Book excerpt: The US Department of Energy (DOE) is considering ways to encourage states to adopt energy efficiency standards for residential and commercial buildings in the private sector. Such standards are now mandatory for federal buildings, and for private buildings in 34 states; in the remaining 16 states, the standards serve as guidelines for voluntary compliance. In this study for DOE, Pacific Northwest Laboratory (PNL) assessed the process by which energy codes for commercial buildings were adopted and implemented in Arizona and New Mexico. Information was gathered primarily through a series of interviews with state officials, city building officials, architects and engineers, builders, and staff from utilities in the two states. Until other state processes are studied, the extent of the similarities and dissimilarities to the situation in New Mexico and Arizona are unknown. A more extensive study may show that at least some elements of the two state's experience have been paralleled in other parts of the country. General strategies to encourage the adoption of energy codes, assist implementation, and support enforcement were developed based on the research from Arizona and New Mexico and are presented in this report. 6 refs., 4 figs.

The development of these standards occurs primarily at the national level, while adoption and implementation occurs at the state and local levels of government. Many assume that the mere adoption of a standard ensures that compliance is achieved and energy conserving buildings automatically result from the process. This assumption accounts for the myth that all buildings are constructed in compliance with the adopted standard and in reality many are not. There are many different processes by which standards are adopted and actually implemented, and they directly affect how close reality is to the myth. The paper presents the different processes used throughout the US to adopt and implement building energy standards for new commercial buildings, reviews available studies on compliance, discusses the reasons for reduced compliance, and suggests programs to improve today's realities.

Book excerpt: The Energy Policy Act (EPAct), passed by Congress in 1992, requires states to adopt building energy codes for new commercial buildings that meet or exceed the American Society of Heating, Refrigerating, and Air Conditioning Engineers (ASHRAE) and Illuminating Engineers Society of North America (IES) Standard 90.1-1989 by October 24, 1994. In response to EPAct many states will be adopting a state-wide energy code for the first time. Understanding the role of stakeholders in the building design process is key to the successful implementation of these codes. In 1993, the Pacific Northwest Laboratory (PNL) conducted a survey of architects and designers to determine how much they know about energy codes, to what extent energy-efficiency concerns influence the design process, and how they convey information about energy-efficient designs and products to their clients. Findings of the PNL survey, together with related information from a survey by the American Institute of Architects (AIA) and other reports, are presented in this report. This information may be helpful for state and utility energy program managers and others who will be involved in promoting the adoption and implementation of state energy codes that meet the requirements of EPAct.

Since 2004, covering the last four cycles of Standard 90.1 updates, about 30% of all new requirements have been related to building controls. These requirements can be difficult to implement and verification is beyond the expertise of most building code officials, yet the assumption in studies that measure the savings from energy codes is that they are implemented and working correctly. The objective of the current research is to evaluate the degree to which high impact controls requirements included in commercial energy codes are properly designed, commissioned and implemented in new buildings. This study also evaluates the degree to which these control requirements are realizing their savings potential.

Book excerpt: The U.S. Department of Energy's (DOE's) Building Energy Codes Program (BECP) has been asked by some states and energy code stakeholders to address the comparability of the 2009 International Energy Conservation CodeĀ® (IECC) as applied to commercial buildings and ANSI/ASHRAE/IESNA Standard 90.1-2007 (hereinafter referred to as Standard 90.1-07). An assessment of comparability will help states respond to and implement conditions specified in the State Energy Program (SEP) Formula Grants American Recovery and Reinvestment Act Funding Opportunity, Number DE-FOA-0000052, and eliminate the need for the states individually or collectively to perform comparative studies of the 2009 IECC and Standard 90.1-07. The funding opportunity announcement contains the following conditions: (2) The State, or the applicable units of local government that have authority to adopt building codes, will implement the following: (A) A residential building energy code (or codes) that meets or exceeds the most recent International Energy Conservation Code, or achieves equivalent or greater energy savings. (B) A commercial building energy code (or codes) throughout the State that meets or exceeds the ANSI/ASHRAE/IESNA Standard 90.1-2007, or achieves equivalent or greater energy savings . (C) A plan to achieve 90 percent compliance with the above energy codes within eight years. This plan will include active training and enforcement programs and annual measurement of the rate of compliance. With respect to item (B) above, many more states, regardless of the edition date, directly adopt the IECC than Standard 90.1-07. This is predominately because the IECC is a model code and part of a coordinated set of model building codes that state and local government have historically adopted to regulate building design and construction. This report compares the 2009 IECC to Standard 90.1-07 with the intent of helping states address whether the adoption and application of the 2009 IECC for commercial buildings can be considered equivalent to the adoption and application of Standard 90.1-07. Based on this document, states adopting the 2009 IECC, which is the document cited in (A), above, for residential construction, can also determine if they are in compliance with the above provisions for commercial buildings in (B) above and if their code meets or exceeds the ANSI/ASHRAE/IESNA Standard 90.1-07.

Book excerpt: In light of the pressing impacts of climate change and rising demand for electricity, many state governments have adopted International Energy Conservation Codes (IECC) and the Energy Standard for Buildings Except Low-Rise Residential Buildings (ASHRAE 90.1) for new commercial buildings. This paper investigates the relationship between commercial building energy codes and electricity consumption on the state level. Using state-level data on commercial building code adoption and electricity use from 2004 to 2015 in OLS and fixed-effects models, I found a negative relationship between building energy code adoption and electricity consumption. States adopting the building energy codes between 2004 and 2015 are associated with a 1,968.974 million kilowatthours less electricity consumption in the commercial sector, enough to power about 18,300 households per year. However, using a fixed-effects model with a one-year lagged effect, I found a positive relationship between building code adoption and electricity consumption. In this model specification, states adopting building energy codes in the previous year are associated with a 606.918 million kilowatthours increase in annual average electricity consumption in the commercial sector, which indicates the importance of compliance with codes. The inconsistent results indicate a need for future study, which could include additional data, such as compliance with codes, number of new commercial buildings, and building activities.

This effort helps to ensure that building standards incorporate the latest research results to achieve maximum energy savings in new buildings, yet remain responsive to the needs of the affected professions, organizations, and jurisdictions. This report documents findings from an analysis conducted by PNL of the State's building codes to determine if the codes meet or exceed the 1992 MEC energy efficiency requirements (CABO 1992a).

This report presents the findings of a formal evaluation of this program. The evaluation framework used in this study is called a Market Progress Evaluation Report (MPER). This MPER was designed to evaluate the program's progress in achieving its goals and provide recommendations to improve program performance moving forward. The focus of this MPER was on codes efforts undertaken since 2011 in NEEA's region (in the states of Washington, Oregon, Idaho and Montana). Key research objectives of the MPER were to conduct reviews of: the program logic model; cost effectiveness assumptions used to estimate program influence; program progress achieved; and effectiveness of processes implemented. The evaluation found that NEEA's codes program has made a significant contribution to the Northwest region through its support of energy code development and adoption, implementation, and compliance. The report's recommendations for improvement include improved training assessment and timing.
