Book excerpt: An Inexplicable Deformity Volume 3 This book has been painstakingly researched and written in hopes of enabling the basic humane treatment for all those incarcerated in the United States today and in the future. Mr. Tripati has specializations in Public International Law, Public Law, and European Law. WHAT IS FRAUD UPON THE COURT? Kupferman v Consolidated Research Mfg., Corp., 459 F.2d 1072, 1078 (2nd. Cir. 1972) (emphasis added) fraud upon the court "embraces only that species of fraud which does, or attempts to defile the court itself, or is a fraud perpetrated by officers of the court so that the judicial machinery cannot perform in the usual manner its impartial task of adjudging cases that are presented for adjudication......while an attorney "should represent his client with singular loyalty that loyalty obviously does not demand that he act dishonestly or fraudulently; on the contrary his loyalty to the court, as an officer thereof, demands integrity and honest dealing with the court. And when he departs from that standard in the conduct of a case he perpetrates a fraud upon the court." ." Hadges v. Yonkers Racing Corp., 48 F.3d 1320, 1325 (2d Cir.1995) (emphasis added) (quotation omitted). Thus, consistent with the First Circuit's observation that fraud on the court does not encompass "gardenvariety fraud," Geo. P. Reintjes, 71 F.3d at 48, "[p]erjury constitutes fraud on the court only in special situations, such as when an officer of the court commits the perjury." Myser v. Tangen, No. C14-0608JLR, 2015 WL 502316, at *6 (W.D. Wash. Feb. 5, 2015). When the unsuccessful party is kept away from the court by a false promise of compromise, or such conduct as prevents a real trial upon the issues involved, or any other act or omission which procures the absence of the unsuccessful party at the trial. Further, it consists of fraud by the other party to the suit which prevents the losing party either from knowing about his rights or defenses, or from having a fair opportunity to present them upon the trial. In United States v. International Telephone & Tel. Corp., 349 F. Supp. 22, 29 (D. Conn. 1972), aff'd without opinion, 410 U.S. 919, (1973), the trial court explained: "The Degree of a civilization can be judged by entering its prisons"

Available in PDF, EPUB and Kindle. Book excerpt: Biochemical Disorders of the Skeleton explores the biochemical and clinical aspects of skeletal disorders, including osteoporosis, osteomalacia, Paget's disease of bone, osteogenesis imperfecta, and Marfan's syndrome. Homocystinuria, Ehlers-Danlos syndrome, mucopolysaccharidoses, hyperphosphatasia and hypophosphatasia, and fibrous dysplasia are also considered. Comprised of 12 chapters, this book begins with an overview of the physiology of bone, with emphasis on the structures produced by bone cells and the different hormones that influence them. The symptoms, signs, and investigation of metabolic bone disease are then described and compared. The following chapters focus on the biochemistry and clinical aspects of disorders affecting the skeleton, from osteoporosis and osteomalacia to Ehlers-Danlos syndrome, fibrous dysplasia, osteopetroses and hyperostoses, and fibrogenesis imperfecta ossium. The final chapter offers a short description of advances that have been made in understanding these biochemical disorders, including the significance of low-plasma calcitonin in women; the role of mithramycin in Paget's disease; and the identification of the different types of osteogenesis imperfecta. This monograph will be a valuable resource for physicians, pediatricians, and orthopedic surgeons.

Available in PDF, EPUB and Kindle. Book excerpt: New Mexico's night sky generated speculation about alien visitation for centuries before the Roswell Incident of 1947. But the luminous spheres known as Bolas de Lumbre weren't the only evidence of unnatural phenomena in play. Locals have grown accustomed to stacking an unending list of questions against a disquieting tally of strange objects, unexplained sightings and unsolved mysteries that perplex scientists and confound skeptics alike. The original inhabitants of the land confidently claimed the distant stars as their ancestral home, but there is nothing remote about the fear many of the state's modern residents feel for the "Evil Eye" or a host of other supernatural threats. From notorious body snatchers to obscure ancient rituals, Ray John de Aragón examines New Mexico's eerie heritage.

Book excerpt: From the 'Monster of Ravenna' to the 'Elephant Man', Myra Hindley and Ted Bundy, the visualisation of 'real', human monsters has always played a part in how society sees itself. But what is the function of a monster? Why do we need to embody and represent what is monstrous? This book investigates the appearance of the human monster in Western culture, both historically and in our contemporary society. It argues that images of real (rather than fictional) human monsters help us both to identify and to interrogate what constitutes normality; we construct what is acceptable in humanity by depicting what is not quite acceptable. By exploring theories and examples of abnormality, freakishness, madness, otherness and identification, Alexa Wright demonstrates how monstrosity and the monster are social and cultural constructs. However, it soon becomes clear that the social function of the monster – however altered a form it takes – remains constant; it is societal self-defence allowing us to keep perceived monstrosity at a distance. Through engaging with the work of Michel Foucault, Julia Kristeva and Canguilhem (to name but a few) Wright scrutinises and critiques the history of a mode of thinking. She reassesses and explodes conventional concepts of identity, obscuring the boundaries between what is 'normal' and what is not.

Available in PDF, EPUB and Kindle. Book excerpt: The high rates of Black arrests and incarceration from 1960-1990 were a direct result of deliberate government policies and a zealous criminal justice system, under the patriotic umbrella of the War on Crime. This stateside war shared a lot of similarities with the Vietnam war happening simultaneously: racism and extreme cruelty towards those seen as the enemy, deprecation of the others' culture, forceful use of a militarized police with combat experience, repeated failure to observe human rights, and mass incarceration. Unfortunately, this conflict continued long after the Vietnam war ended. Ronald L. Morris reviews those dark times, analyzing their causes, short- and long-term effects, and calls for change.

Available in PDF, EPUB and Kindle. Book excerpt: Generation of Animals is one of Aristotle's most mature, sophisticated, and carefully crafted scientific writings. His overall goal is to provide a comprehensive and systematic account of how animals reproduce, including a study of their reproductive organs, what we would call fertilization, embryogenesis, and organogenesis. In this book, international experts present thirteen original essays providing a philosophically and historically informed introduction to this important work. They shed light on the unity and structure of the Generation of Animals, the main theses that Aristotle defends in the work, and the method of inquiry he adopts. They also open up new avenues of exploration of this difficult and still largely unexplored work. The volume will be essential for scholars and students of ancient philosophy as well as of the history and philosophy of science.
