Book Synopsis Article 177 EEC by : Henry G. Schermers
Download or read book Article 177 EEC written by Henry G. Schermers and published by North Holland. This book was released on 1987 with total page 488 pages. Available in PDF, EPUB and Kindle. Book excerpt: Expert representatives of all member states of the EEC met in The Hague in 1985 to discuss ''Experiences and problems in applying the preliminary proceedings of Article 177 EEC''. All categories of practitioners were present; at the national level (judges, counsel, government agents) and at the European level (Commission, Council, European Parliament and the Court of Justice). The importance of the preliminary procedure of article 177 EEC for the development of the legal order of the European Communities is undisputed. It is the most effective means available to individuals and companies of ensuring the respect of the national authorities of the rights which they enjoy under Community law (freedom of movement of goods, persons, services and capital, common policies, etc.). Without detracting from the success of the preliminary procedure, certain deficiencies do exist. To a large extent these may be attributed to the workload of the Court of Justice, which has led to a considerable increase in the delay for obtaining a preliminary ruling. It is felt that there is a growing need to streamline the procedure before the court. This volume is a comprehensive and authoritative survey of experiences with the preliminary procedure, and should be of great academic and practical value.

This book was released on 2024-01-22 with total page 466 pages. Available in PDF, EPUB and Kindle. Book excerpt: The place of the European Convention on Human Rights within the legal order of the European Union has been the subject of much controversy over the past twenty years. It is now almost 25 years since the European Court of Justice in Luxembourg first referred specifically to the Human Rights Convention in one of its judgments. Since then it has considered and commented on almost all of the substantive articles of the Human Rights Convention in the context of European Community law. For the first time, these references to the European Convention on Human Rights by the European Court of Justice, the Court of First Instance and the Advocates General of the two Courts have been brought together and published by reference to the substantive right under consideration. This book presents extensive extracts from these cases, permitting the reader to follow the development of the Court's thinking on each article of the European Convention on Human Rights. It is an invaluable reference work for any practitioner, academic lawyer or student working in the field either of human rights or European Community law, who needs to look at the actual source material on the Court of Justice's handling of its Member States' human rights obligations.

Download or read book Development of Judicial Control of the European Communities written by Gerhard Bebr and published by Springer. This book was released on 2013-12-01 with total page 826 pages. Available in PDF, EPUB and Kindle. Book excerpt: The development of the judicial control of the European Communities is perhaps best illustrated by comparing the first decision the Court of Justice rendered in December 1954, under the ECSC Treaty, with its preliminary rulings van Gend & Loos (1962), ENEL (1964) and Simmenthal II (1978) rendered under the EEC Treaty. In the first case the Court quashed a decision of the High Authority impugned by an annulment action of a Member State for an illegal exercise of Community powers - a judicial control which at the time already represented a spectacular legal in novation introduced by the ECSC Treaty. At that time the Court was, for evident reasons, still reserved as to its role within the unprecedented institutional structure of the Community. In van Gend, ENEL and Simmenthal II, on the other hand, the Court resolutely pursued a judicial policy intended to ensure an effective operation of the Community legal order, a problem hardly envisaged in 1954. In these rulings the Court characterized the emerging legal order and stated its fundamental and indispensable requirements: the unlimited supremacy of Community law and its direct effect. The development of a superior and autonomous Community legal order was finally completed by the Court's recognition of fundamental Communiry rights of individuals. This development from an initially reserved stand of the Court searching for its proper role and its potentialities to a bold and determined judicial policy is truly remarkable.

Book Synopsis The Institutional Framework of the European Communities by : J. S. Davidson
Download or read book The Institutional Framework of the European Communities written by J. S. Davidson and published by Routledge. This book was released on 2005-07-15 with total page 242 pages. Available in PDF, EPUB and Kindle. Book excerpt: After more than a decade of British membership of the European Community, there is still a widespread lack of appreciation of what goes on within the Community institutions, and of its significance for UK political and legal processes. This book aims to provide a concise introduction to the institutions and law-making processes of the Community, and to set them im their proper perspective as part of UK public law. The prime focus is upon the Community institutions and their inter-relations, however, reference is also made as appropriate to the effects which Community decision-making has on Westminster and Whitehall and in the English courts. In particular, the book examines the sources of Community law, the organisation and composition of the main institutions after the accession of Portugal and Spain, and the decision-making processes involved in the enactment of the Community's legislation. There are also chapters on the budgetary process and on the role of the European Court of Justice. Despite the UK emphasis some comparative material is used to put the UK approach into perspective. To enhance its value to readers cominig to the subject for the first time, the book also contains the text of selected articles of the Treaty of Rome.
