La delega è stata attuata con D.L. 8 novembre 2021, n. 177 (Attuazione della Direttiva 2019/790/UE del Parlamento europeo e del Consiglio, del 17 aprile 2019, sul diritto d’autore e sui diritti connessi nel mercato unico digitale e che modifica le Direttive 96/9/CE e 2001/29/CE). Il Decreto del 2021 ha ampliato i compiti e le funzioni dell’AGCom - Autorità per le garanzie nelle comunicazioni -, ha disciplinato le rassegne stampa (imprese di media monitor) e ha rivisto la disciplina delle eccezioni e limitazioni, il tutto nel quadro dell’adeguamento del diritto d’autore al mondo digitale. Gli interventi hanno riguardato, tra l’altro, l’art. 68, ove è inserito il comma 2 bis, ove si prevede che gli istituti di tutela del patrimonio culturale per finalità di conservazione e nella misura a tal fine necessaria, hanno sempre il diritto di riprodurre e realizzare copie di opere o di altri materiali protetti, presenti in modo permanente nelle loro raccolte, in qualsiasi formato e su qualsiasi supporto. Sono stati inseriti i nuovi art. 70 bis, 70 ter, 70 quater e 70 sexies. Il Titolo II-quater, che disciplina l’utilizzo dei contenuti protetti da parte dei prestatori di servizi di condivisione di contenuti on line è nuovo, e si articola in cinque articoli, da 102 sexies a 102 decies. Il Titolo II-quinquies, che disciplina l’utilizzo di opere e altri materiali fuori commercio, è nuovo, e si articola in sette articoli, da 102 undecies a 102 septiesdecies. Infine, il legislatore, nel D.L 8 novembre 2021 n. 177, ha fatto ampio ricorso all’istituto dell’equo compenso. Alle modifiche apportate alla Legge sul diritto d’autore dal D.L 8 novembre 2021 n. 177 vanno poi aggiunte quelle che sono state operate dal D. L. 8 novembre 2021, n. 181 in attuazione della Direttiva 2019/789/UE del Parlamento europeo e del Consiglio del 17 aprile 2019 che stabilisce norme relative all’esercizio del diritto d’autore e dei diritti connessi applicabili a talune trasmissioni online degli organismi di diffusione radiotelevisiva e ritrasmissioni di programmi televisivi e radiofonici e che modifica la Direttiva 93/83/CEE del Consiglio. 3. Legge 21 settembre 2022 n. 142 costituisce la conversione in legge, con modificazioni, del decreto-legge 9 agosto 2022, n. 115, recante misure urgenti in materia di energia, emergenza idrica, politiche sociali e industriali (22G00152). L’art. 20-bis, comma 1) del D.L. 9 agosto 2022, n. 115 ha così disposto: “1. All’articolo 44 della legge 22 aprile 1941, n. 633, le parole: “, il direttore artistico e il traduttore” sono sostituite dalle seguenti: “e il direttore artistico”. È così stato cancellato il “traduttore”, che era stato introdotto tra i coautori dell’opera cinematografica dal D.L 8 novembre 2021 n. 177. 4. La Legge 14 luglio 2023 n. 93 è denominata “Disposizioni per la prevenzione e la repressione della diffusione illecita di contenuti tutelati dal diritto d’autore mediante le reti di comunicazione elettronica” ed è nota come “Legge antipirateria”. L’art. 3 riguarda le modifiche alla legge sul diritto di autore (e al codice penale) che conseguono all’art. 2, contenente i provvedimenti urgenti. L’art. 3 (Misure per il contrasto della pirateria cinematografica, audiovisiva o editoriale) dispone: 1. “Al comma 1 dell’articolo 171-ter della legge 22 aprile 1941, n. 633, è aggiunta, in fine, la seguente lettera: «h-bis) abusivamente, anche con le modalità indicate al comma 1 dell’articolo 85-bis del Testo unico delle leggi di pubblica sicurezza, di cui al regio decreto 18 giugno 1931, n. 773, esegue la fissazione su supporto digitale, audio, video o audiovideo, in tutto o in parte, di un’opera cinematografica, audiovisiva o editoriale ovvero effettua la riproduzione, l’esecuzione o la comunicazione al pubblico della fissazione abusivamente eseguita». 2. Dopo il numero 4) del terzo comma dell’articolo 131-bis del Codice penale è aggiunto il seguente: «4-bis) per i delitti previsti dalla sezione II del capo III del titolo III della legge 22 aprile 1941 n. 633, salvo che per i delitti di cui all’articolo 171 della medesima legge». 3. All’articolo 174-ter della legge 22 aprile 1941, n. 633, sono apportate le seguenti modificazioni: a) al comma 1: 1) dopo la parola: «duplica,» sono inserite le seguenti: «mette a disposizione,»; 2) dopo la parola: «supporti» sono inserite le seguenti: «o servizi»; b) al comma 2: 1) dopo la parola: «noleggiate» sono inserite le seguenti: «o per la quantità di opere o materiali protetti resi potenzialmente accessibili in maniera abusiva attraverso gli strumenti di cui al comma 1»; 2) le parole: «euro 1032,00» sono sostituite dalle seguenti: «euro 5.000». 5. La Legge 30 dicembre 2023 n. 214 è la “Legge annuale per il mercato e la concorrenza 2022” (23G00220). L’art. 20, denominato “Criteri di misurazione della rappresentatività nelle attività di intermediazione dei diritti d’autore” dispone: 1. All’articolo 180, secondo comma, numero 1), della legge 22 aprile 1941, n. 633, dopo le parole: «opere tutelate» sono aggiunte le seguenti: «, a condizioni economiche ragionevoli e proporzionate al valore economico dell’utilizzo dei diritti negoziati e alla rappresentatività di ciascun organismo di gestione collettiva. Con regolamento dell’Autorità per le garanzie nelle comunicazioni sono definiti i criteri per la determinazione della rappresentatività degli organismi di gestione collettiva per ciascuna categoria di diritti intermediati». Queste, dunque, le modifiche apportate. 6. In questa edizione – come nella precedente - si pubblica il Regolamento di attuazione della Legge sul Diritto di autore (Regio decreto 18 maggio 1942, n. 1369) e un estratto delle norme del Codice Civile che riguardano il diritto di autore (Libro Quinto - Titolo IX - Dei diritti sulle opere dell’ingegno e sulle invenzioni industriali. Capo I – Del diritto di autore sulle opere dell’ingegno letterarie e artistiche (art. 2575 – 2583). Si pubblica altresì il testo della Convenzione di Berna per la protezione delle opere letterarie e artistiche del 9 settembre 1886, ricordando che la Convenzione fu completata a Parigi il 4 maggio 1896, riveduta a Berlino il 13 novembre 1908, completata a Berna il 20 marzo 1914 e riveduta a Roma il 2 giugno 1928, a Bruxelles il 26 giugno 1948, a Stoccolma il 14 luglio 1967 e a Parigi il 24 luglio 1971. 7. Si conserva la pubblicazione della Direttiva 2019/790/UE del 17 aprile 2019 sul diritto d’autore e sui diritti connessi nel mercato unico digitale e che modifica le Direttive 96/9/CE e 2001/29/CE e il testo del Decreto attuativo 8 novembre 2021, n. 177. Si conserva altresì il testo del Decreto legislativo 8 novembre 2021, n. 181 di attuazione della Direttiva 2019/789/UE del Parlamento europeo e del Consiglio, del 17 aprile 2019, che stabilisce norme relative all’esercizio del diritto d’autore e dei diritti connessi applicabili a talune trasmissioni online degli organismi di diffusione radiotelevisiva e ritrasmissioni di programmi televisivi e radiofonici e che modifica la Direttiva 93/83/CEE. 8. Il Codice è corredato da una Cronologia di aggiornamento della Legge 22 aprile 1941 n. 633 dalla sua promulgazione ai giorni nostri, tesa a ricostruire le vicende legislative che la hanno inciso sulla sua lunga vita. Infine si è ritenuto utile predisporre una Tavola delle modifiche della Legge che permettano al lettore di avere una visione immediata delle modifiche e delle integrazioni apportate. Chiude il volume l’indice analitico alfabetico. Obwohl Stravinskijs Werk oftmals in drei verschiedene Stilperioden – die russische, die neoklassizistische und die serielle – untergliedert wird, zeichnet es sich durch gemeinsame Konstruktionsprinzipien einer ureigenen Tonsprache aus. Die Analysen legen deren grundlegende Elemente und ihre Grammatik offen. Jedes der acht Kapitel des Buches ist auf einen Aspekt der Tonsprache Stravinskijs fokussiert, jeweils in der Abfolge der Chronologie der Werke. Aus diesem Grund werden dieselben Kompositionen in mehreren Kapiteln unter verschiedener Perspektive untersucht. Auf diese Weise ergeben sich ganz wesentliche neue Einsichten zum Gesamtschaffen Stravinskijs. The Language of Stravinsky proposes new methods of looking at Stravinsky’s work, more than 40 years after his death. It considers both his individual compositions and the evolution of his work over his lifetime. The main purpose of the book is to analyse and clarify the inner coherence of Stravinsky’s music, despite the wide variety of styles, instrumental combinations and theatrical modes with which he worked. Though his career is often seen as falling into three distinct periods – Russian, Neoclassical and Serial – his work as a whole is threaded through with a language unique to himself as a composer. The analysis presented in this account identifies the basic elements and grammar of this underlying musical language. Each of the eight chapters of the book focuses on one aspect of Stravinsky’s musical language, followed chronologically within that chapter. The same works are therefore often studied in different chapters, looked at from a different musical perspective. This analysis of Stravinsky’s music over time provides major new insights into his work.

In this book, Martha Buskirk addresses the interesting fact that since the early 1960s, almost anything can and has been called art. Among other practices, contemporary artists have employed mass-produced elements, impermanent materials, and appropriated imagery, have incorporated performance and video, and have created works through instructions carried out by others. Furthermore, works of art that lack traditional signs of authenticity or permanence have been embraced by institutions long devoted to the original and the permanent. Buskirk begins with questions of authorship raised by minimalists' use of industrial materials and methods, including competing claims of ownership and artistic authorship evident in conflicts over the right to fabricate artists' works. Examining recent examples of appropriation, she finds precedents in pop art and the early twentieth-century readymade and explores the intersection of contemporary artistic copying and the system of copyrights, trademarks, and brand names characteristic of other forms of commodity production. She also investigates the ways that connections between work and context have transformed art and institutional conventions, the impact of new materials on definitions of medium, the role of the document as both primary and secondary object, and the significance of conceptually oriented performance work for the intersection of photography and the human body in contemporary art. Buskirk explores how artists active in the 1980s and 1990s have recombined strategies of the art of the 1960s and 1970s. She also shows how the mechanisms through which art is presented shape not only readings of the work but the work itself. Book excerpt: The theft, trafficking, and falsification of cultural property and cultural heritage objects are crimes of a particularly complex nature, which often have international ramifications and significant economic consequences. Organized criminal groups of various types and origins are involved in these illegal acts. The book Crime in the Art and Antiquities World has contributions both from researchers specializing in the illegal trafficking of art, and representatives of international institutions involved with prevention and detection of cultural property-related crimes, such as Interpol and UNESCO. This work is a unique and useful reference for scholars and private and public bodies alike. This innovative volume also includes an Appendix of the existing legal texts, i.e. international treaties, conventions, and resolutions, which have not previously been available in a single volume. As anyone who has undertaken research or study relating to the protection of cultural heritage discovers one of the frustrations encountered is the absence of ready access to the multi- various international instruments which exist in the field. Since the end of the Second World War these instruments have proliferated, first in response to increasing recognition of the need for concerted multinational action to give better protection to cultural property during armed conflict as well as ensuring the repatriation of cultural property looted during such conflict. Thus the international community agreed in 1954 upon a Convention for the Protection of Cultural Property in the Event of Armed Conflict. That Convention, typically referred to as the Hague Convention of 1954, is now to be found reproduced in the Appendix to this book (Appendix I) together with 25 other important and diverse documents that we believe represent a core of the essential international sources of reference in this subject area. In presenting these documents in one place we hope that readers will now experience less frustration while having the benefit of supplementing their understanding and interpretation of the various instruments by referring to individual chapters in the book dealing with a particular issue or topic. For example, Chapter 9 by Mathew Bogdanos provides some specific and at times rather depressing descriptions of the application in the field of the Hague Convention 1954, and its Protocols (Appendices II and III), to the armed conflict in Iraq. Reference may also be had to the resolution of the UN Security Council in May 2003 (Appendix VI) urging Member States to take appropriate steps to facilitate the safe return of looted Iraqi cultural property taken from the Iraq National Museum, the National Library and other locations in Iraq. Despite such pleas the international antiquities market seems to have continued to trade such looted property in a largely unfettered manner, as demonstrated by Neil Brodie in Chapter 7. Fittingly, as referred to in the Preface to this book, the last document contained in the Appendix (Appendix 26) is the “Charter of Courmayeur”, formulated at a ground breaking international workshop on the protection of cultural property conducted by the International Scientific and Professional Advisory Council (ISPAC) to the United Nations Crime Prevention and Criminal Justice Program in Courmayeur, Italy, in June 1992. The Charter makes mention of many of the instruments contained in the Appendix while also foreshadowing many of the developments which have taken place in the ensuing two decades designed to combat illicit trafficking in cultural property through international collaboration and action in the arena of crime prevention and criminal justice.

Italian populism is of interest to comparative lawyers for many reasons. Firstly, the country has a long-lasting tradition of anti-parliamentarism over the course of its history as a unitary state. After the 2018 general election, it has turned into the first European country in which two self-styled populist parties formed a coalition government. Although it collapsed in August 2019, many issues that it had raised remain. Secondly, as Italy is a founding member of the European Communities, the constitutional implications of populist politics have to be considered not only within the national framework but also in a wider context. This book argues that the relationship between populism and constitutionalism should not be seen in terms of mutual exclusion and perfect opposition.
