Book excerpt: The purpose of this quantitative study was to examine the perceptions of candidates in the Educational Leadership program at the University of Nebraska at Omaha regarding their knowledge and understanding of special education law, including the areas of Free Appropriate Public Education, Child Find, Least Restrictive Environment, Procedural Safe Guards, and Related Services. It further analyzed whether UNO Educational Leadership graduate students' opinions are related to school district size, professional experience, administrative experience, or area certification. When thinking about the considerable amount of training and knowledge it takes to be well versed in the rules and regulations of special education, it's difficult to imagine how a principle of a school can take on this responsibility in light of an already demanding position. The principal's responsibilities have shifted significantly beyond that of a building manager. This study analyzed responses from candidates in the Educational Leadership program at the University of Nebraska-Omaha regarding their perceptions of their knowledge of special education law. This study found a significant difference in respondents perception of special education law based upon the amount of coursework one has in the area of special education. While this study denotes statistically significant differences upon respondents in the Educational Leadership program at the University of Nebraska-Omaha, the study suggests a need for additional research.

Book excerpt: ABSTRACT: The purpose of this study was to assess the perceptions and knowledge of special education law among North Carolina Principal Fellows. A three-part questionnaire was the primary data source for this study. Part I of the questionnaire assessed the opinions Principal Fellows had toward the knowledge and understanding of special education law. It also investigated their need for additional training in special education law, as well as their satisfaction with administrative training in special education law. Twenty-one scenario-based statements relating to the IDEA provisions were used to determine the level of knowledge Principal Fellows had for special education law. The last section of the questionnaire provided demographic characteristics of the participants. The study revealed that the majority of Principal Fellows did not believe they had sufficient knowledge of special education law, with a larger percentage indicating a lack of understanding with special education law. Although the majority of Principal Fellows indicated an average need for additional training in special education law, a large majority indicated dissatisfaction for their administrative training in special education law. Data collected from Part 11 of the questionnaire indicated that Principal Fellows have insufficient levels of knowledge of the IDEA provisions. As indicated by their responses to scenario-based statements, Principal Fellows demonstrated difficulty with four of the seven provisions. This study revealed a need for more administrative training in special education law, in order for school administrators to acquire the skills necessary to provide effective leadership in the management of special education.

Book excerpt: The purpose of this collective case study was to discover, describe, and understand 11 public, general, K–12 in-service teachers’ knowledge, experiences, interpretations, and perceptions of education law. In addition, the study investigated teachers’ critical decision-making processes during their daily activities and responsibilities in the education profession in selected areas such as student bullying, fights, grades, students with disabilities, and teachers’ and students’ rights. Three theories that guided the study were constructivism (Young & Collin, 2004), cognitive dissonance (Chapanis & Chapanis, 1964), and self-efficacy (Bandura, 1977). Through purposeful sampling, 11 K–12 in-service teachers from the United States with at least one year of teaching experience with or without education law training (workshops, courses, or both) were used in the study. Data were collected using interviews, vignettes, and questionnaires. Data analysis methods included coding; finding patterns; developing categories, themes, matrices and charts; using QSR NVivo analysis software; and, within and cross-case analysis (Merriam, 1988; Miles & Huberman, 1994; Sorensen, 2008; Yin, 2009). Trustworthiness was established through member checking, triangulation, thick description, and reflexivity (Creswell, 2013; Merriam, 1988; Yin, 2009). Results of the study revealed educators from various backgrounds have some commonalities regarding their knowledge, interpretations, and perceptions of education law and their decision-making processes in selected areas of education law. It is recommended pre-service and in-service educators receive education law training for initial and renewal certification. Future research should investigate other stakeholders’ (teacher education faculty, teacher assistants, and substitutes) education law experiences, interpretations, knowledge, perceptions, and decision-making processes.

Book excerpt: Teachers play a crucial role in the education of students with disabilities and their participation in the special education process is critical and mandated by the Individuals with Disabilities Education Improvement Act (IDEIA). Despite the important role teachers play in the education of students with disabilities and the legal ramifications for failing to follow IDEIA, very few studies have examined teachers' actual knowledge or perception of their knowledge of special education procedure and law. The purpose of the present study is to determine the current knowledge of special education procedures and law and to determine areas in which educators need more support. This current case study focuses on the non-instructional tasks associated with educating students with disabilities. A sample of 17 general and special education teachers from various disciplines throughout grades K-12 in a Nassau County school district were interviewed independently or participated in a focus group via Google Meets. Four themes emerged from the data analysis: first, conflicting perceptions of teachers' ability to adhere to special education laws and regulations, second, that teacher's roles and responsibilities depend on the environment, third, that there is insufficient support from administration and fourth, that teachers have a mix of emotional responses as they fulfill the non-instructional task related to special education. The findings suggest that teachers make sense of the non-instructional tasks associated with special education students' support through peer relationships and administrative leadership. The study's findings indicate that there is a lack of professional development in the areas of special education law and that there are opportunities to meaningfully engage teachers in how to have positive and effective co-teaching relationships to enhance the education of students with disabilities across all grade levels.

The majority of special education teachers were not interested in pursuing a special education leadership position. The specific factors special education teachers believed may encourage other special education teachers in their pursuit of special education leadership positions were notably few. The specific factors special education teachers believed may discourage special education teachers from their pursuit of special education leadership positions all had common negative themes. In general, special education teachers did not have a positive view toward special education leadership roles.

Valid responses were collected from 59 participants. The quantitative data were analyzed using a series of one-way ANOVAs. The qualitative data were analyzed using color coding and theme analysis. While no statistically significant differences between the groups were found, school leaders perceived that special education law, accommodations, behavior management, and instructional strategies were four key areas that preparation programs needed, and special education teachers perceived that special education law, behavior management, co-teaching, and assessment should be addressed in educational leadership preparation programs. Future research is needed to further examine the topics presented during university-level and district-level programs. These findings support the need to provide additional, ongoing professional development on the current trends in special education for school leaders.
