Book excerpt: A district convention held to elect a person to be appointed to fill a vacancy in a district office is subject to K.S.A. 1990 Supp. 25-3902. The county chairperson must, within 10 days of receipt of notice that a vacancy has occurred or will occur, call a convention by mailing a notice to the persons designated in subsection (b) or (c) of K.S.A. 1990 Supp. 25-3902. The convention is to be convened and held as soon as is reasonable and practicable after the appropriate time as set forth in subsection (b) or (c) has elapsed. An actual vacancy need not exist before the convention is called and held. K.S.A. 13-1802 precludes a member of the board of commissioners of a city of the first class from simultaneously serving as a state representative. The common law doctrine of incompatibility of offices does not preclude an individual from simultaneously serving as a state representative and as president of a registered lobbying group. However, the ability of an individual to simultaneously serve in both roles is subject to the findings of the Kansas commission on governmental standards and conduct. Book excerpt: Where real property has both agricultural and nonagricultural uses, a court may consider whether the parcels can be split and valued accordingly, or, if the parcels cannot be classified separately, a court may consider which use is primary in order to determine whether the property is devoted to agricultural use pursuant to K.S.A. 1995 Supp. 79-1476. Whether real property is exempt from zoning regulations pursuant to K.S.A. 19-2921 will require a determination, based upon the totality of circumstances, whether the agricultural use is substantial enough to establish that the owner is not masking a residential or nonagriculture use with an agricultural pretense to gain exemption from zoning regulations. Whether a landscaping business qualifies for a zoning exemption pursuant to K.S.A. 19-2921, or may be classified as land devoted to agricultural use pursuant to K.S.A. 1995 Supp. 79-1476, will depend upon the facts, not the label which purports to describe the activity on the property. Moreover, any regulation that seeks to define a percentage ratio for agricultural land may be invalid to the extent it defines agricultural use more restrictively than the courts construe the term. Due to the change in district and precinct boundaries, however, the number of signatures required on nominating petitions cannot be determined. Until the statutory method of calculating the number is changed, the only means of becoming placed on the ballot is by filing fee. The United States Supreme Court has ruled that, based on the Equal Protection Clause of the Constitution, an indigent candidate cannot be required to pay a filing fee, and that a reasonable alternative means of ballot access must be available. Until current law is amended, the filing fee requirement must be waived for persons unable to pay. Book excerpt: K.S.A. 19-101b does not specifically provide a format for a petition demanding that a resolution of a county be submitted to a vote of the electors. Therefore, such a petition must meet the requirements of K.S.A. 25-3602. The petition must clearly state the question which petitioners seek to bring to an election and each circulator must sign a verification at the end of each set of documents which that circulator carried. It is not necessary for each and every document to contain a separate verification. The verification must be accompanied by an oath or affirmation of the circulator stating to the effect that the circulator has personally witnessed the signatures contained on the documents. In lieu of an oath or affirmation, the verification may be accompanied by the statement contained in K.S.A. 1989 Supp. 53-601. However, state statute does not require that the verification be notarized. When no person has sought the nomination of a political party to a particular office at a primary election, the law provides that the ballot shall list the office to be elected, followed by a blank space, so that party members may write in the name of any person they choose to nominate as their party candidate. K.S.A. 25-213, which prescribes the form of a primary election ballot, does not prohibit a person from appearing on the ballot as a candidate for nomination of one political party and at the same time receiving write-in votes sufficient to nominate the person for the same office on the ballot of another political party. K.S.A. 25-213 also does not prohibit a person from appearing on the primary election ballot of one political party as a candidate for nomination to one office and also receiving sufficient write-in votes to win the nomination to another office on the ballot of a different political party. K.S.A. 25-306, which prevents a person from accepting more than one nomination to the same office, applies only to nominations accomplished by convention, caucus, or independent petition and cannot be construed to apply to nominations accomplished by primary election. K.S.A. 25-613, which prescribes the form of general election ballots, does not prevent a single name from appearing twice on the same ballot, for the same or different offices. K.S.A. 25-123 addresses the problem of the simultaneous election of a single person to incompatible offices and clearly indicates a legislative intent to permit simultaneous candidacies for more than one office.
