Book excerpt: This book’s basic hypothesis – which it proposes to test with a cognitive-sociological approach – is that legal behavior, like every form of human behavior, is directed and framed by biosocial constraints that are neither entirely genetic nor exclusively cultural. As such, from a sociological perspective the law can be seen as a super-meme, that is, as a biosocial constraint that develops only in complex societies. This super-meme theory, by highlighting a fundamental distinction between defensive and assertive biases, might explain the false contradiction between law as a static and historical phenomenon, and law as a dynamic and promotional element. Socio-legal scholars today have to face the challenge of pursuing a truly interdisciplinary approach, connecting all the fields that can contribute to building a modern theory of normative behavior and social action. Understanding and framing concepts such as rationality, emotion, or justice can help to overcome the significant divide between micro and macro sociological knowledge. Social scientists who are interested in the law must be able to master the epistemological discourses of different disciplines, and to produce fruitful syntheses and bridge-operations so as to understand the legal phenomenon from each different point of view. The book adopts four perspectives: sociological, psychological, biological-evolutionary and cognitive. All of them have the potential to be mutually integrated, and constitute that general social science that provides common ground for exchange. The goal is to arrive at a broad and integrated view of the socio-legal phenomenon, paving the way for a comprehensive theory of norm-oriented and norm-perceived actions.

This analysis is also needed to explain the woeful economic, and governmental and administrative performance of the strata that finally reached the levers of power. The Italian society and social and political system are in a crisis: development is uneven and the bureaucratic structures are in shambles. The roots of this crisis lie in the endemic underdevelopment typical of the second half of the nineteenth century. Clearly, they cannot be attributed to the historic failures of Fascism, Democracy, Catholicism or Marxism in Italy, but they are the outcome of a long history of underdevelopment followed by extremely uneven regional evolution leading to tremendous cleavages between ultra-modern and utterly antiquated phenomena, the juxtaposition of flexibility and rigidity, of optimistic enthusiasm and hidebound traditionalism, of extreme wealth and abysmal poverty, of high and low levels of earnings, and of a maladjusted, ill-functioning, uneasy combination of agricultural, industrial, and post-industrial society. All this is aggravated by the crisis in the church and by the North-South situation in which many millions of people have migrated from the South to the North, and by the ensuing struggle between a mass of lumpen proletarians and proletarian immigrants from the South, who are exploited as a work force for the industrial development of the North.

Book excerpt: The notion that there is no alternative to capitalism emerged after the fall of the Berlin Wall and made rapid headway due to increasing economic globalisation. More recently, this belief that there is no viable alternative has held firm despite the financial crisis, high unemployment levels and an ever-increasing gap between rich and poor. However, since the appearance of Benjamin Ward’s seminal 1958 article, economic theorists have been developing a workable alternative: a system of self-managed firms. The core argument outlined in this book is that a well-organised system of producer cooperatives would give rise to a new mode of production and, ultimately, a genuinely socialist society. This argument is developed through three key steps. First, following on from Jaroslav Vanek’s definition, it is argued that a ‘Labour-Managed Firm’, a firm which strictly segregates capital incomes from labour incomes, would implement a new production mode because it would reverse the pre-existing relation between capital and labour. Second, given that a system of these ‘Labour-Managed Firm’ cooperatives would reverse the capital-labour relationship, it is suggested that this would constitute a form of market socialism. Third, it is argued that compared to capitalism a system of producer cooperatives offers a wealth of advantages, including the potential for efficiency gains, the eradication of unemployment and the end of exploitation. Ultimately, this book concludes that self-management could take the place of central planning in Marxist visions for the future.
