Available in PDF, EPUB and Kindle. Book excerpt: Presenting a critique of conventional methods in comparative law, this book argues that, for comparative law to qualify as a discipline, comparatists must reflect on how and why they make comparisons. Günter Frankenberg discusses not only methods and theories, but also the ethical implications and the politics of comparative law in bringing out the different dimensions of the discipline. Comparative Law as Critique offers various approaches that turn against the academic discourse of comparative law, including analysis of a widespread spirit of innocence in terms of method, and critique of human rights narratives. It also examines how courts negotiate differences between cases regarding Muslim veiling. The incisive critiques and comparisons in this book will be of essential reading for comparatists working in legal education and research, as well as students of comparative law and scholars in comparative anthropology and social sciences.

Available in PDF, EPUB and Kindle. Book excerpt: This book explores the Paris Ecole Militaire as an institution, arguing for its importance as a school that presented itself as a model for reform during a key moment in the movement towards military professionalism as well as state-run secular education. The school is distinguished for being an Enlightenment project, one of its founders publishing an article on it in the Encyclopédie in 1755. Its curriculum broke completely with the Latin pedagogy of the dominant Jesuit system, while adapting the legacy of seventeenth-century riding academies. Its status touches on the nature of absolutism, as it was conceived to glorify the Bourbon dynasty in a similar way to the girls’ school at Saint Cyr and the Invalides. It was also a dispensary of royal charity calculated to ally the nobility more closely to royal interests through military service. In the army, its proofs of nobility were the model for the much debated 1781 Ségur decree, often described as a notable cause of the French Revolution.

Available in PDF, EPUB and Kindle. Book excerpt: European harmonisation efforts such as a European civil code, European constitutional treaties, European principles, and European fundamental rights are frequently criticised for building on or creating a European legal culture that does not exist; in reality what we have is European legal pluralism. Some have argued that the pluralistic structure of European law hinders the development of a community, which is a necessary requirement for a European legal culture. And if there can be no common European legal culture then there is no basis for harmonising exercises. The contributors to this book explore in different legal areas whether in fact the contrary is true. Cultural pluralism might indeed be a distinctive feature of European legal culture. Diversity is not something that is in opposition to, but rather constitutes a new, different understanding of European legal culture. The contributions demonstrate in detail how such an approach inter alia in the areas of private, corporate, administrative and constitutional law furthers understanding of a developing European legal culture, how it offers theoretical and doctrinal insights, and how it adds critical perspective.

Available in PDF, EPUB and Kindle. Book excerpt: Moving from the scientific revolution to the nineteenth-century rise of legal codes, Berkowitz tells the story of how lawyers and philosophers invented legal science to preserve law's claim to moral authority. The "gift" of science, however, proved bittersweet. Instead of strengthening the bond between law and justice, the subordination of law to science transformed law from an ethical order into a tool for social and economic ends.

Book excerpt: 'People should not leave looking-glasses hanging in their rooms any more than they should leave open cheque books or letters confessing some hideous crime.' 'If she concealed so much and knew so much one must prize her open with the first tool that came to hand - the imagination.' Virginia Woolf's writing tested the boundaries of modern fiction, exploring the depths of human consciousness and creating a new language of sensation and thought. Sometimes impressionistic, sometimes experimental, sometimes brutally cruel, sometimes surprisingly warm and funny, these five stories describe love lost, friendships formed and lives questioned. This book includes The Lady in the Looking Glass, A Society, The Mark on the Wall, Solid Objects and Lappin and Lapinova.

Book excerpt: Orestes was produced in 1750, an experiment which intensely interested the literary world and the public. In his Dedicatory Letters to the Duchess of Maine, Voltaire has the following passage on the Greek drama: "We should not, I acknowledge, endeavor to imitate what is weak and defective in the ancients: it is most probable that their faults were well known to their contemporaries. I am satisfied, Madam, that the wits of Athens condemned, as well as you, some of those repetitions, and some declamations with which Sophocles has loaded his Electra: they must have observed that he had not dived deep enough into the human heart. I will moreover fairly confess, that there are beauties peculiar not only to the Greek language, but to the climate, to manners and times, which it would be ridiculous to transplant hither. Therefore I have not copied exactly the Electra of Sophocles-much more I knew would be necessary; but I have taken, as well as I could, all the spirit and substance of it."
