Book excerpt: Plusieurs milliers de médecins informatisés encourent aujourd'hui de 2000 francs à 200000 francs d'amende et de 3 mois à 6 mois de prison pour ne pas avoir satisfait aux obligations de la loi du 6 janvier 1978 dite "loi informatique et libertés" et notamment ne pas avoir effectué la déclaration de leurs fichiers. Ce travail expose à la fois les principaux élements qu'il est indispensable de connaître, leurs modalités pratiques de mise en oeuvre et les difficultés que celles-ci rencontrent dans le domaine médical. Par ailleurs, le développement croissant de l'informatique en médecine, en particulier la création des registres épidémiologiques regroupant des informations médicales nominatives à des fins de recherche, suscite de légitimes interrogations vis à vis de la déontologie du secret médical. L'existence de ces registres nécessite la rédaction d'un texte pour compléter et modifier le cadre juridique prévu par la loi du 6 janvier 1978 de manière à ce qu'ils puissent s'y inscrire et fonctionner en toute légalité. Ces modifications et compléments ont pris la forme de l'avant projet de loi sur les sciences de la vie et les droits de l'homme dont le titre VI est relatif "au traitment de données nominatives ayant pour fin la connaissance, la protection ou l'amélioration de la santé." Cette proposition de texte ne fait pas l'unanimité et en particulier, dans sa délibération N°89-126 du 7 novembre 1989, la Commission Nationale Informatique et Libertés s'interroge sur le peu de garantie que ce texte accorde au patient vis à vis du respect du secret médical et au delà, sur le bien fondé de légiférer dans ce domaine. Les différentes implications légales et déontologiques de cet avant projet de loi et ses éventuelles solutions alternatives sont discutées dans cette thèse. Le vote d'une telle loi paraîtrait consacrer aussi bien l'incapacité du corps médical à sensibiliser les patients à l'intérêt de la recherche médicale que l'irresponsabilité du citoyen en matière de Santé Publique.
