Available in PDF, EPUB and Kindle. Book excerpt: Public Opinion and the Rehnquist Court offers the most thorough evidence yet in favor of the U.S. Supreme Court representing public opinion. Thomas R. Marshall analyzes more than two thousand nationwide public opinion polls during the Rehnquist Court era and argues that a clear majority of Supreme Court decisions agree with public opinion. He explains that the Court represents American attitudes when public opinion is well informed on a dispute and when the U.S. Solicitor General takes a position agreeing with poll majorities. He also finds that certain justices best represent public opinion and that the Court uses its review powers over the state and federal courts to bring judicial decision making back in line with public opinion. Finally, Marshall observes that unpopular Supreme Court decisions simply do not endure as long as do popular decisions. Book jacket.

Book excerpt: Utilizing both a critical thinking approach and a comparative perspective throughout the text, Sobel and Shiraev provide comprehensive coverage of public opinion while also teaching students the basic skills necessary for measurement, understanding, and interpreting. Written in an accessible and engaging manner, this text provides a unique and practical introduction to the field of public opinion. The book begins by “schooling” the reader in how to think critically and then helps students apply those techniques as they encounter the concepts of public opinion. The text also employs a comparative perspective, demonstrating the effect and nature of public opinion in other countries while also placing American public opinion in context.

Available in PDF, EPUB and Kindle. Book excerpt: "How to inform the judicial mind," Justice Frankfurter remarked during the school desegregation cases, "is one of the most complicated problems." Social research is a potential source of such information. Indeed, in the 1960s and 1970s, with activist courts at the forefront of social reform, the field of law and social science came of age. But for all the recent activity and scholarship in this area, few books have attempted to create an intellectual framework, a systematic introduction to applied social-legal research. Social Research in the Judicial Process addresses this need for a broader picture. Designed for use by both law students and social science students, it constructs a conceptual bridge between social research (the realm of social facts) and judicial decision making (the realm of social values). Its unique casebook format weaves together judicial opinions, empirical studies, and original text. It is a process-oriented book that teaches skills and perspectives, cultivating an informed sensitivity to the use and misuse of psychology, social psychology, and sociology in apellate and trial adjudication. Among the social-legal topics explored are school desegregation, capital punishment, jury impartiality, and eyewitness identification. This casebook is remarkable for its scope, its accessibility, and the intelligence of its conceptual integration. It provides the kind of interdisciplinary teaching framework that should eventually help lawyers to make knowledgeable use of social research, and social scientists to conduct useful research within a legally sophisticated context.

Book excerpt: American politics is most notably characterized by the heated debates on constitutional interpretation at the core of its ever-raging culture wars, and the coverage of these lingering disputes are often inundated with public-opinion polls. Yet for all their prominence in contemporary society, there has never been an all-inclusive, systematic study of public opinion and how it impacts the courts and electoral politics. Public Opinion and Constitutional Controversy is the first book to provide a comprehensive analysis of American public opinion on the key constitutional controversies of the twentieth century, including desegregation, school prayer, abortion, the death penalty, affirmative action, gay rights, assisted suicide, and national security, to name just a few. With essays focusing on each issue in-depth, Nathaniel Persily, Jack Citrin, Patrick Egan, and an established group of scholars utilize cutting edge public-opinion data to illustrate these contemporary debates, methodically examining each one and how public attitudes have shifted over time, especially in the wake of prominent Supreme Court decisions. More than just a compilation of available data, however, these essays join the "popular constitutionalism" debate between those who advocate a dominant role for courts in constitutional adjudication and those who prefer a more pluralized constitutional discourse. Each essay also vividly details the gap between the public and the Supreme Court on these hotly contested issues and analyzes how and why this divergence of opinion has grown or shrunk over the last fifty years. Ultimately, Public Opinion and Constitutional Controversy sheds light on a major yet understudied part of American politics, providing an incisive look at the crucial part played by the voice of the people on the issues that have become an indelible part of the modern-day political landscape.

Available in PDF, EPUB and Kindle. Book excerpt: Much has been written about Thurgood Marshall, but this is the first book to collect his own words. Here are briefs he filed as a lawyer, oral arguments for the landmark school desegregation cases, investigative reports on race riots and racism in the Army, speeches and articles outlining the history of civil rights and criticizing the actions of more conservative jurists, Supreme Court opinions now widely cited in Constitutional law, a long and complete oral autobiography, and much more. Marshall's impact on American race relations was greater than that of anyone else this century, for it was he who ended legal segregation in the United States. His victories as a lawyer for the NAACP broke the color line in housing, transportation, voting, and schools by overturning the long-established &“separate-but-equal&” doctrine. But Marshall was attentive to all social inequalities: no Supreme Court justice has ever been more consistent in support of freedom of expression, affirmative action, women's rights, abortion rights, and the right to consensual sex among adults; no justice has ever fought so hard against economic inequality, police brutality, and capital punishment.
