Excerpt: ...will be remembered that the Duke of York claimed under title from the King based on discovery. The matter was never authoritatively adjudicated upon and determined. Even as conquered territory, however, its laws could not stand in so far as they were inconsistent with the fundamental laws of England. Furthermore, the Act of 7 and 8 William III, ch. 22, repealed all colonial laws inconsistent with and repugnant to the laws of England, and various English statutes were in terms from time to time made applicable to all the American colonies, while some of the grants of privileges to the colony of New York in terms made certain English laws applicable. From any point of view, then, the laws of England had an important bearing upon the status of the Jews in the newly conquered province of New York, and we will find that they were distinctly applied in several instances. It is important, then, that we glance for a few moments at the legal status of the Jews in England before the Revolution. It is not my purpose to branch off here into an extended review of the legal status of the Jews in England during the colonial period; such a task is wholly beyond the scope of the present paper. It may be observed, however, that thus far no earnest treatment of this subject has appeared, although without it, it is impossible to understand the development of religious liberty in America as far as it is applicable to the Jews. The enactments and adjudications of the mother country were so largely binding upon the colonies, so frequently in conflict with their statutes, and so often applied in unexpected contingencies, that the history of the latter is unintelligible without the former.
