Book Synopsis Decolonising International Law by : Sundhya Pahuja
Download or read book Decolonising International Law written by Sundhya Pahuja and published by Cambridge University Press. This book was released on 2011-09-29 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The universal promise of contemporary international law has long inspired countries of the Global South to use it as an important field of contestation over global inequality. Taking three central examples, Sundhya Pahuja argues that this promise has been subsumed within a universal claim for a particular way of life by the idea of 'development'. As the horizon of the promised transformation and concomitant equality has receded ever further, international law has legitimised an ever-increasing sphere of intervention in the Third World. The post-war wave of decolonisation ended in the creation of the developmental nation-state, the claim to permanent sovereignty over natural resources in the 1950s and 1960s was transformed into the protection of foreign investors, and the promotion of the rule of international law in the early 1990s has brought about the rise of the rule of law as a development strategy in the present day.
Book Synopsis Public Philosophy in a New Key: Volume 1, Democracy and Civic Freedom by : James Tully
Download or read book Public Philosophy in a New Key: Volume 1, Democracy and Civic Freedom written by James Tully and published by Cambridge University Press. This book was released on 2008-12-18 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: These two ambitious volumes from one of the world's most celebrated political philosophers present a new kind of political and legal theory that James Tully calls a public philosophy, and a complementary new way of thinking about active citizenship, called civic freedom. Professor Tully takes the reader step-by-step through the principal debates in political theory and the major types of political struggle today. These volumes represent a genuine landmark in political theory from the author of Strange Multiplicity, one of the most influential and distinctive commentaries on politics and the contemporary world published in recent years. This first volume of Public Philosophy in a New Key consists of a presentation and defence of a contextual approach to public philosophy and civic freedom, and then goes on to study specific struggles over recognition and distribution within states.

Book Synopsis The Occurrence of Separate Opinions at the Federal Constitutional Court by : Caroline Wittig
Download or read book The Occurrence of Separate Opinions at the Federal Constitutional Court written by Caroline Wittig and published by Logos Verlag Berlin GmbH. This book was released on 2016-12-31 with total page 181 pages. Available in PDF, EPUB and Kindle. Book excerpt: Courts with the right to constitutional review exert considerable power in a political system. However, especially for Kelsenian constitutional courts there are hardly any large-N studies. This is mainly due to a lack of data. For the German Federal Constitutional Court, this gap has been closed by building a novel database, the development of which is depicted in this book. Employing data from this database, the occurrence of separate opinions in general and their different types in particular are analyzed. The book introduces a new, universal theory that reconciles and expands existing explanations. In a second step, the theory is applied to the German Federal Constitutional Court. It can be proven that one factor that has been neglected so far plays a decisive role: The judges' behavior depends on the profession they pursue after their time in office. Moreover, the study shows that - contrary to the common literature - it is not mainly the topic that determines a case's conflict potential but rather the number of issues a decision has to address.

Book Synopsis The International Protection of Internally Displaced Persons by : Catherine Phuong
Download or read book The International Protection of Internally Displaced Persons written by Catherine Phuong and published by Cambridge University Press. This book was released on 2005-01-27 with total page 326 pages. Available in PDF, EPUB and Kindle. Book excerpt: Despite the fact that there are up to 25 million internally displaced persons around the world, their plight is still little known. Like refugees, internally displaced persons have been forced to leave their homes because of war and human rights abuses, but they have not left their country. This has major consequences in terms of the protection available to them. This 2005 book aims to offer a clear and easily accessible overview of this important humanitarian and human rights challenge. In contrast with other books on the topic, it provides an objective evaluation of UN efforts to protect the internally displaced. It will be of interest to all those involved with the internally displaced, as well as anyone seeking to gain an overall understanding of this complex issue.
