This particular edition (2009): This year''s edition of the Global Community Yearbook is restructured to update its format and to better respond to its objective. The elaboration of legal maxims, extracted from the courts'' decisions, and their systematic classification makes this year''s edition of the Yearbook unique. International courts and tribunals have developed remarkably in recent years, and it is becoming increasingly difficult to follow the case law emanating from those jurisdictions without the help of an intermediary. The Yearbook and its unique changes fill this gap by serving as an intermediary between the case law and international scholars, practitioners, and students. In previous issues of the Yearbook, these legal maxims were prepared by referring both to the law and often extensively to the specific facts of the case. In the new format, the "legal maxims" will now distil the most important elements of judicial decisions and rely less heavily on the facts. The text of the legal maxims has been reduced to the minimum necessary for systematic classification, printing the website links for the case law. An introductory note on each international tribunal or court continues to be provided as a synopsis of their activity over the year. This reduction of the text of legal maxims better responds to the goals of the Yearbook to serve as a mediator and to provide complete coverage of case law from international courts and tribunals. c. Book excerpt: The observation that mater semper certa est remains accurate under most legal systems in the world. Maternity is defined as the personal status (filiation) of a woman who gave birth to a child. It is typically complemented by the fatherhood of the man from whom the child biologically originates (often quem nuptiae demonstrant). However, in some states, a kind of competitive way of acquiring the legal status of mother and father (or “homosexual parents A and B”) has been introduced via concluding a contract with a surrogate mother. Usually with a woman coming from poorer societies and with the assistance of professional intermediaries and organizers. The postulates to change substantive family law, or at least to recognize the effects of foreign law and procedures (a kind of “procreative tourism”), appear nowadays also in states generally prohibiting surrogate motherhood. The issues discussed in this volume concern both national law and international court cases. Recent examples include the opinion of the European Court of Human Rights of 10 April 2019 initiated by the French Cour de cassation, the judgement of the German Bundesgerichtshofof 20 March 2019, and dilemmas of Polish administrative courts. Focusing on the international perspective, the present volume as well as an accompanying book in Polish are the results of the international cooperation of over 30 experts from both member states and observer states of the Council of Europe. The monograph is structured “from the general to the detail” and includes a comprehensive view as well: from the issues of philosophy and sociology of law, to human rights standards of national constitutions and international agreements, to principles of ordre public of forum and their protection with measures of private, public, and penal law. This allows readers, including legislators and judges, the better understanding of the fundamental legal problems that surrogate motherhood brings, both in states where law creates them in a narrower or wider extent, and in other countries of the world, to which these problems can be imported with the movement of people and with de lege lata and de lege ferenda postulates.

Book excerpt: The COVID-19 pandemic has made evident that the field of global health – its practices, norms, and failures – has the power to shape the lives of billions. Global health perspectives on the role of religion, however, are strikingly limited. Uncovering the points where religion and global health have connected across the twentieth century, focusing on Ghana, provides an opportunity to challenge narrow approaches. In Religion in Global Health and Development Benjamin Walker shows that the religious features of colonial state architecture were still operating by the turn of the twenty-first century. Walker surveys the establishment of colonial development projects in the twentieth century, with a focus on the period between 1940 and 1990. Crossing the colonial-postcolonial divide, analyzing local contexts in conjunction with the many layers of international organizations, and identifying surprisingly neglected streams of personnel and funding (particularly from Dutch and West German Catholics), this in-depth history offers new ways of conceptualizing global health. Patchworks of international humanitarian intervention, fragmented government services, local communities, and the actions of many foreign powers combined to create health services and the state in Ghana.
