Book excerpt: This volume assesses the evolution of Spain's external relations during the 1990s, within and beyond Europe, and assesses the principal challenges facing the country at the beginning of the twenty-first century. The coincidence of several crucial global and European developments has had a profound effect on Spain. Adjustment of the economy and changes in foreign policy perspectives have become unavoidable. In turn, Spain, as an increasingly self-confident member of the EU, has itself become a significant actor in European-level developments. Spain's relationship with Europe and the wider world is increasingly balanced between new constraints and new opportunities for international influence.

Available in PDF, EPUB and Kindle. Book excerpt: European Union Enlargement provides a comparative analysis of the post-war European policies of those states that joined the European Union between 1973 and 1995. The volume draws upon new empirical research in order to investigate the policies that these 'newcomer' states have had towards Europe since 1945, with an emphasis on their experience of membership and its possible Europeanising effect. A final comparative chapter draws the national European policies of the 'newcomers' together and outlines what they have brought to the EU. The book also tests integration theories against the available evidence, demonstrating their limited explanatory value and the economic, political and cultural specificity of different national paths towards EU integration.

Book excerpt: The Oxford Handbook of Spanish Politics provides a comprehensive and comparative overview of the Spanish political system through the lens of political science. It aims to move away from a complacent analysis of Spanish democracy and provide a nuanced view of some of its strengths and challenges. The Handbook introduces Spanish politics to an international audience of scholars and practitioners. It is structured around six sections that cover Spain's political history, institutional changes, elections, civil society, policy-making, and foreign affairs. The volume brings together a distinguished group of 47 internationally renowned scholars who study Spain in its own right, or as a case among others in a comparative perspective. The contributors provide expert accounts of contemporary Spain, making the Oxford Handbook of Spanish Politics an invaluable resource for anyone interested in Spanish politics and government since the country's transition to democracy.

Available in PDF, EPUB and Kindle. Book excerpt: Spain and the EU takes the country's accession to the European Community in 1986 as its starting point and traces the changes in the national and regional economy, the shifts in national economic policy, and the fundamental restructuring of a public sector only recently enlarged as a result of the country's transition to democracy. The book identifies the challenges that continue to confront the Spanish polity under monetary integration in the pursuit of convergence towards the EU model, while retaining national cohesion. Aimed at an academic and general audience, the issues raised in this book have broader lessons for the management of integration at the national and sub-national level, particularly for new member states.

Available in PDF, EPUB and Kindle. Book excerpt: This book presents a comprehensive review of fundamental rights issues that are currently in the spotlight. The first part explores why the question of whether or not fundamental rights have horizontal effect is a topic of endless debate. The second part focuses on human rights and the rule of law. It begins by arguing that the hitherto valid model of the rule of law is now outdated, and then goes on to outline the importance of the judicial dimension in countering threats to the independence of the judiciary. Lastly, the third part addresses a classic issue in the field of human rights: states’ margin of appreciation, highlighting two aspects: (i) the elements used by the ECJ to determine the scope of the margin of appreciation, which varies depending on the subject matter, the nature of the right in question, as well as the severity and the purpose of the interference; and (ii) the margin of appreciation enjoyed by national courts when interpreting the law. Exploring current issues concerning a topic of eternal interest, the book will appeal to scholars and practitioners alike. Written by formidable intellectual talents, committed to the study of fundamental rights, it rigorously analyses the most recent judgments of both the ECJ and the ECHR.

This book was released on 1996-06-26 with total page 606 pages. Available in PDF, EPUB and Kindle. Book excerpt: Just how International and European Community Law is being integrated into domestic legal systems is as yet not too well known. To gain a clear overview of this grey area requires more than knowing about the various constitutional rules. What is also needed is a study of little-known administrative practices and the attitudes of the national courts, where case-law is often as complex as it is diverse. When all these elements are taken into account, the general picture that emerges is a much more subtle one, transcending the classical positions based on the theories of monism and dualism. To grasp this reality and go beyond preconceived ideas, it seemed indispensable to make a thorough analysis of national practices. To this end, the International Law Centre of the University of Paris XIII (Cedin Paris XIII) took the initiative, in 1990, of setting up a network of European international lawyers to work on the theme International norms and legal barriers'. This book presents the outcome of the network's programme. The research was organized on the basis of a single questionnaire which provided the outline of a common workplan, to which each of the contributors has adhered. Detailed comparisons of national practices can now be made, relating in particular to international treaties, acts of international organisations and of the European Communities, and to unwritten international law. This is the first time that such a comprehensive and detailed survey has been made of all thirteen countries. Reading the national reports one after the other provides complete information on domestic practices; reading them crosswise gives a direct comparison between the different countries on specificissues.
