A través de un análisis jurídico de la normativa internacional, europea,nacional, y de la evolución que ha tenido a lo largo de la historia este fenómeno, se realiza una investigación con el fin de estudiar el status jurídico que poseen estos menores, desdeel momento en que son localizados en territorio nacional.Una vez que se conoce su minoría edad, ya sea a partir de los documentos que traen consigo o a través de las pruebas de la determinación de la edad a la que son sometidos,pasan a formar parte de un sistema de protección especial enfocado a este colectivo. El derecho a la tutela judicial efectiva y principio del interés superior del menor deben esta rsiempre presentes en las medidas que se apliquen a estos menores, ya sea con el retorno al país de origen o con la permanencia en nuestro país.
