Book excerpt: When there is concern with deficit or debt levels, Congress will sometimes implement budget enforcement mechanisms to mandate specific budgetary policies or fiscal outcomes. The Budget Control Act of 2011(BCA; P.L. 112-25), which was signed into law on August 2, 2011, includes several such mechanisms. The BCA as amended has three main components that currently affect the annual budget. One component imposes annual statutory discretionary spending limits for defense and non-defense spending. A second component requires annual reductions to the initial discretionary spending limits triggered by the absence of a deficit reduction agreement from a committee formed by the BCA. Third are annual automatic mandatory spending reductions triggered by the same absence of a deficit reduction agreement. Each of those components is described in further detail in this report. The discretionary spending limits (and annual reductions) are currently scheduled to remain in effect through FY2021, while the mandatory spending reductions are scheduled to remain in effect through FY2025. Congress may modify or repeal any aspect of the BCA procedures, but such changes require the enactment of legislation. Several pieces of legislation have changed the spending limits or enforcement procedures included in the BCA with respect to each year from FY2013 through FY2017. These include the American Taxpayer Relief Act of 2012 (ATRA/P.L. 112-240), the Bipartisan Budget Act of 2013 (BBA 2013/P.L. 113-67, also referred to as the Murray-Ryan agreement), and the Bipartisan Budget Act of 2015 (BBA 2015/P.L. 114-74). Those laws included changes to the discretionary limits imposed by the BCA that increased deficits in each year from FY2013-FY2017. No change has been enacted for FY2018 and beyond, so the discretionary spending limits for FY2018 through FY2021 remain at the level prescribed by the BCA. The discretionary caps in FY2018 are scheduled to be approximately $549 billion for defense activities and $516 billion for nondefense activities This report addresses several frequently asked questions related to the BCA and the annual budget.

BBEDCA has been amended many times, including by the Budget Enforcement Act of 1990, the Statutory Pay-As-You-Go Act of 2010, the Budget Control Act of 2011, the American Taxpayer Relief Act of 2012, and the Bipartisan Budget Act of 2013. This body of law is classified in sections 900 through 907d in title 2 of the United States Code. During fiscal year 2013, several laws changed the timing and amount of sequestration.

Each fiscal year Congress and the President undertake a variety of steps intended to set levels of spending and revenue and to make policy decisions. The purpose of this report is to provide an overview and background on the current budget debate. This report will track legislative events related to the federal budget and will be updated as budgetary legislation moves through Congress. In recent years, policies enacted to restrain spending, along with a stronger economy, have led to reductions in the budget deficit. On August 2, 2011, the President signed into law the Budget Control Act of 2011 (P.L. 112-25). The BCA contained a variety of measures intended to reduce the deficit by at least $2.1 trillion over the FY2012-FY2021 period, along with a mechanism to increase the debt limit. Two subsequent pieces of legislation have modified the BCA since it was enacted-the American Taxpayer Relief Act of 2012 (ATRA; P.L. 112-240) and the Bipartisan Budget Act of 2013 (BBA; P.L. 113-67). Both pieces of legislation allow for more discretionary spending than was provided under the BCA for FY2013, FY2014, and FY2015. Various deficit reduction measures were included to offset the costs of the changes to spending levels in both ATRA and the BBA. The BCA and the BBA will continue to affect spending levels in FY2015 and beyond as Congress may debate whether or not to enact further changes. The Obama Administration released its FY2015 budget in two parts-the first on March 4, 2014, and the second on March 10, 2014. In his budget, President Obama proposes an "Opportunity, Growth, and Security Initiative" to provide additional funding for unspecified discretionary programs in FY2015. The budget also proposes to eliminate the BCA sequester on mandatory programs in FY2015. These proposals yield a deficit for FY2015 that is slightly higher than what is currently projected in the CBO baseline. Congressional consideration of FY2015 budget and appropriations legislation has already begun. The BBA contained a provision directing the House and Senate Budget Committee chairmen to file spending and revenue levels in the Congressional Record that would be enforceable in the same manner as a concurrent budget resolution for FY2015 if an agreement on a budget resolution could not be reached by April 15, 2014. However, nothing would preclude Congress from acting on a budget resolution for FY2015 even after those levels have been filed. It has been reported that Senate Budget Committee Chairman Patty Murray has signaled that the provisions contained in the BBA make a budget resolution for FY2015 unnecessary. On April 10, 2014, the House agreed to a budget resolution (H.Con.Res. 96, 113th Congress) by a vote of 219 to 205.

It entails dozens of subprocesses, countless rules and procedures, the efforts of tens of thousands of staff persons in the executive and legislative branches, and the active participation of the President, congressional leaders, Members of Congress, and members of the executive branch. This analysis shows the various elements of the federal budget process including the President's budget submission, framework, timetable, the budget resolution, reconciliation, the "Byrd Rule," appropriations, authorizations, and budget execution. Congress is distinguished from nearly every other legislature in the world by the control it exercises over fashioning the government's budgetary policies. This power, referred to as "the power of the purse," ensures Congress' primary role in setting revenue and borrowing policies for the federal government and in determining how these resources are spent. The congressional power of the purse derives from several key provisions in the Constitution. Article I, Section 8, Clause 1 (Power to tax and spend) declares in part that Congress shall have the power to raise (that is, "to lay and collect") revenues of various types, including taxes and duties, among other things. Article I, Section 8, Clause 2 (Borrowing power) declares that the power to borrow funds "on the credit of the United States" belongs to Congress. In addition to its powers regarding revenues and borrowing, Congress exerts control over the expenditure of funds. Article I, Section 9, Clause 7 declares in part that funds can be withdrawn from the Treasury only pursuant to laws that make appropriations. Under the Constitution, revenue measures must originate in the House of Representatives. Beyond this requirement, however, the Constitution does not prescribe how the House and Senate should organize themselves, or the procedures they should use, to conduct budgeting. Over the years, however, both chambers have developed an extensive set of rules (some set forth in statute) and precedents that lay out complicated, multiple processes for making budgetary decisions. The House and Senate have also created an intricate committee system to support these processes. As American society has grown and become ever more complex, and as the role of the federal government in the national economy has steadily expanded, Congress also has increasingly shared power over budgetary matters with the president and the executive branch. It has refashioned the president’s role in budgeting by requiring him to submit to Congress each year a budget for the entire federal government and giving him responsibilities for monitoring agencies’ implementation of spending and revenue laws.
