Book excerpt: This report examines the events leading to the qualified audit opinion on the Equality and Human Rights Commission's 2006-08 accounts and on the continuing weaknesses in the Commission's controls. The Commission took up its new powers, and those of the former Commission for Racial Equality, the Disability Rights Commission and the Equal Opportunities Commission (the Legacy Commissions), on 1 October 2007. Serious errors were made in setting up the Commission, not helped by three changes of sponsor department in the months immediately before its launch. The Commission now accepts that it was not ready for business when the doors opened on 1 October 2007 and that its set-up process, which cost £39 million, was flawed and inefficient: it did not have in place sufficient senior staff, a transition strategy, business strategy, organisation design or job descriptions. Skills gaps were filled by bringing back former employees of the CRE as consultants, even though they had all received severance payments. The Treasury, which should have been consulted about these appointments, did not grant approval retrospectively as the Commission could not prove that the re-engagements gave good value for money. This expenditure was therefore deemed irregular and the Comptroller and Auditor General issued a qualified opinion on the Commission's 2006-08 accounts. This is not the way that the Public Accounts Committee expects public bodies to be run. Strong controls need to be in place to ensure that such errors do not recur.

Book excerpt: The Public Bodies Bill (HL Bill 25, ISBN 9780108478765) proposes to create a number of delegated powers by which the Government can abolish, merge, modify the constitution, functions or budgetary arrangements or a body or authorise delegation of a body's functions to a third person or body. Several other committees have expressed concern about the extreme breadth of the delegated powers proposed, and this report outline's three significant human rights issues arising from the Bill. First is the independence and impartiality of bodies protecting and promoting human rights. The inclusion of bodies such as the Equality and Human Rights Commission, the Children's Commissioner, the Inspectorate of Prisons and the Legal Services Commission in the schedules to the Bill may undermine their functional or perceived independence. Secondly, the Committee is concerned that the abolition or reform of other bodies which serve a particular decision making function may undermine the right to procedural fairness. Thirdly, the breadth of delegation proposed in the Bill appears wholly inappropriate, and the excessive use of delegated powers may reduce the effectiveness of parliamentary scrutiny for human rights compatibility of proposed legislation.

Book excerpt: This report considers the experience of some three years of holding 'pre-appointment' hearings by select committees to examine the 'preferred candidate' for certain public appointments before that appointment is confirmed. Whilst the committee considers the experiment a success they do recommend a number of changes. They propose a three tier list: Posts in the first tier are those considered to be of sufficient constitutional significance as to require a process which is effectively a joint appointment by Government and the House of Commons. Posts in the second tier are those which the committee proposes should be subject to an enhanced an improved version of the current process, and which should be subject to an 'effective veto' by the House of Commons or its committees. For posts in the third tier, pre-appointment hearings should be at the discretion of committees.

Available in PDF, EPUB and Kindle. Book excerpt: A deep dive into the mechanics of national human rights institutions and the forces that make or break their success. In the years since World War II, the endeavor to promote human rights has gained momentum and become increasingly important within international relations. Yet these efforts often run into serious problems of enforcement. Many countries formed national human rights institutions (NHRIs) with independent mandates to support and monitor government compliance with international human rights law. Be they commissions, ombudsmen, or tribunals, these institutions vary in their power and impact. For this book, Corina Lacatus surveyed NHRIs in Europe and around the world to determine their effectiveness and explain why some succeed while others fail. The Strength of Our Commitments explores the relationship between the domestic and international support an institution receives and its ability to secure resources, credibility, and tangibly improve human rights conditions. Lacatus shows that NHRIs can be models of resilience, even in the face of opposition from political elites. Although their impact on human rights is difficult to measure, The Strength of Our Commitments shows how NHRIs’ strength comes from clearly defined formal powers, strong institutional leadership, and independence from political interference.

Book excerpt: The Equality Act 2010 is a major landmark in the long struggle for equal rights. This book tells the story of how and why it came to be enacted, what it means, what changes it can bring about in British society, and - no less important - what the Act will not do. The Act is the outcome of over 13 years of research, public debate and campaigning, starting with the publication of Equality: A New Framework. Report of the Independent Review of the Enforcement of UK Anti-Discrimination Legislation by Bob Hepple, Mary Coussey and Tufyal Choudhury (Hart Publishing, 2000). The aim of this book is to examine the aims and structure of the new legal framework and to assess the Act against goals of reform set by the earlier review: harmonising and extending the law on status equality; widening the areas of unlawful conduct; changing organisational policy and behaviour including positive duties to advance equality; and improving enforcement of the law. The book will be essential reading for anyone who wants to understand the Act and the wider context of equality law, including students of law and social sciences, human rights activists and lawyers, as well as the general reader.
