Sin embargo, es necesario distinguir ambos tipos de plataformas, averiguar cuál es su naturaleza jurídica y, obviamente, su responsabilidad o no con los usuarios.El tratamiento de estas plataformas y la eventual competencia que realizan a los modelos de negocio tradicionales son otras de las cuestiones más acuciantes a las que debemos dar respuesta. Obviamente, el tratamiento jurídico de cada una de estas formas de transacción no puede ser el mismo, pero todos aquellos que de forma directa o indirecta encajen en modelos de negocios entre impares deben tener algún tipo de ordenación por cuanto, también aquí, la eventual desigualdad de quienes suscriben de forma masiva estos pactos, sobre todo en el caso de los consumidores con las plataformas que prestan los servicios subyacentes, deben quedar sujetos a las mismas normas que aquellos otros servicios similares que se prestan offline.A todo lo anterior, se suman los reiterados conflictos entre los conductores con licencias VTC y los taxistas, obligándonos a abordar el estudio detallado de ambos sectores para tratar de resolver algunos de los problemas que se generan día a día. Por tanto, también afrontamos la concreta relación jurídica que hoy se concierta en la demanda de estos servicios de transporte, su naturaleza jurídica y su ordenación

Asimismo, aporta una perspectiva sociológica al estudio de las plataformas de intercambio para establecer una tipología que identifique los diferentes modelos económicos y sociales a los que responden. De este modo, se identifican empíricamente dos tendencias contrapuestas en la economía digital: una que avanza hacia la intensificación del capitalismo digital, la precariedad y la concentración de riqueza; y otra que explora diferentes formas de economía comunitaria, orientadas a satisfacer necesidades sociales a partir de relaciones igualitarias, realmente colaborativas. Como conclusión, se reflexiona sobre la relación dialéctica entre los principios de valor sobre los que se sostiene cada una de estas tendencias.En este proceso, esta investigación apuesta por el desarrollo de una sociología de las instituciones digitales, proponiendo un marco teórico y metodológico desde el que estudiar cómo, en términos generales, las plataformas digitales construyen nuevas realidades. Desde esta perspectiva, las plataformas —y las organizaciones que hay detrás de ellas— se constituyen como nuevas instituciones sociales, capaces de producir grandes procesos de socialización, así como de ocupar posiciones clave en la sociedad actual.
