Book excerpt: Excerpt from Bench and Bar of Colorado In the printed arguments which are addressed to the appellate courts, the case is but little better, since they are buried in the files of the court, read only by the counsel on the other side, and the court, and bv it often not understand ingly, and without sufficient attention to the facts to follow the argument, much less to give it the credit and weight which it deserves. So, while the judgment of the court on what the law is, is recorded, the argument Of the lawver as to what it should be, is recalled only to be forgotten. Book excerpt: Excerpt from Morrison's Corporation Law Colorado Since the publication of the Third Edition, Colonel Morrison departed this life in an accident on the Interurban between Boulder and Denver. The third edition being exhausted, the demand makes it necessary to bring out this new edition; and the undersigned undertook the work of preparing the new edition, thinking that the original style and character of the work of the late Colonel Morrison could in this way be best retained and maintained. All new Legislative Enactments have been added or substituted and the Colorado Decisions affecting corporations cited and quoted therefrom. A form for a Declaration of Trust and Certificate of shares for a Common Law Corporation has been added, as well as a little preliminary matter. The object of the work is to supply the lawyers and others interested in corporations, the Statutory Law and the Judicial Decisions affecting same as well as all the Forms that will ordinarily be used. The Statutes reprinted and referred to are the sections of the new Mills Annotated Statutes. The work is submitted to the Bench, Bar and Others with the hope that it will be found a complete commentary on the Corporation Law of the State of Colorado. His fellow men. But Winfield' 5 children had died, one by one, in childhood, and it is pathetic to recall that he sank to his long sleep while addressing little children on a peaceful Sunday afternoon in June, just sixty-six years after his eyes had opened not far away on a world in which he was destined to reap many cruel sorrows, some substantial rewards, and all the mocking, delusive delights of a transient fame. His friend, Judge Gedney, followed him only a month later as he sat upon the porch of his home in Goshen. As together they had journeyed through life, sharing its burdens and its conflicts, so in death they were not long separated, and in the manner of their summons they were alike blessed, for to neither did it come upon a bed of lingering illness. Book excerpt: Excerpt from Sketches of the Bench and Bar of Tennessee This book is intended to be contribution to the history of Tennessee. It is also, in some measure, the outcome of professional pride. Its literary quality is not high. Many of the articles are of the kind to be found in encyclopedias - bare recitals of dates and facts. The labor devoted to the collection of material has been much greater than the Sketches indicate. It required six months to find when and where one of our greatest orators was born. Repetition of facts and monotony of phrase could not be avoided. Above everything, accuracy has been sought, but after all, it is in respect of dates that the book is likely to prove most defective. The serious trouble encountered on this point will be shown by the statement that three different documents relating to one judge give each a different date for his death, and it is impossible to find which is right. Book excerpt: Excerpt from The Government of the People, of the State of Colorado In the preparation of this work, the aim has been, not to present a hand-book of condensed facts, but through interest and suggestion, to stimulate the desire for individual investigation. In accordance with this view, the school library should be provided with the Session Laws, issued by the Secretary of State, since 1887. In this connection a set of Mills' Annotated Statutes (3 vols.) and a set of Hall's History of Colorado (4 vols.) will prove valuable aids. The teacher and pupils should make a collection of primary, convention and election calls, official ballots, blanks used by various officers and the official reports of State and local officers. The pupil should be led to discover the principles of government by his own thought and labor. To assist and direct in this work numerous references have been given to the Constitution. In the study of government nothing can take the place of the Constitution. To use the "Studies" profitably, will require much conscientious preparation on the part of the teacher. The instructor should encourage intelligent observation of all those things with which the citizen has to do in every-day life. That knowledge of government is valueless which does not inspire the pupil, at the proper time, to the performance of civic duties; which does not lead him to realize that obedience to authority is the fundamental basis of patriotism. Criticisms, suggestions and questions that may occur to teachers who use this book will be received in the professional spirit. The author desires to express his obligations to Professor N. M. Fenneman, his colleague, at whose suggestion this book was undertaken, and to others who have kindly aided with advice and information. For the purpose of uniformity, the plan and portions of the text of this book are similar to those in other works of the series of which it is a part.
