Book excerpt: The impact and ramifications of cases argued before the Supreme Court are felt for decades, if not centuries. Only the most important issues of the day and the land make it to the nine justices, and the effects of their decisions reach far beyond the litigants. Under discussion here are five of the most momentous Supreme Court cases ever. They include Marbury v. Madison, Roe v. Wade, Dred Scott, Brown v. Board of Education, and The Pentagon Papers. An absorbing exploration of enormously controversial events, the series details, highlights, and clarifies the complex legal arguments of both sides. Placing the cases within their historical context (though they ultimately emerge as works in progress), the authors reveal each decision's relevance both to the past and the present. the result is a fascinating glimpse across the centuries into the workings of the Supreme Court and the American judicial system.

Book Synopsis The Making of Reverse Discrimination by : Ellen Messer-Davidow
Download or read book The Making of Reverse Discrimination written by Ellen Messer-Davidow and published by University Press of Kansas. This book was released on 2021-07-14 with total page 424 pages. Available in PDF, EPUB and Kindle. Book excerpt: In The Making of Reverse Discrimination Ellen Messer-Davidow offers a fresh and incisive analysis of the legal-judicial discourse of DeFunis v. Odegaard (1974) and Regents of the University of California v. Bakke (1978), the first two cases challenging race-conscious admissions to professional schools to reach the US Supreme Court. While the voluminous literature on DeFunis and Bakke has focused on the Supreme Court’s far from definitive answers to important constitutional questions, Messer-Davidow closely examines each case from beginning to end. She investigates the social surrounds where the cases incubated, their tours through the courts, and their aftereffects. Her analysis shows how lawyers and judges used the mechanisms of language and law to narrow the conflict to a single white male applicant and a single white-dominated university program to dismiss the historical, sociological, statistical, and experiential facts of “systemic racism” and thereby to assemble “reverse discrimination” as a new object of legal analysis. In exposing the discursive mechanisms that marginalized the interests of applicants and communities of color, Messer-Davidow demonstrates that the construction of facts, the reasoning by precedent, and the invocation of constitutional principles deserve more scrutiny than they have received in the scholarly literature. Although facts, precedents, and principles are said to bring stability and equity to the law, Messer-Davidow argues that the white-centered narratives of DeFunis and Bakke not only bleached the color from equal protection but also served as the template for the dozens of anti–affirmative action projects—lawsuits, voter referenda, executive orders—that conservative movement organizations mounted in the following years.

Download or read book The Half-Opened Door written by Marcia Synnott and published by Routledge. This book was released on 2017-07-12 with total page 359 pages. Available in PDF, EPUB and Kindle. Book excerpt: By the turn of the twentieth century, academic nativism had taken root in elite American colleges—specifically, Harvard, Yale, and Princeton. White, Anglo-Saxon, Protestant hegemony was endangered by new kinds of student, many of them Catholic and Jewish immigrants. The newcomers threatened to displace native-born Americans by raising academic standards and winning a disproportionate share of the scholarships. The Half-Opened Door analyzes the role of these institutions, casting light on their place in class structure and values in the United States. It details the origins, history, and demise of discriminatory admissions processes and depicts how the entrenched position of the upper class was successfully challenged. The educational, and hence economic, mobility of Catholics and Jews has shown other groups—for example, African Americans, Asian Americans, and Spanish-speaking Americans—not only the difficulties that these earlier aspirants had in overcoming class and ethnic barriers, but the fact that it can be done. One of the ironies of the history of higher education in the United States is the use of quotas by admissions committees. Restrictive measures were imposed on Jews because they were so successful, whereas benign quotas are currently used to encourage underrepresented minorities to enter colleges and professional schools. The competing claims of both the older and the newer minorities continue to be the subject of controversy, editorial comments, and court cases—and will be for years to come.
