Book excerpt: Excerpt from An Introduction to the Study of the Roman Law The lectures have been revised and published in their present form, not because they consti tute a complete introduction to the study of the Roman law, but because they seem calculated, in some measure, to supply the present want of such a work for the use of the students of American law. Book excerpt: Excerpt from Historical Introduction to the Roman Law The facts that another edition of this book has been called for, and that the second edition has been translated into Portuguese indicate that it makes an appeal to students who are attending lectures upon the Institutes. It does not pretend to be a systematic history of the Roman law, nor is it intended in any way to take the place of a commentary on the Institutes of Justinian. It is rather a series of chapters on problems, mainly historical, which confront the student who is beginning the Roman law. Its aim is to be complementary to a course of lectures, and to supply a historical background. The historical notices contained in the Institutes of Justinian are so fragmentary that without more information the student does not see the law in its true perspective. He has to be reminded that the law of Justinian is the culmination of a long history, and that the Romans started with a little body of Aryan customs, out of which their extraordinary genius was able by slow degrees to shape a legal system of the greatest refinement. Unfortunately the pressure of other subjects renders it impossible for most students to make a detailed study of the history of Roman law. If the "introduction" is not to encroach upon the time assigned to the practical law it must be kept within narrow limits. The difficulty is largely one of selection. Available in PDF, EPUB and Kindle. Book excerpt: "Historical Comparative Law and Comparative Legal History Legal history and comparative law overlap in important respects. This is more apparent with the use of some methods for comparison, such as legal transplant, natural law, or nation building. M.N.S. Sellers nicely portrayed the relationship. The past is a foreign country, its people strangers and its laws obscure.... No one can really understand her or his own legal system without leaving it first, and looking back from the outside. The comparative study of law makes one's own legal system more comprehensible, by revealing its idiosyncrasies. Legal history is comparative law without travel. Legal historians, perhaps especially in the United States, have been skeptical about the possibility of a fruitful comparative legal history, preferring in general to investigate the distinctiveness of their national experience. Comparatists, however, content with revealing or promoting similarities or differences between legal systems, by their nature strive toward comparison. Some American historians, especially since World War II, see the value in this"--

Available in PDF, EPUB and Kindle. Book excerpt: This book provides a new approach to the study of the History of Roman Law. It collects the first results of the European Research Council Project, Scriptores iuris Romani - dedicated to a new collection of the texts of Roman jurisprudence, highlighting important methodological issues, together with innovative reconstructions of the profiles of some ancient jurists and works. Jurists were great protagonists of the history of Rome, both as producers and interpreters of law, since the Republican Age and as collaborators of the principes during the Empire. Nevertheless, their role has been underestimated by modern historians and legal experts for reasons connected to the developments of Modern Law in England and in Continental Europe. This book aims to address this imbalance. It presents an advanced paradigm in considering the most important aspects of Roman law: the Justinian Digesta, and other juridical late antique anthologies. The work offers an historiographic model which overturns current perspectives and makes way for a different path for legal and historical studies. Unlike existing literature, the focus is not on the Justinian Codification, but on the individualities of ancient Roman Jurists. As such, it presents the actual legal thought of its experts and authors: the ancient iuris prudentes. The book will be of interest to researchers and academics in Classics, Ancient History, History of Law, and contemporary legal studies.

Available in PDF, EPUB and Kindle. Book excerpt: This book equips both lawyer and historian with a complete history of Roman law, from its beginnings c.1000 BC through to its re-discovery in Europe where it was widely applied until the eighteenth century. Combining a law specialist’s informed perspective of legal history with a socio-political and cultural focus, it examines the sources of law, the ways in which these laws were applied and enforced, and the ways the law was influenced and progressed, with an exploration of civil and criminal procedures and special attention paid to legal science. The final chapter covers the history of Roman law in late antiquity and appraises the move towards the codification of law that culminated in the final statement of Roman law: the Corpus Iuris Civilis of Emperor Justinian. Throughout the book, George Mousourakis highlights the relationship between Roman law and Roman life by following the lines of the major historical developments. Including bibliographic references and organized accessibly by historical era, this book is an excellent introduction to the history of Roman law for students of both law and ancient history.
