Available in PDF, EPUB and Kindle. Book excerpt: `Copyright, Contracts, Creators provides a new and original analysis on the relationship between owners and creators and recommendations for legislative change to re-balance the relationship. It is a must-read for the intellectual property legal community and anyone interested in the promotion of creative works.'- Marshall Rothstein, Justice of the Supreme Court of Canada `Dr Giuseppina D'Agostino is a protector of the arts, and her work on intellectual property is designed not only to bring law and order to our digital universe but to bring hope to the artists, poets and writers whose only hope of pursuing their artistry is to earn income for their craft. A wonderful book by one of the most wonderful and forward thinking minds in this subject area.' -Tony Chapman, Founder and CEO, Capital C, Canada `Dr D `Agostino has produced an important, carefully documented and courageous study that deserves to be widely read and discussed and (dare one say?) even to have its message heeded.' - David Vaver, University of Oxford, UK. Copyright, Contracts, Creators evaluates the efficacy of current copyright law to address the contracting and use of creative works. It looks in particular at freelance works and argues that their copyright treatment on a national and international level is inadequate to resolve ambiguities in the contracting and uses of the work. Giuseppina D'Agostino discusses how historically laws and courts were more sympathetic to creators, and how the Internet revolution has shifted the scales to favour owners. Consequently, creators often find themselves at opposing ends with copyright owners, and in a disproportionately weaker bargaining position that places tremendous strain on their livelihoods. She argues that this predicament puts society at risk of losing its most valued asset: professional creators. The author calls for a new framework to justify legislative provisions and resolve ambiguities while suggesting principles and mechanisms to address the inadequate treatment of freelance work.

Available in PDF, EPUB and Kindle. Book excerpt: From an acclaimed writer and journalist, essays containing “a brilliant overview of American history from the 1960s to the post 9/11 era” (Maura Stanton, author of Immortal Sofa: Poems by Maura Stanton). William O’Rourke’s singular view of American life over the past 40 years shines forth in these short essays on subjects personal, political, and literary, which reveal a man of keen intellect and wide-ranging interests. They embrace everything from the state of the nation after 9/11 to the author’s encounter with rap, from the masterminds of political makeovers to the rich variety of contemporary American writing. His reviews illuminate both the books themselves and the times in which we live, and his personal reflections engage even the most fearful events with a special humor and gentle pathos. Readers will find this richly rewarding volume difficult to put down. “O’Rourke has always had his finger on the pulse of the contemporary American literary scene.” —Corinne Demas, author of The Writing Circle “With sparkling wit that never takes a vacation, [O’Rourke] is our unpaid public intellectual number one.” —Jaimy Gordon, author of Lord of Misrule, winner of the 2010 National Book Award for Fiction “O’Rourke’s . . . writing is literary, without a doubt, but his style is conversational, rhythmic and leavened by a dry sense of humor that engage the reader on an intimate level.” —South Bend Tribune “[T]hose who enjoy a good romp through some of our country’s most pivotal times in the company of an astute observer who is unafraid to offer a penetrating, and sometimes scathing, critique of the state of the nation, will find themselves well matched.” —ForeWord Reviews “O’Rourke’s descriptions of the writing life have the ring of absolute truth.” —Review of Contemporary Fiction

Available in PDF, EPUB and Kindle. Book excerpt: Jim Tomlinson's previous book of short stories, Things Kept, Things Left Behind, won the prestigious Iowa Short Fiction Award and received enthusiastic reviews. The New York Times compared the strong sense of place in Tomlinson's writing to that found in the works of Flannery O'Connor and Alice Munro. The stories in his new collection, Nothing Like An Ocean, also reflect Tomlinson's awareness of place, revisiting the fictional town of Spivey, a community in rural Appalachia where the characters confront difficult circumstances and, with quiet dignity, try to do what is right. In the title story, Tomlinson explores themes of forgiveness and acceptance in the lives of two characters, Alton Wood, a high school math teacher isolated by grief, and his sister Fran, who is emotionally paralyzed by her part in a tragic death. The two take halting steps back into the world after Alton receives an anonymous invitation to a church singles dance. These themes also underlie "Angel, His Rabbit, and Kyle McKell," which tells of Dempsie's evening with two men -- her volatile boyfriend and the recently returned Iraq War amputee whose secret she has been keeping. Loss and the inevitability of change recur in Tomlinson's stories. In "Overburden," Ben, a man simultaneously contemplating AARP membership and impending fatherhood, travels with his wife, Sarah, back to eastern Kentucky to visit the oak tree that was essential to their courtship, only to find the site as barren and featureless as the moon, a casualty of mountaintop removal mining. "So Exotic" draws us into the worn environs of Rita's Huddle In Café, where the owner becomes the confidant of Quilla, a mousy bank teller who blossoms as the muse of an eccentric artist from Belarus. The eleven stories in Nothing Like An Ocean evoke a strong sense of small-town Kentucky life, finding humor in the residents' foibles while never diminishing their inner lives. Tomlinson's masterful fiction captures light and dark moments, moments that are foreign yet deeply familiar, as his characters seek redemption and sometimes find unexpected grace..
