Attention is directed to developments in the law relating to sex discrimination against employees and against students in colleges and universities, and practical and cost-efficient strategies for complying with the law. The pertinent laws on sex discrimination against employees, job applicants, and students are cited. The employee-related laws address hiring, retention, promotion, tenure, salary and fringe benefits, sexual harassment, and affirmative action practices for government contracts. Judicial decisions are based on the prima facie case, rebuttal, pretext, and the discovery of confidential faculty evaluations. The laws on sex discrimination against students address practices in admissions, tuition rates, financial aid, sexual harassment, student organizations, student services, housing and parietal rules, and athletics. Three strategies for compliance are: (1) carefully selecting and training key academic and administrative personnel, including faculty who serve on review and search committees; (2) implementing a management control system; and (3) securing indemnification against losses suffered as a result of unintentional discrimination. Book excerpt: The sexual interaction among students and educators has become a significant social issue in higher education, resulting in claims being brought to the U.S. courts by students and parents alleging sex discrimination and sexual harassment. These claims have been based on three principal legal theories: 1) the Equal Protection Clause of the Fourteenth Amendment to the United States Constitution, (2) Title VII of the Civil Rights Act of 1964 (42 U.S.C.A. section 2000), and (3) Title IX of the Educational Amendments of 1972 (20 U.S.C.A. section1681-1863). During its first phase, this study examined U.S. Courts of Appeal and U.S. District Court decisions involving sex discrimination in higher education between students and faculty or administration, brought to the court under the Equal Protection Clause of the Fourteenth Amendment, Title VII, and Title IX. The study's purpose was to examine the relationship among judges' political ideology, judges' gender, judges' appointment era, plaintiffs' gender, and judges' voting in sex discrimination disputes. Judges' individual voting, the single binary dependent variable, was classified as pro-plaintiff (liberal) or pro-defendant (conservative). Political ideology, appointment era, judges' gender, and plaintiffs' gender were set up as independent predictors. In addition to examining the relationship among the independent variables and individual voting, the study in its second phase examined case outcomes in United States Courts of Appeal to determine, among other things, if the composition of an appellate panel influenced decisional outcomes. The independent predictors in this phase of the study were the gender majority of the panel, the appointment era majority of the panel, the ideological majority of the panel, and the plaintiffs' gender. The binary dependent variable was the case decisional outcome, either pro-plaintiff (liberal) or pro-defendant (conservative). Results with the individual database indicated that political ideology and plaintiffs'gender were factors which influenced judge voting. Results of the panel database indicated that appointment era majority and plaintiffs' gender were significant factors influencing case outcome.

The United States Supreme Court has held that Title IX holds schools liable for sex discrimination, including sexual harassment and sexual assault. In the landmark case, Davis v. Monroe County Board of Education, the Supreme Court identified the criteria in which a school district can be held liable for student-on-student sexual harassment under Title IX. The Supreme Court's criterion is presented in the form of a three-prong test, and all prongs must be satisfied for liability to exist. The first prong is whether or not the harassment was so severe, pervasive, and objectively offensive that the victim was denied access to an educational opportunity. The second prong is whether an official who had the authority to stop the harassment had actual notice of the harassment. Finally, the third prong is whether an official who did have both the authority to stop the harassment and actual notice remained deliberately indifferent. The goal of this study was to analyze post-Davis case law to determine how and when a school can be found liable for student-on-student sexual harassment. This analysis can help school administrators and school boards to develop policies and practices to help prevent Title IX liability for student-on-student sexual harassment.

Book excerpt: In recent years, a number of high-profile incidents of sexual violence at institutions of higher education (IHEs) have heightened congressional and administration scrutiny of the policies and procedures that IHEs currently have in place to address campus sexual violence and how these policies and procedures can be improved. Campus sexual violence is widely acknowledged to be a problem. However, reported data on the extent of sexual violence at IHEs varies considerably across studies for a variety of methodological and other reasons. Victims of sexual violence may suffer from a range of physical and mental health conditions including injuries, pregnancy, sexually transmitted diseases, post-traumatic stress disorder, depression, suicidality, and substance abuse. College students who are the victims of sexual violence may experience a decline in academic performance, and they may drop out, leave school, or transfer. Currently, there are two federal laws that address sexual violence on college campuses: the Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (Clery Act, P.L. 101-542) and Title IX of the Education Amendments of 1972 (Title IX, P.L. 92-318). These two statutes differ in significant respects, including in their purpose, coverage, enforcement, and remedies. The Clery Act requires all public and private IHEs that participate in the student financial assistance programs under Title IV of the Higher Education Act (HEA, P.L. 89-329) of 1965 to track crimes in and around their campuses and to report these data to their campus community and to the Department of Education (ED). ED's Federal Student Aid (FSA) Office oversees educational institutions' compliance with Title IV student financial aid requirements, including requirements related to the Clery Act. In this role, FSA conducts program reviews of IHEs' compliance with student aid and Clery provisions. Title IX is a civil rights law that prohibits discrimination on the basis of sex under any education program or activity that receives federal funding. Under Title IX, sexual harassment, which includes sexual violence, is a form of unlawful sex discrimination. Unlike the Clery Act, whose coverage is limited to IHEs that receive student financial aid funds under the HEA, Title IX is applicable to recipients of any type of federal education funding, including any public or private elementary, secondary, and postsecondary school that receives such funds. Although each federal agency enforces Title IX compliance among its own recipients, ED, which administers the vast majority of federal education programs, is the primary agency conducting administrative enforcement of Title IX. Such enforcement by ED's Office for Civil Rights (OCR) may occur as part of a routine compliance audit or in response to a complaint filed by an individual. Members of Congress have been actively involved in seeking ways to improve how IHEs respond to, investigate, and adjudicate incidents of campus sexual violence. Several bills that would strengthen existing laws pertaining to campus sexual violence have been introduced during the 113th Congress. In January 2014, the Obama Administration established a White House Task Force to Protect Students from Sexual Assault. In April 2014, the Task Force issued its first report—Not Alone— and created a website that addresses campus sexual violence. Among other things, the report included an extensive list of actions that the Administration will take (or has already taken) to address campus sexual violence.
