Book excerpt: La legge 190/2012, cosiddetta “anticorruzione”, introduce nella pubblica amministrazione nuovi strumenti per combattere i fenomeni corruttivi, oltre a modificare in parte le norme del codice penale relative alla materia. Si tratta di una serie di innovazioni, alcune delle quali significative, come l’onere di redigere una pianificazione di azioni volte a scongiurare i rischi di corruzione, o la previsione della figura obbligatoria del responsabile della prevenzione della corruzione, che negli enti locali coincide col segretario comunale, salvo motivata decisione diversa. Al di là delle singole e specifiche misure di prevenzione, la norma ha un notevole impatto sull’organizzazione degli enti e, in una certa misura, anche sui rapporti di lavoro. Le misure anticorruzione prevedono, ad esempio, l’articolazione di sistemi di rotazione della dirigenza e del personale, nei servizi qualificati come a maggior rischio. Il che impone sistemi di gestione più sofisticati e complessi, oltre al necessario rilancio della formazione e dell’aggiornamento professionale. In più, occorrerà rivedere anche in buona parte gli strumenti operativi: la legge 190/2012 insiste particolarmente sul concetto della total disclosure, dell’amministrazione “aperta”, incidendo in modo significativo anche sulla legge 241/1990, allo scopo di rendere trasparente e conoscibile in ogni sua fase l’azione amministrativa. La norma, dunque, chiama gli enti ad una significativa e rilevante revisione dei propri strumenti di programmazione, gestione e controllo. Da questo punto di vista, la legge 190/2012 si salda col d.l. 174/2012, che come è noto ha inteso proprio rivitalizzare le forme di controllo negli enti locali, quali strumento di presidio non solo della corruzione, ma anche e soprattutto della buona amministrazione, esente il più possibile da vizi di legittimità e anche di merito, oltre che il più possibile orientata verso risultati utili per la collettività amministrata.
