Book excerpt: Money laundering is one of the most prevalent crimes in the global community, and one in which several preventions exist within the United States, including the Bank Secrecy Act and the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism (USA PATRIOT). The following study examines the incidence and risks associated with money laundering, the potential effects for financial institutions, the history of compliance by financial institutions, the confusion surrounding anti-money laundering regulations, and the existing research relating to the perceived effectiveness of money laundering controls. Research was conducted with both managerial and non-managerial employee levels to determine whether anti-money laundering efforts were effective for financial institutions and to ascertain whether existing research was skewed having previously only surveyed the senior management level at banking institutions. The research found that financial institutions are generally in compliance with money laundering regulations, specifically the USA PATRIOT Act Title III S 352. The research conducted indicated that respondents answered similarly in comparison to the senior management research already in existence. The research identified some areas of concern, including the need to ensure that appropriate technology systems and training exists for financial institution employees as well as the need for enhanced penalties for failure to adhere to regulations as the potential revenue far outweighs penalties.

The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. These are identified in the table of titles near the beginning of each volume. The Law Revision Counsel of the House of Representatives continues to prepare legislation pursuant to 2 U.S.C. 285b to enact the remainder of the Code, on a title-by-title basis, into positive law. The 2012 edition of the Code was prepared and published under the supervision of Ralph V. Seep, Law Revision Counsel. A major piece of legislation that has garnered criticism for its restrictive effects is Title III of the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act of 2001 (the USA Patriot Act), in particular Section 326 governing customer identification regulations. This study considers the likelihood that immigrants are unbanked before and after the Patriot Act, and whether the Act limits their access to banking. In addition, the research recognizes the influence of various government policies and bank initiatives that aim to encourage financial inclusion of immigrants. The results suggest that immigrants in general are more likely to own a transaction account after the Patriot Act than before. Thus, the net result of policies that are intended to promote and those that are said to restrict access to banking points more to financial inclusion as opposed to exclusion. Finally, the probability of immigrants being unbanked varies according to various characteristics, such as country of origin, length of stay in the United States, place of residence and so forth, suggesting that outreach initiatives should be customized by community.

And civil rights activists have decried the government's interpretation of the act with respect to detaining individuals who may be guilty of nothing more than being born in the Middle East.
