This book explores the legal, political, and historical nature of disputes over territory in the African continent, and critiques the content and application of contemporary International law to the resolution of African territorial and border disputes. Drawing on central concepts of public international law such as sovereignty and jurisdiction, and socio-political concepts such as colonialism, ethnicity, nationality and self-determination, this book interrogates the intimate connection that peoples and nations have to territory and the severe disputes these may lead to. Gbenga Oduntan identifies the major principles of law at play in relation to territorial, and boundary disputes, and argues that the predominant use of foreign based adjudicatory mechanisms in attempting to deal with African boundary disputes alienates those institutions and mechanisms from African people and can contribute to the recurrence of conflicts and disputes in and among African territories. He suggests that the understanding and application of multidisciplinary dispute resolution mechanisms and strategies can allow for a more holistic and effective treatment of boundary disputes. In Africa, border disputes are commonplace, and they produce bitter conflicts and tribulations. This thesis investigates the border dispute between Malawi and Tanzania over Lake Nyasa. It argues that the protracted dispute is the result of inaction and poor leadership, rather than 'colonial legacy.' Using game theory, this thesis demonstrates that partial sum games produce the best path for resolving this border dispute through communication and cooperation. Furthermore, the thesis argues that the establishment of democracy and rule of law, responsible leadership, and strong political will should create the conditions for successful compromise between the two countries. Without a negotiated settlement, Malawi and Tanzania's border dispute will continue to affect relations between the two countries and deplete natural resources in and around the lake.

Book excerpt: At independence, Cameroon and Nigeria adhered to the OAU principle of UTI POSSEDETIS JURIS by inheriting the colonial administrative borders whose delineation in some parts was either imperfect or not demarcated or both. The two countries tried to correct these anomalies. But such efforts were later thwarted by incessant geostrategic reckoning, dilatory, and diversionary tactics in the seventies and eighties that persisted and resurfaced in the nineties with a more determined posture. On two occasions, the border conflict almost boiled over to a full-scale war. First, in May 1981 when there was the exchange of fire between Cameroonian and Nigerian coast guards and second, in February 1994 when Nigeria marched her troops into Cameroons Bakassi Peninsula. Elsewhere in Africa, border incidents like these have often degenerated into war. But Cameroon and Nigeria together with the international community managed these protracted incidents from escalating into war.
