It has wrested from congress the assumed power to intervene for the prohibition or destruction of slavery in the common territories; and if, for a moment, it now flounders in the bog of non-intervention for the protection of slavery, as property, and a recognized element of our constitutional compact, I trust and believe that it is only for a moment. During the latter half of this period, beginning with the annexation of Texas in 1845, slavery was the dominant political issue. Over it the nation became sectionalized and the issue was resolved into a struggle between the two sections for political and industrial supremacy. The possession, first of the prospective Mexican acquisitions, later of the unorganized portion of the Louisiana Purchase, was the prize for which they strove, - the South to extend its system of slave labor to these regions, the North to restrain that system within existing limits and dedicate the future Territories and States to freedom. The long contest was characterized by great intensity and ever increasing bitterness, with the single exception of the period of "finality" which followed the Compromise of 1850; then, indeed, it was temporarily lulled into an unquiet sleep, - a sleep rudely terminated by the introduction of Douglas's Nebraska Bill in 1854. If any portion of those citizens should introduce into such territory any profession 011 institution which is recognized as legal by the constitution of the United States and that of the state from whence they come, the other part of the people residing in such territory, or the government itself, have no right to interfere to suppress or restrain their introduction, 011 in any way to attempt to prevent those persons from the exercise of such natural and legal rights. The people of the United States being the owners of such territories, and having an equal right in their common property and occupancy, each ought to be permitted to enjoy without molestation all the advantages arising from that common ownership, which does not in any way interfere with its common use. None should be permitted to change or destroy a common water-course, 011 otherwise disarrange any of the general rights of his fellow tenants; so should none attempt to suppress the exercise of the full rights of others in regard to the kind of labor they may employ. Nor can the government of the United States, or of the several states, interfere with the people in the exercise of these rights. Book excerpt: Excerpt from The Just Supremacy of Congress Over the Territories We shall begin what we have to say upon this subject with the free admission, that there are a good many elements Of popularity both in Mr. Douglas's character and in his present position. The public man who presents himself as an advocate for the right of self-government for any people, however they are situated, will always command popular sympathy in this country. But we are not now concerned with Mr. Douglas's chances or means of political success, but with the soundness and correctness of his constitutional Opinions. Whether he is or is not of that order Of men who would rather be right than be President, we do not presume to decide; but we are sure for ourselves, that, having no personal interest in the matter, we would rather be right than be able to prevent him or any other man from reaching the Presidency, if we had the power of all the nominating conventions or of all the voters in the land. It is the purpose of Mr. Douglas's article to maintain, that the people Of a Territory have the right to decide, independently of the will Of Congress, whether the institution Of slavery shall or shall not exist among them while they are in the Territorial condition. On a cursory reading of his paper, we were a little at a loss to determine whether he meant to be understood that this power belongs to the people of a Territory because the organic act bestows upon them general legisla tive power, or, as in the case of Kansas, declares that they shall be free to form their own institutions in their own way; or whether he holds that the people of a Territory are originally free to establish or prohibit slavery without any Congressional declaration or grant of such a power, or even against a Congressional prohibition. But, on a more careful perusal, we find that his argument goes the entire length Of maintaining, that, in reference to what he calls their local concerns and internal polity, the people of a Territory are absolutely sovereign in the same sense in which the people of a State are sovereign. In order to establish what he calls popular sovereignty in the Territories, Mr. Douglas undertakes to define the dividing line between federal and local authority; and he places it, in respect to the Territories, substan tially where it is in respect to the States. He sums up the whole dis cassion in the following principle, that every distinct politicalcommunity, loyal to the Constitution and the Union, is entitled to all the rights, privileges, and immunities of self-government in respect to their local concerns and internal polity, subject only to the Constitution of the United States. No. 51) proposing to amend the Constitution of the United States: Resolved by the Senate and House of Representatives the United States of America in Congress assembled, (two thirds of both Houses concurring.) That the following article be proposed to the Legislatures of the several States as an amendment to the Constitution of the United States; which, when ratified by three fourths of said Legislatures, shall be valid as part of valid Constitution, namely: Article - Representatives shall be apportioned among the several States which may be included within this Union according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed: Provided, That whenever the elective franchise shall be denied or abridged in any State on account of race or color, all persons therein of such race or color shall be excluded from the basis of representation. Mr. Sumner said: Mr. President: I begin by expressing my acknowledgments to the Senator from Maine, who yields the floor to me to-day, and also my sincere regret that anything should interfere with the opening of this debate by him. It is his right, and I enter upon it now only by his indulgence. I am not insensible to the responsibility which I assume in setting myself against a proposition already adopted in the other House, and having the recommendation of a committee to which the country looks with such just expectation, and to which, let me say, I look with so much trust. But after careful reflection, I do not feel that I can do otherwise. Knowing, as I do, the eminent character of the committee, its intelligence, its patriotism, and the moral instincts by which it is moved, I am at a loss to understand the origin of a proposition which seems to me nothing else than another Compromise of Human Rights as if the country had not already paid enough in costly treasure and more costly blood for such compromises in the past. I had hoped that the day of compromise with wrong had gone by for ever. Ample experience shows that it is the least practical mode of settling questions involving moral principles. A moral principle cannot be compromised. Here are the words of the amendment: Provided, That whenever the elective franchise shall be denied or abridged on account of race or color, all persons therein of such race or color shall be excluded from the basis of representation. I may be mistaken, sir, but I think it difficult to read this proposition without being painfully impressed by the discord and defilement which it will introduce into the Constitution, having among its specific objects the guarantee of a republican form of government. The discord is apparent on the face. The defilement Is none the less apparent. Go back, if you please, to the adoption of the Constitution, and you will gratefully acknowledge that the finest saying of the times was when Madison, evidently inspired by the Declaration of Independence, and determined to keep the Constitution in harmony with it, insisted in well-known words, that "it was wrong to admit in the Constitution the idea of property in man." Of all that has come to us from that historic Convention, where Washington sat as President, and Franklin and Hamilton sat as members, there is nothing having so much of imperishable charm. It was wrong to admit in the Constitution the idea that man could hold property in man. Accordingly, in this spirit the Constitution was framed. This offensive idea was not admitted. I can make allowance for difference in education, and doubt not the fre quent exercise of humanity in the master. I am not called Upon to speak of slavery in the States where it now exists; when those States came into the Union, no power over the subject was reserved to the General Government, and hence this power belongs to such States exclusively. But in discussing the expediency and the right Of extending this institution into free territory, it would he unpardon able in a legislator to shut his eyes against any thing legitimately bearing on the question. The charge, that the agitation of this subject tends to affect slave property in the Southern States is true to a certain extent. It is like the influence produced bygjhe emancipation of our own country from the thraldom of Great Britain upon shveral nations in Europe. So will the policy pursued by our Government in te gard to these newly acquired Territories, produce some moral effect upon the slave holding States themselves. Even the emancipation Of the slaves in the Northern States must have produced some influence in the South. I am not surprised that the emancipation of slaves by Mexico, the South American Republics, England, and Denmark, should press somewhat upon the Southern States, and produce a restiveness occasioned by the spread of principles hostile to this institution. This progress of freedom to the slave illy prepared the mind of the slaveholder for the intelligence that republican France, among her first legislative enactments, ex tended to her slaves the same liberty which she had won for her own citizens; and ratified the deed by inserting in her Constitution the short but comprehensive and memorable article, that slavery cannot exist in any territory belonging to France. Though this general progress of liberty may produce some effect in the South, it is demanding too much that all that the world is doing for liberal princi ples should stop on that account. Can the South ask more than the pledge, that slavery in the States where it now is, shall not be interfered with. This conception of the Union, which is known as the states-rights doctrine, was adopted by the Southern States, and their deliberate acts of secession were the immediate cause of the Civil war and all its attending disasters. But with the defeat of the South, the dogma of states rights perished. Henceforth the Constitution is to be viewed, not as a compact between sovereign States, but as the fundamental law of the whole land - as the expression of the will of the entire N ation - and arguments relating to it must be based upon that fundamental conception. Among the first fruits of the triumph of the North was the adoption of three amendments to the Constitution, which gave a number of important powers to the central govern ment, which were hitherto deemed to rest exclusively withinthe province of the States. A series of acts was passed by Congress, which was in direct violation of principles hither to maintained, and manifested a disposition to exalt the national idea by eliminating from State life theories of action from which the dogma of state-rights could again spring into being. I refer to those acts relating to the reconstruction of the rebellious States and their restoration to their former practical relations with the rest of the Union, and to some acts admitting new States. The practical course pursued in the restoration of the old States throws new light upon the process of State formation and admission, which is reflected in the debates in Congress, incident to the admission of new States. It had often been maintained that the territories of the United States had the right to be admitted into the Union as States. This claim now met with rigid criticism, and even bold denial.
