"All persons sick with smallpox, cholera, scarlet fever, diphtheria, epidemic cerebro-spinal meningitis or any contagious or infectious diseases dangerous to the public health shall be thoroughly isolated from the public and properly quarantined." (Id. sec. 3309.) See, also, sections 3306, 3310, 3316, and 6668, General Statutes 1901. Your question therefore divides itself into two questions; first, shall the individual pay for the fumigation and disinfection, or, shall the municipality pay for the same? and second, if it be decided that the municipality should pay for it, should the county or the city pay? There seems to be in the decisions of the courts a well-defined position that the municipality should pay for all of the work of quarantine, disinfection, etc., that is done for the purpose of preventing the spread of the disease. In other words, it is the individual's duty unless he be a poor and indigent person, to pay for medicines, and such medical attendance, nursing, etc., as is required to cure him of the disease, and it is the duty of the municipality to pay all of the expenses which go to the prevention of the spread of the disease. Of course if the patient be a poor and indigent person, or if by reason of neglect the disease would thereby be liable to become disseminated or scattered in the community, then doubtless it would be the duty of the municipality to step in and see that the persons were cured of the disease and taken care of by compulsion, if necessary. Excerpt: ...and which are unoccupied by the purchaser or his assigns shall be reappraised, and may be purchased by any person in accordance with the provisions of this act, and in all cases lands which have not been claimed or purchased shall be reappraised every five years; provided, that they may be reappraised at any time on petition of onehalf of the bona fide householders of the township in which the lands lie to the board of county commissioners of the county, at their discretion." So you see this section provides that lands which have been forfeited may be reappraised, and when reappraised of course they may be advertised by the county treasurer as indicated above, and parties may buy them at public auction, if there are no actual residents living thereon. If the lands have not been reappraised, the county commissoners may have them reappraised when a petition is presented to them signed by one-half of the bona fide householders of the township; and in a great many of these townships there are very few bona fide householders and it would not be a great deal of trouble to get this kind of a petition. You will observe that section 5786 of the Compiled Laws of 1889 also bears somewhat upon this same subject, as it provides that "in all cases where school lands fail to sell, as provided for in this act, the county treasurer may dispose of said lands at private sale, to actual settlers only, in tracts not exceeding 160 acres to each purchaser; provided, that no sale be made at less than the appraised value of the land and improvements; and provided further, that if school lands once offered at public sale are not sold within one year from-the time of said sale they shall be reappraised and sold at public auction as other school lands are...
