Available in PDF, EPUB and Kindle. Book excerpt: In 1963, West Germany was gripped by a dramatic trial of former guards who had worked at the Nazi death camp Auschwitz. It was the largest and most public trial to take place in the country and attracted international attention. Using the pretrial files and extensive trial audiotapes, Rebecca Wittmann offers a fascinating reinterpretation of Germany's first major attempt to confront its past. Evoking the courtroom atmosphere, Wittmann vividly recounts the testimony of survivors, former SS officers, and defendants--a cross-section of the camp population. Attorney General Fritz Bauer made an extraordinary effort to put the entire Auschwitz complex on trial, but constrained by West German murder laws, the prosecution had to resort to standards for illegal behavior that echoed the laws of the Third Reich. This provided a legitimacy to the Nazi state. Only those who exceeded direct orders were convicted of murder. This shocking ruling was reflected in the press coverage, which focused on only the most sadistic and brutal crimes, allowing the real atrocity at Auschwitz--mass murder in the gas chambers--to be relegated to the background. The Auschwitz trial had a paradoxical result. Although the prosecution succeeded in exposing SS crimes at the camp for the first time, the public absorbed a distorted representation of the criminality of the camp system. The Auschwitz trial ensured that rather than coming to terms with their Nazi past, Germans managed to delay a true reckoning with the horror of the Holocaust.

Book excerpt: In the end, out of nothing at all, an enormous fabric of guilt will be conjured up. One morning Josef K. is arrested for a crime he did not commit. In fact, he is never even told the nature of the offense. His life is thrown into turmoil as he becomes enmeshed in a struggle to prove his innocence. As the confounding case unfolds, K. is ultimately powerless - battling against a remote and uncaring bureaucracy. This edition features a new translation by Isabel Tucker. Due to its posthumous publication, The Trial 's original text is largely unedited and Tucker emends certain details while retaining the enigmatic and surreal style which marks Kafka's brilliance. Filled with psychological tension and disconcerting parallels with the modern world, The Trial is a dystopian masterpiece by one of the greatest writers in the German-language.

Deepening cynicism, the growth of corrosive individualism, statism, and the loss of civil society are warning signs that democracy may be incapable of satisfying the yearnings it itself unleashes - yearnings for freedom, fairness, and equality. In her 1993 CBC Massey Lectures, political philosopher Jean Bethke Elshtain delves into these complex issues to evaluate democracy's chances for survival.

Available in PDF, EPUB and Kindle. Book excerpt: After the Civil War, Republicans teamed with activist African Americans to protect black voting rights through innovative constitutional reforms--a radical transformation of southern and national political structures. The Trial of Democracy is a comprehensive analysis of both the forces and mechanisms that led to the implementation of black suffrage and the ultimate failure to maintain a stable northern constituency to support enforcement on a permanent basis. The reforms stirred fierce debates over the political and constitutional value of black suffrage, the legitimacy of racial equality, and the proper sharing of power between the state and federal governments. Unlike most studies of Reconstruction, this book follows these issues into the early twentieth century to examine the impact of the constitutional principles and the rise of Jim Crow. Tying constitutional history to party politics, The Trial of Democracy is a vital contribution to both fields.

Available in PDF, EPUB and Kindle. Book excerpt: The Trial of Anne Hutchinson re-creates one of the most tumultuous and significant episodes in early American history: the struggle between the followers and allies of John Winthrop, governor of the Massachusetts Bay Colony, and those of Anne Hutchinson, a strong-willed and brilliant religious dissenter. The controversy pushed Massachusetts to the brink of collapse and spurred a significant exodus. The Puritans who founded Massachusetts were poised between the Middle Ages and the modern world, and in many ways, they helped to bring the modern world into being. The Trial of Anne Hutchinson plunges participants into a religious world that will be unfamiliar to many of them. Yet the Puritans' passionate struggles over how far they could tolerate a diversity of religious opinions in a colony committed to religious unity were part of a larger historical process that led to religious freedom and the modern concept of separation of church and state. Their vehement commitment to their liberties and fears about the many threats these faced were passed down to the American Revolution and beyond.

Book excerpt: The International Criminal Court (ICC) has run into serious problems with its first big case -- the situation in northern Uganda. There is no doubt that appalling crimes have occurred here. Over a million people have been forced to live in overcrowded displacement camps under the control of the Ugandan army. Joseph Kony's Lord's Resistance Army has abducted thousands, many of them children and has systematically tortured, raped, maimed and killed. Nevertheless, the ICC has confronted outright hostility from a wide range of groups, including traditional leaders, representatives of the Christian Churches and non-governmental organizations. Even the Ugandan government, which invited the court to become involved, has been expressing serious reservations. Tim Allen assesses the controversy. While recognizing the difficulties involved, he shows that much of the antipathy towards the ICC's intervention is misplaced. He also draws out important wider implications of what has happened. Criminal justice sets limits to compromise and undermines established procedures of negotiation with perpetrators of violence. Events in Uganda have far reaching implications for other war zones - and not only in Africa. Amnesties and peace talks may never be quite the same again.
