Yet, paradoxically, a study that systematically investigates the interrelated reality of Franco-German bilateralism and multilateral European integration has been conspicuously lacking. Formulating an approach the authors call "embedded bilateralism", this book offers exactly that. It scrutinizes in empirical and historical detail the bilateral Franco-German order and France and Germany's joint role in shaping Europe over the past half century. The book addresses two key questions regarding France and Germany in Europe from the Elysée Treaty to the twenty-first century: Why have France and Germany continued to hang together in an especially tight relationship for over five decades amidst frequently dramatic domestic change, lasting differences, and fundamental international transformation? And why has the joint Franco-German impact on shaping Europe's polity and European policies, while fundamental, proved so uneven across political domains and time? In answer to the first question, Shaping Europe argues that the actions and practices of the Franco-German order-its regularized bilateral intergovernmentalism, symbolic acts and practices, and parapublic underpinnings-together have rendered this bilateral connection historically resilient and politically adaptable. There are only, as a hang-over from the French and Italian colonialist past, certain Dec1arations, in the Appendices, regard ing a possible association of Tunis, Morocco, Libya with the new under taking. And, of course, there is Artic1e 113 prescribing, at the end of the Community's transition period, the common trade policy - plus the Artic1e (238) giving blanket authorisation for association agreements. These legal prescriptions were duly implemented in the Association Agreements with Greece (1961) and Turkey (1963) and have supplied the basis for bilateral instruments in respect of other Mediterranean lands - ad hoc, pragmatic ar rangements. In the circumstances the Community could scarcely have proceeded otherwise. Yet the outlines of a European economic policy with regard to the countries of the Mediterranean basin were there from the beginning -limited, however, over the years by the internal development of the Community itself. One is reminded in this connection of sundry invoca tions by European and Mediterranean personalities and members of the European Commission - and, specifically, of a Memorandum presented by Italy to the Council of Ministers in 1964.

In the past decade, the rule of law in Europe has been put under strain by both external and internal factors. The term “illiberal democracies” is sometimes used to describe the rise of a phenomenon in which the fundamental values of the European legal order, as enshrined in the European Convention of Human Rights and in the Charter of Fundamental Rights of the European Union, are called into question. The preservation of the independence of the judiciary, of the freedom of expression and the protection of journalists are among the values under threat. But these challenges are also present within the older democracies in which emergency regimes have become more common. As the European Union’s sanctions regime shows, striking a balance between security and the rule of law, of which fundamental rights are an intrinsic part, is a constant challenge. The acid test of the rule of law might indeed be how it safeguards the judicial guarantees designed to protect core European values beyond the discretion of government.
