Dwight Golann's award-winning book, Mediating Legal Disputes, explained how commercial mediators settle cases. In Sharing a Mediator's Powers, he explains how advocates can harness these techniques to maximize their effectiveness in bargaining. Using examples from actual mediations, Golann offers specific suggestions about how to use mediators, and the process, to best effect. You will learn how to: get key players to the table, obtain access to evidence not provided in discovery, arrange a mediation format that matches your strategy, focus discussion on issues that help your case, probe the other side's state of mind, support cooperative, creative or competitive bargaining strategies, manage how a mediator evaluates a legal case, influence when and how impasse-breaking tactics are applied. The theme of this book? Don't approach the mediation process passively. Instead, use it in an active way to achieve your bargaining goals. Included with this book is a DVD that brings advocacy concepts alive. 24 excerpts show how to apply key techniques in the context of a commercial case"--Unedited summary from book.

Book Synopsis Beyond Winning by : Robert H. Mnookin
Download or read book Beyond Winning written by Robert H. Mnookin and published by Harvard University Press. This book was released on 2004-04-15 with total page 369 pages. Available in PDF, EPUB and Kindle. Book excerpt: Conflict is inevitable, in both deals and disputes. Yet when clients call in the lawyers to haggle over who gets how much of the pie, traditional hard-bargaining tactics can lead to ruin. Too often, deals blow up, cases don’t settle, relationships fall apart, justice is delayed. Beyond Winning charts a way out of our current crisis of confidence in the legal system. It offers a fresh look at negotiation, aimed at helping lawyers turn disputes into deals, and deals into better deals, through practical, tough-minded problem-solving techniques. In this step-by-step guide to conflict resolution, the authors describe the many obstacles that can derail a legal negotiation, both behind the bargaining table with one’s own client and across the table with the other side. They offer clear, candid advice about ways lawyers can search for beneficial trades, enlarge the scope of interests, improve communication, minimize transaction costs, and leave both sides better off than before. But lawyers cannot do the job alone. People who hire lawyers must help change the game from conflict to collaboration. The entrepreneur structuring a joint venture, the plaintiff embroiled in a civil suit, the CEO negotiating an employment contract, the real estate developer concerned with environmental hazards, the parent considering a custody battle—clients who understand the pressures and incentives a lawyer faces can work more effectively within the legal system to promote their own best interests. Attorneys exhausted by the trench warfare of cases that drag on for years will find here a positive, proven approach to revitalizing their profession.

Available in PDF, EPUB and Kindle. Book excerpt: Shield Construction Techniques in Tunnelling presents the latest on this fast, environmentally-friendly and relatively safe construction technique, reflecting on its technical risks and challenges as seen in China. Sections introduce the type of shields, the history of the technique, shielding principles, selection, management, the latest techniques in operation, consider engineering cases, discuss construction in gravel, soft-soil, composite, and rock strata, and present video clips of construction that are accessible through QR codes embedded in the text. The book combines theory and practical experience, giving the reader unique insights into shield equipment and construction techniques. The shield tunneling technique is being used very widely, particularly in China, which is building urban-rail transit systems at an unparalleled scale and speed. The use of tunneling-shields provides a fast, relatively-safe, and ecologically-friendly method for the construction of tunnels. However, a number of incidents have shown the risks involved in tunnelling through geologically complex areas. - Gives the principles and practice of shield construction techniques, including shield selection and operation - Demonstrates the latest technologies in shield construction that can be applied in practice - Reflects on the technical risks and challenges of shield construction, based on extensive use of the technique for tunnel construction in China - Discusses challenges in construction in gravel, soft-soil, composite and rock strata - Provides engineers with applicable insights into shield equipment and construction techniques
Book Synopsis Strategic Hamlets in South Vietnam by : Milton E. Osborne
Download or read book Strategic Hamlets in South Vietnam written by Milton E. Osborne and published by Cornell University Press. This book was released on 2018-05-31 with total page 88 pages. Available in PDF, EPUB and Kindle. Book excerpt: The strategic hamlet program in South Vietnam deserves careful consideration in light of the fact that war had been the central fact of many Vietnamese lives for many years. This paper delineates both the development of the program and studies the effect that the seemingly similar Communist insurrection in Malaysia (known as the Malayan Emergency) had upon American dealings with the insurgency in South Vietnam. Osborne, in one fascinating and revealing chapter, presents the commentary of both the Allied and North Vietnamese officials upon the successes and failures, real or perceived, of this program. An illuminating, focused, and important work.

Book Synopsis Advanced Theoretical and Computational Methods for Complex Materials and Structures by : Francesco Tornabene
Download or read book Advanced Theoretical and Computational Methods for Complex Materials and Structures written by Francesco Tornabene and published by MDPI. This book was released on 2021-08-30 with total page 180 pages. Available in PDF, EPUB and Kindle. Book excerpt: The broad use of composite materials and shell structural members with complex geometries in technologies related to various branches of engineering has gained increased attention from scientists and engineers for the development of even more refined approaches and investigation of their mechanical behavior. It is well known that composite materials are able to provide higher values of strength stiffness, and thermal properties, together with conferring reduced weight, which can affect the mechanical behavior of beams, plates, and shells, in terms of static response, vibrations, and buckling loads. At the same time, enhanced structures made of composite materials can feature internal length scales and non-local behaviors, with great sensitivity to different staking sequences, ply orientations, agglomeration of nanoparticles, volume fractions of constituents, and porosity levels, among others. In addition to fiber-reinforced composites and laminates, increased attention has been paid in literature to the study of innovative components such as functionally graded materials (FGMs), carbon nanotubes (CNTs), graphene nanoplatelets, and smart constituents. Some examples of smart applications involve large stroke smart actuators, piezoelectric sensors, shape memory alloys, magnetostrictive and electrostrictive materials, as well as auxetic components and angle-tow laminates. These constituents can be included in the lamination schemes of smart structures to control and monitor the vibrational behavior or the static deflection of several composites. The development of advanced theoretical and computational models for composite materials and structures is a subject of active research and this is explored here for different complex systems, including their static, dynamic, and buckling responses; fracture mechanics at different scales; the adhesion, cohesion, and delamination of materials and interfaces.
