Available in PDF, EPUB and Kindle. Book excerpt: In 1997, Congress enacted the Adoption and Safe Families Act (ASFA) in an attempt to reform the nation's troubled public child welfare systems. In passing ASFA, Congress emphasized two primary themes. First, Congress made clear that the paramount goal for public child welfare systems is to secure the health and safety of the children who enter these systems. Second, Congress recommitted public child welfare systems to the goal of securing timely permanent placement outcomes for children. An appreciation of ASFA's historical context is necessary to gain an understanding of its actual goals and its consistent design. Consideration of the historical context is also necessary in order to assess the likelihood of ASFA's success. As became apparent under Adoption Assistance and Child Welfare Act of 1980 (AACWA), the breach can be quite wide between legislative design and actual implementation in the trenches of public child welfare systems. Because of the need to consider ASFA's historical context, Part II of this article assesses the implementation of AACWA. Part III examines ASFA in light of the AACWA experience and assesses the likelihood of, and the role of legal professionals in, the effective implementation of ASFA. Part IV considers the possibility of additional congressional action.

Available in PDF, EPUB and Kindle. Book excerpt: This volume asks what legal and socio legal scholarship can contribute to understanding the role of law in the care and development of children. The editors have selected key articles ranging from theoretical analysis to empirical data based research that address the law's approach in the United States and the United Kingdom to resolving parenting disputes after separation, protecting children from abuse and neglect, and affording children procedural protections in the juvenile justice system. Their introduction to these important and often distressing areas of the law confirms the importance of understanding how law works in practice, and reaffirms that law itself remains responsible for articulating and protecting society's values.

Available in PDF, EPUB and Kindle. Book excerpt: Everyday Law for Children provides an accessible introduction to laws that affect children and families and the dominant public debates that surround and drive these laws. Using real-world examples, the book exposes the tension between reliance on the private, autonomous family and the public's desire to secure child well-being. A look at some public systems, such as child welfare and juvenile delinquency, shows that an initial public aspiration to assist children and families is often frustrated by a lack of resolve and resources. In other areas, such as education and healthcare, the public shrinks from a commitment to comprehensive child well-being. Everyday Law for Children makes a case for the improvement of public systems by focusing on pragmatic goals related to child well-being. More immediately, it makes a case for zealous advocates for children who can have a dramatic impact on children's everyday lives. Accordingly, the book provides an annotated list of resources and contact information for parents and for service providers who need help addressing specific problems within complex public systems.

It is filled with research findings and addresses clinical issues as well. Many children are affected by a parent in the criminal justice system, and this book is sorely needed. The editors and contributors have produced a wonderful resource." Score: 94, 4 stars --Doody's This book serves as a comprehensive source for understanding and intervening with children of incarcerated parents. The text examines the daunting clinical implications inherent in trauma throughout development, as well as social and political roles in ameliorating intergenerational delinquency. It conceptualizes the problem by using an ecological framework that is focused on the experience of the child. Children of Incarcerated Parents addresses developmental and clinical issues experienced throughout the trajectory of childhood and adolescence with a focus on interventions and social policies to improve outcomes for this under-studied group. The chapters explore individual, community, and national levels of policy, programming, and legislation.

Available in PDF, EPUB and Kindle. Book excerpt: ASFA attempted to create safer environments for maltreated children by moving them through the foster care system as rapidly as possible and incentivizing adoptions when reunification with family was deemed not appropriate. This study utilized a qualitative design, reviewing data from primary and secondary sources that address this legislation. The outcomes, unintended consequences, and implications of ASFA were discussed to assess whether this policy met its goals and the present challenges of the child welfare system.
