Indigenous Peoples and the Future of Federalism presents legal analyses that explore forms of federalism and their potential to include multiple and divided sovereignties. This collection aims to advance reconciliation with Indigenous peoples in Canada and elsewhere by developing jurisprudence on the possibilities for a nation-to-nation relationship between Indigenous nations and Crown sovereignty. Studies of indigenous peoples’ opposition to extractive industries have tended to focus on its economic, political or social aspects, as if these were discrete dimensions of the conflict. In contrast, this book offers a comprehensive and interdisciplinary understanding of the tensions between indigenous peoples’ territorial rights and the governance of extractive industries and related state developmental policies. Analysing the contentious process pushed by indigenous peoples for implementing pluri-nationality against extractive projects and pro-extractive policies, the book compares the struggle for territorial rights in Bolivia, Ecuador and Peru. Centrally, it argues that indigenous territorial defenses against the extractive industries articulate a politics of self-determination that challenges coloniality as the foundation of the nation-state. The resource governance of the nation-state assumes that indigenous peoples must be integrated or assimilated within multicultural arrangements as ethnic minorities with proprietary entitlements, so they can participate in the benefits of development. As the struggle for indigenous self-determination in Latin America maintains that indigenous peoples must not be considered as ethnic communities with property rights, but as nations with territorial rights, this book argues that it offers a radical re-imagination of politics, development, and constitutional arrangements. Drawing on detailed case studies, this book’s multidisciplinary account of indigenous movements in Latin America will appeal to those with relevant interests in politics, law, sociology and development studies.

This paper argues that part of this variation has its roots in the colonial era. Colonizers engaged in different economic activities in different regions of a country, depending on local conditions. Some activities were "bad" in the sense that they depended heavily on the exploitation of labor and created extractive institutions, while "good" activities created inclusive institutions. The authors show that areas with bad colonial activities have lower gross domestic product per capita today than areas with good colonial activities. Areas with high pre-colonial population density also do worse today. In particular, the positive effect of "good" activities goes away in areas with high pre-colonial population density. The analysis attributes this to the "ugly" fact that colonizers used the pre-colonial population as an exploitable resource. The intermediating factor between history and current development appears to be institutional differences across regions and not income inequality or the current ethnic composition of the population.

Drawing on a variety of theoretical perspectives and approaches, this book explores the ways in which social movements in the Global South are rejecting Western-centric notions of development and modernization, as well as creating their own alternatives. By assessing development theories from the perspective of subaltern groups and movements, the contributors posit a new notion of development ‘from below’, one in which these movements provide new ways of imagining social transformation, and a way out of the ‘developmental dead end’ that has so far characterized post-development approaches. Beyond Colonialism, Development and Globalization therefore represents a radical break with the prevailing narrative of modernization, and points to a bold new direction for development studies.

Book excerpt: Many of Bolivia's poorest and most vulnerable citizens work as vendors in the Cancha mega-market in the city of Cochabamba, where they must navigate systems of informality and illegality in order to survive. In Owners of the Sidewalk Daniel M. Goldstein examines the ways these systems correlate in the marginal spaces of the Latin American city. Collaborating with the Cancha's legal and permanent stall vendors (fijos) and its illegal and itinerant street and sidewalk vendors (ambulantes), Goldstein shows how the state's deliberate neglect and criminalization of the Cancha's poor—a practice common to neoliberal modern cities—makes the poor exploitable, governable, and consigns them to an insecure existence. Goldstein's collaborative and engaged approach to ethnographic field research also opens up critical questions about what ethical scholarship entails.
