Shah's style is instantly recognizable in the totemic and iconic heads that are rather phallic in shape. They are contemplative and embody masculinity rather than portraiture. By applying techniques used in printmaking, Shah marks the surfaces with grooves and etching, whether the sculpture be in terracotta or bronze. -- Dust Jacket.

Book excerpt: In the field of administrative law, there is no systematic body of rules similar to those characteristic of European civil codes. General principles are therefore of fundamental importance. This volume - the sixth in the series concerning the common core of European administrative laws - explores this importance through two strands. Firstly, it examines in detail the relationship between general principles of law, such as due process, and sector-specific rules established by legislative and regulatory provisions, for example in licensing and disciplinary matters. Several questions about the nature of general principles emerge through this analysis. Are general principles about filling gaps? Or do they have a foundational role because they give meaning to the values that are shared by European legal systems, such as respect for the rule of law and for fundamental rights? Secondly, this volume also explores the interaction between commonality and diversity in European administrative law. It considers whether there are shared standards of administrative conduct, including the duty to give reasons, or if there are fundamental differences with regard to non-European legal systems, such as that of China and Venezuela. These questions are investigated through factual analysis, based on a set of hypothetical cases, which are discussed by national experts. This book then scrutinizes these questions to determine how commonality and diversity have extended and interact with one another, within and across legal systems, both diachronically and synchronically, over the course of a century. It shows that there are both unexpected areas of agreement between the European legal systems, notably concerning the right to be heard (expressed by the maxim audi alteram partem) and the duty to give reasons, and there are also areas of disagreement, for example as far as the right to remain silent vis ? vis the administration (that is, nemo tenetur se detegere) is concerned.

Available in PDF, EPUB and Kindle. Book excerpt: Are social groups real in any sense that is independent of the thoughts, actions, and beliefs of the individuals making up the group? Using methods of philosophy to examine such longstanding sociological questions, Margaret Gilbert gives a general characterization of the core phenomena at issue in the domain of human social life. After developing detailed analyses of a number of central everyday concepts of social phenomena--including shared action, a social convention, a group's belief, and a group itself--she proposes that the core social phenomena among human beings are "plural subject" phenomena. In her analyses Gilbert discusses the work of such thinkers as Emile Durkheim, Georg Simmel, Max Weber, and David Lewis. "Gilbert's book aims to ... exhibit some general and structural features of the conceptual scheme in terms of which we think about social groups, collective action, social convention, and shared belief.... [It] offers an important corrective to individualistic thinking in the social sciences...."--Michael Root, Philosophical Review "In this rich and rewarding work, Margaret Gilbert provides a novel and detailed account of our everyday concepts of social collectivity. In so doing she makes a seminal contribution to ... some vexed issues in the philosophy of social science.... [An] intellectually pioneering work."--John D. Greenwood, Social Epistemology

Available in PDF, EPUB and Kindle. Book excerpt: How do treaties function in the American legal system? This book provides a comprehensive analysis of the current status of treaties in American law. Its ten chapters examine major areas of change in treaty law in recent decades, including treaty interpretation, federalism, self-execution, treaty implementing legislation, treaty form, and judicial barriers to treaty enforcement. The book also includes two in-depth case studies: one on the effectiveness of treaties in the regulation of armed conflict and one on the role of a resurgent federalism in complicating US efforts to ratify and implement treaties in private international law. Each chapter asks whether the treaty rules of the 1987 Third Restatement of Foreign Relations Law accurately reflect today's judicial, executive, and legislative practices. This volume is original and provocative, a useful desk companion for judges and practicing lawyers, and an engaging read for the general reader and graduate students.

Available in PDF, EPUB and Kindle. Book excerpt: Liberal political philosophy and natural law theory are not contradictory, but - properly understood - mutually reinforcing. Contemporary liberalism (as represented by Rawls, Guttman and Thompson, Dworkin, Raz, and Macedo) rejects natural law and seeks to diminish its historical contribution to the liberal political tradition, but it is only one, defective variant of liberalism. A careful analysis of the history of liberalism, identifying its core principles, and a similar examination of classical natural law theory (as represented by Thomas Aquinas and his intellectual descendants), show that a natural law liberalism is possible and desirable. Natural law theory embraces the key principles of liberalism, and it also provides balance in resisting some of its problematic tendencies. Natural law liberalism is the soundest basis for American public philosophy, and it is a potentially more attractive and persuasive form of liberalism for nations that have tended to resist it.
