The personnel of the California Legislature of 1909, was, all things considered, better than that of any other Legislature that has assembled in California in a decade or more. There were, to be sure, in both Senate and Assembly men who were constantly on the wrong side of every question affecting the moral, political or indus trial well-being of the State, but a majority of each House labored for the passage of good laws, laws which would not only silence and satisfy constituents, but prove effect ive and accomplish the purpose for which they had been drawn. Again and again have Commissioners sent away free colored people as slaves. We have not yet forgotten that Commissioner Ingraham sent Adam Gibson into slavery, in most indecent haste, and Mr. Knight, of Maryland, refused to accept him as his slave. Other cases have occurred where witnesses have sworn to falsehood, and the Commissioner decided, in the face of justice, a free man a slave. We have only to read the history of the cases under this law to learn how many such attempts have been made; how often they have succeeded how a few victims have been rescued by great effort. But who can tell how many free men and women have been spirited away in secret by the facilities afforded through this infamous edict of despotism. The Fugi tive Slave Law is really a law to encourage kidnapping for it leaves the whole free colored population without defense against that power which proclaims the black man the natural slave of the white man. Sir Denis Le March ant, the chief clerk, then read the paragraphs as follows: - "I have directed that information should be procured in reference to the rights of voting in the election of members to serve in Parliament far counties, cities, and boroughs. "When that information is complete, the attention of Parliament will be called to the result thus obtained, with a view to such improvements in the laws which regulate the rights of voting in the election of members of the House of Commons as may tend to strengthen our free institutions, and conduce to the public welfare." The Chancellor of the Exchequer rose and said: Mr. Deputy-Speaker, if in order to estimate the difficulties of the question which I have now to bring before you it be right, as I suppose, to take into view not only its own extent and complexity, and the strange fluctuations of circumstances which have attended and marked its history, but also the weakness of the hands into which the treatment of it has fallen - this perhaps I may well say, that few Ministers have risen in recent years to address the House under greater difficulties than at this moment attend my own position and task. Sir, these are difficulties which affect in the first instance her Majesty's Government, and they are perfectly sensible of the weight of responsibility which attaches to them; but although they be concentrated in their greatest weight upon us, yet they are not ours alone. The interest in the solution of this question is an interest common to the whole House of Commons, and to every party and every section of a party that sits within this House. (Hear, hear.) For, sir, let me remind you that these paragraphs which we have just heard read are not the only paragraphs in which, under the most solemn form known to the Constitution, the subject of the representation of the people has been brought under the notice of Parliament. It is certain that the adoption of a vigorous month's work in winter, instead of a month's lassitude in July, would produce vastly better results in legislation, to say nothing of the health of the workers; and, as was urged on the Committee by a great Conservative statesman, if any great public question required the attendance for a time of sporting county members, their patriotism would no doubt lead them to make the necessary sacrifice, and if not, well, I suppose, we should have to manage to get on without them. Book excerpt: Excerpt from Political Reform by the Representation of Minorities When the compilation of the following pages was commenced the intention was first, to describe briefly the evils growing out of the present system of electing, by a majority or plurality of the votes cast in each district, single members to represent the people in it, in national, state or municipal legislative assemblies; second, to show that by increasing the size of or consolidating a number of the present districts and electing several members from each, by a system which would give minorities as well as majorities representation, at least some of these evils would be remedied; third, to give a very brief, simple, and as clear an explanation as possible of what is meant by minority, proportional or personal representation - as it has been called by different writers - then to collect from the various books and essays on the subject some of the most convincing arguments which have been advanced in favor of adopting some such method of electing representatives to our national, state, and municipal legislative bodies. In making such an explanation the practice which has prevailed in Illinois, for more than twenty years, of choosing the members of the House of Representatives in that State by a system of cumulative voting, afforded an object lesson from which the general principles of the simplest form of minority representation could be described and made obvious to those who are totally ignorant of the subject - and at least nineteen-twentieths of all who are ordinarily regarded as intelligent people are included in this class - more easily than in any other way. As the Illinois system was used as an illustration, it was thought readers would naturally ask how it has worked in practice. To answer this anticipated inquiry a method of getting information was adopted which has been used very successfully in various associations with which the writer has been connected, for making investigations relating to technical subjects. The pro posalwas embodied in a rider to one of the appropria tion bills and at first provided for a term of five years, at the end of which every employee who was not re appointed should be regarded as dismissed from the service. In-this form the bill passed the House, but through the efforts of the National Civil Service Re form League the rider was struck out by the Senate. In its place the Senate inserted a new section providing for a system of efficiency records for the entire federal service, to be kept under the supervision of the Civil Service Commission and to serve as. An automatic basis for promotion, reduction or dismissal. In con ference the bill was again changed; the efficiency pro visions werxaretained, but a new tenure of office provi sion was inserted, differing from the original only in that the term was made seven years instead of five. In spite of the active opposition of various organiza tions, including the National Civil Service Reform League, and the general condemnation of the proposal in the press, the bill in this form was passed. For tunately President Taft utterly disapproved the fixed term idea and refused to approve the bill with this rider in it. The two - thirds majority necessary to pass the bill over the veto could not be secured and the at tempt was fortunately defeated. At the same time, however, the provisions for an efficiency system were retained and a distinct gain was thus made. Book excerpt: Excerpt from Queensland: Correspondence Respecting the Reserved Bill for Abolition of the Legislative Council Sir, I have the honour to forward herewith for the signification of His Majesty's pleasure thereon, a Parchment copy of a Bill to Amend the Constitution of Queensland by Abolishing the Legislative Council ("The Constitution Act Amendment Bill of 1921"), which passed through both Houses of the Parliament of Queensland in their recent Session. I also transmit 20 copies of the Bill and for convenience of reference a full report on the debate which took place on the 24th, 25th and 26th October, extracted from the Hansard Report. (Enclosure 2.) 2. The Bill as originally introduced was intended to abolish by its second clause the Legislative Council, membership of that Council, and all Offices in or in connection with it, and to make Parliament consist of The King and the Legislative Assembly only. The third clause, subsequently removed from the Bill as explained below, established a standing Revisory Committee of the Legislative Assembly to ensure that the provisions of any Bill were a clear expression of the will and intention of Parliament, and that so far as it dealt with existing legislation, it dealt with it clearly and effectively. The fourth clause, which subsequently became the third, was to preserve to existing members during life, or for a period to be notified, certain privileges, of which the principal were a free railway pass, and the use of the Parliamentary Library. The fifth clause, which subsequently became the fourth, repealed enactments or privileges inconsistent with legislation by a Parliament constituted as was to be provided for by the second clause. 3. The first debate on the Bill (p. 1729 to 1744 of Hansard Report) was on the Premier's motion in the Legislative Assembly on October 24th that the Committee of the whole House should consider the desirableness of introducing the Bill.
