Book Synopsis Introduction to Dutch Law by : Larissa van den Herik
Download or read book Introduction to Dutch Law written by Larissa van den Herik and published by Kluwer Law International. This book was released on 2022-01-27 with total page 696 pages. Available in PDF, EPUB and Kindle. Book excerpt: A standard legal resource since its first edition in 1978, this matchless book has proven itself the ideal overview of Dutch law for foreign lawyers. This Sixth Edition fully updates its systematic description of the legal sources, institutions, and concepts in all major fields of law. Recent developments covered include the progressive implementation of standards set by international conventions, the reorganization of the judiciary, the statute on environmental law, and the (re)codification of private international law. The continuing influence of European law is evident in many fields, perhaps most notably in family law. The various chapters are written by experts - scholars and lawyers - in particular fields, and provide an authoritative overview of each field. The historical sources of Dutch law are discussed, as well as Dutch legal culture, legal philosophy, judicial organization, legal education, and the legal profession. These chapters are followed by introductions to essential issues of private and public law and labour law. The last chapter examines financial law. The only resource of its kind available, this book is unmatched as a thorough guide to further research. It offers practitioners, particularly foreign lawyers, a quick and reliable way into any area of Dutch law that they may be required to research. It will also be of great value to comparatists (especially those studying the influence of European law on national legal systems), scholars, and students. Like previous editions, the Sixth Edition has been prepared under the auspices of the Netherlands Comparative Law Association.

Available in PDF, EPUB and Kindle. Book excerpt: This volume of the Netherlands Yearbook of International Law explores the many faces of populism, and the different manifestations of the relationship between populism and international law. Rather than taking the so-called populist backlash against globalisation, international law and governance at face value, this volume aims to dig deeper and wonders ‘What backlash are we talking about, really?’. While populism is contextual and contingent on the society in which it arises and its relationship with international law and institutions thus has differed likewise, this volume assists in our examination of what we find so dangerous about populism and problematic in its relationship with international law. The Netherlands Yearbook of International Law was first published in 1970. It offers a forum for the publication of scholarly articles in a varying thematic area of public international law./div

Book Synopsis The Law Applicable to Cross-border Contracts involving Weaker Parties in EU Private International Law by : María Campo Comba

This book was released on 2020-12-07 with total page 380 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book provides answers to the following questions: how do traditional principles of private international law relate to the requirements of the internal market for the realisation of the EU’s objectives regarding the protection of weaker parties such as consumers and employees? When and how should private international law ensure the applicability of EU directives concerning the protection of weaker parties? Are the EU’s current private international law, rules on conflict of laws, and private international law approach sufficient to ensure the realisation of its objectives regarding weaker contracting parties, or is a different approach to private international law called for? The book concludes with several proposed amendments, mainly regarding the Rome I Regulation on the law applicable to contractual obligations, as well as suggestions on the EU’s current approach to private international law. This book is primarily intended for an academic audience and to help achieve better regulation in the future. It also seeks to dispel certain lingering doubts regarding the current practice of EU private international law.

Book Synopsis The Dutch Collective Settlements Act and Private International Law by : Hélène van Lith
Download or read book The Dutch Collective Settlements Act and Private International Law written by Hélène van Lith and published by Maklu. This book was released on 2011 with total page 188 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book analyzes the relationship between private international law and collective settlements concluded for the benefit of foreign-interested parties under the 2005 Dutch Collective Settlements Act, or WCAM. It examines aspects of international jurisdiction, cross-border notification, representation of foreign-interested parties, international recognition, and applicable law. The principal object of this study is to assess the suitability of existing private international law instruments at the national, European, and international levels, for the application of WCAM in transnational mass damage cases. The WCAM provides for collective redress in mass damages, on the basis of a settlement agreement concluded between one or more representative organizations and one or more allegedly liable parties, for the benefit of a group of affected persons to whom damage was allegedly caused. When a WCAM collective settlement is concluded by representative organizations for the benefit of foreign interested parties, various aspects of private international law come into play. These include aspects of international jurisdiction, cross-border notification, recognition, applicable law, and representation of foreign interested parties. The book analyzes all of these matters, but focuses on the applicability of WCAM settlements to transnational mass damage cases involving interested parties domiciled outside the Netherlands. It includes comparative observations in relation to jurisdictions, such as the US and Canada, that are familiar with collective or group actions based on an opt-out mechanism like the WCAM procedure.
