Book excerpt: This paper presents an overview of sixteen papers in the informal Transparency Project, a comprehensive study of the Federal Trade Commission's merger files that grew out of the 2004 Horizontal Merger Investigation data release. Analysis is presented for market definition, structure, competitive effects, entry, and efficiencies. Most of the papers follow the same basic structure; they introduce an issue related to the Merger Guidelines, review the files and generalize from the results. Commission staff appears to apply a wide range of models to evaluate mergers. Of particular interest are the innovations in merger analysis, including, but not limited too, the concept of a significant competitor, the use of evidence to test structural models and the application of Net Present Value to entry analysis.

These data brokers collect personal information about consumers from a wide range of sources and provide it for a variety of purposes, including verifying an individual's identity, marketing products, and detecting fraud. Because these companies generally never interact with consumers, consumers are often unaware of their existence, much less the variety of practices in which they engage. By reporting on the data collection and use practices of these nine data brokers, which represent a cross-section of the industry, this report attempts to shed light on the data broker industry and its practices. For decades, policymakers have expressed concerns about the lack of transparency of companies that buy and sell consumer data without direct consumer interaction. Indeed, the lack of transparency among companies providing consumer data for credit and other eligibility determinations led to the adoption of the Fair Credit Reporting Act ("FCRA"), a statute the Commission has enforced since its enactment in 1970. The FCRA covers the provision of consumer data by consumer reporting agencies where it is used or expected to be used for decisions about credit, employment, insurance, housing, and similar eligibility determinations; it generally does not cover the sale of consumer data for marketing and other purposes. While the Commission has vigorously enforced the FCRA, 1 since the late 1990s it has also been active in examining the practices of data brokers that fall outside the FCRA.

On May 30, 2012, the FTC held a workshop entitled “In Short: Advertising and Privacy Disclosures in a Digital World.” The concluding panel at that workshop explored how privacy disclosures on mobile devices could be short, effective, and accessible to consumers.Based on more than a decade of work on mobile privacy issues and recent data obtained through panel discussions and comments, the Commission offers this staff report providing recommendations for best practices on mobile privacy disclosures. First, the report reviews the benefits and privacy risks of mobile technologies. Second, it discusses the FTC's efforts to address mobile privacy, as well as its research on disclosure issues generally. It then summarizes general themes raised by panel participants. Finally, it sets forth recommendations for best practices to key commercial players involved in the mobile arena – platforms, app developers, third parties such as ad networks and analytics companies, and trade associations. The recommendations are intended to promote more effective privacy disclosures.
