The Committee believes the Government should ensure the Commissioner has sufficient resources for its work. The Committee endorses Mr Graham's suitability for appointment as Information Commissioner and his preliminary view of the priorities of the role and its supporting organisation. It looks forward to a continuing dialogue on progress both in protecting people's personal information effectively and sensitively, and in securing implementation of the letter, and the spirit, of the Freedom of Information Act.

Book excerpt: The Government's proposals for opening up probation services to competition need further thought, MPs on the Justice Committee have warned in a new report released today. The committee believes that the Government's proposals for payment by results and wider competition in the provision of rehabilitative services are limited because they separate the commissioning of prison places from the commissioning of every other form of sentence provision. They also criticised the very large and incoherent areas used for the tendering of community payback contracts, which they say should not be a model for future commissioning. The report also recommends that probation trusts are given greater freedoms - for example, over the buildings and IT systems they use - and calls on them to focus scarce resources on the frontline. MPs were concerned that frontline probation staff spend three-quarters of their time doing administrative tasks rather than meeting directly with offenders. The committee concluded that the creation of the National Offender Management Service (NOMS), which effectively merged prison and probation services, has not led to an appreciable improvement in the 'joined-up' treatment of offenders; its handling of the community payback tendering exercise has not inspired confidence; and it has not proved itself proficient at running effective national contracts. The MPs are calling on the Government to commission an externally-led review of NOMS. The committee calls for leadership and courage from politicians and sentencers in supporting community sentences and recommends that the Government clarifies to the public what it means by more robust community sentences, and the outcomes they are designed to achieve. Book excerpt: The Government presented its Post-legislative Scrutiny of the Serious Crime Act 2007 Memorandum to the Home Affairs Committee and Justice Committee in November 2012. The parts of the Memorandum falling within the Justice Committee's remit were a) Serious Crime Prevention Orders and b) Part 2, in particular, offences of encouraging or assisting crime in terms of prosecution and interpretation of the sections by courts and the CPS. There is concern about the trenchant criticism that Part 2 of the Serious Crime Act 2007 received. In addition, Part 2 was the subject of appeals to the Court of Appeal. The report concurs with the academics who wrote that the sections are complex and difficult to understand for lawyers, let alone for defendants, jurors and other lay-people working in the criminal justice system. It raises some key concerns and questions about the purpose of post-legislative scrutiny. It is considered that where the substance of an Act or part of an Act is to create or revise criminal offences it is appropriate for questions of a purely legal or technical nature to be considered. The latest judgment in the case of Sadique may allow the legislation to settle into accepted use and interpretation. However, the Ministry should conduct a further and full post-legislative assessment of Part 2 in 2016. If, in the meantime, the number of appeals on Part 2 increases, the Ministry should consider bringing forward legislative proposals for revising, or even replacing, Part 2 to meet the purpose of the legislation in a less tortuous fashion
