Those belonging to the determinist school deny the possibility of free choice due to the deterministic nature of the supposedly free agents. The libertarians allege that there is a grain of indeterminism in free agents. The compatibilists argue that freedom and determinism can coexist and try to dissolve the contradiction between them. However, common compatibilist accounts do not explain how free choice develops in biological agents. In this dissertation I argue that describing freedom conceptually is impossible without explaining how it can exist in the world. Therefore, I develop an account of freedom's instantiation in living entities and suggest several prerequisites that are necessary for its exercise. I argue that freedom is linked to the form of life and distinguish between choice in non-verbal animals and human freedom, where the latter is enabled by the development of language and thus a distinct character. The descriptive account is followed by an exploration of freedom's evolutionary history that explains how it developed in the course of the evolution of species.

Book excerpt: The subject of this book is the controversy—one of the oldest in philosophy—about whether it is possible to have freedom in the face of universal causal determinism. Of course, it is crucial to consider what such freedom might mean—in particular, there is an important distinction between libertarian “free will” and the more naturalistic view of freedom taken by compatibilists. This book provides background for laypersons through a historical survey of earlier views and some discussion and criticism of various contemporary views. In particular, it states and discusses the Consequence Argument, the most important argument challenging human freedom in recent literature. The main feature of the book is the argument for a solution: one that is within the compatibilist tradition, is naturalistic and in accord with findings of science and principles of engineering control theory. Some particular features of the offered solution include an argument for a close tie between freedom and control—where what is meant is the voluntary motion control of our bodies, and this “control” is understood naturalistically, by which the author means in accordance with concepts of engineering control theory and modern science. Such concepts are used to explain and demarcate the concept of “control” being used. Then it develops a working conception of what rationality is (since what is crucial is freedom in choice, and rationality is crucial to that), by reviewing texts on the subject by three expert authors (namely, Nathanson, Nozick, and Searle). It is argued that rationality is a species of biological learning control that involves deliberation; and that our freedom in choice is greatest when our choices are most rational.

Stevens, to explore how American society attempts to balance the protection of free speech and the prevention of animal cruelty. Starting from the detailed case study of a single prominent ruling, the authors provide a masterful survey of important issues facing society in the area of animal welfare. The Stevens case included various "hot topic" elements connected to the role of government as arbiter of public morality, including judicial attitudes to sexual deviance and dogfighting. Because it is one of only two animal rights cases that the US Supreme Court has handled, and the only case discussing the competing interests of free speech and animal cruelty, it will be an important topic for discussion in constitutional and animal law courses for decades to come. The Stevens case arose from the first conviction under 18 USC § 48 (Section 48), a federal law enacted in 1999, which criminalized the creation, sale, and/or possession of certain depictions of animal cruelty. The US Congress intended Section 48 to end the creation and interstate trafficking of depictions of animal cruelty in which animals are abused or even killed for entertainment's sake. Proponents of Section 48 predicted that countless benefits to both humans and animals would flow from its enforcement. Opponents of the law argued that it was too far-reaching and would stifle protected speech. Critics of Section 48 appeared to have prevailed when the US Supreme Court struck the law down as unconstitutionally overbroad. Although a law tailored to address the Supreme Court's concerns was quickly enacted, the free speech/animal cruelty controversy is far from over.

First, he outlines some aspects of contemporary philosophical views on animals and morality, including the criticism of speciesism and the animal rights argument. Second, he criticizes these views, arguing that we cannot escape a speciesist perspective on morality, and that there are no good reasons why we should believe that non-human animals have moral rights. Third, he argues that cruelty against non-human animals is morally wrong, but not because animal rights are being violated but because human agents who inflict cruelty on non-human animals are failing their duty to develop in themselves the virtue of justice. This latter argument is reminiscent of Immanuel Kant’s idea that we have only indirect duties towards animals, but unlike that idea, Bauhn's argument does not depend on any causal hypothesis that humans who are cruel to animals are likely to be cruel also to their fellow humans. Instead, Bauhn's argument relies on the fact that being cruel to non-human animals and other innocent beings is conceptually and logically inconsistent with the virtue of justice – a virtue which agents are rationally required to develop in themselves.
