Largely overlooked is the fact that between 1951 and 1972 there was a group of European Commission (and before that the High Authority) officials who wished to build a Civil Europe to sit alongside an economic and political Europe. This Civil Europe was, it was hoped, to become home to a European citizenry equipped with a European civil consciousness that complemented their national and local loyalties. To this end these officials pioneered a series of civil initiatives designed to begin the process of building Civil Europe. This book analyses three such civil initiatives: the building of the first European School, the European Community’s participation in Expo 58 and the production of the European Community’s own documentaries. From the start Europe was designed and conceived of in terms of a European general civil public and not solely in terms dictated by economic and political interests.

Book excerpt: Given the impact that successive court rulings have had on the organisation of the sports movement in the past 15 years, the autonomy of non-governmental sports organisations has become a highly topical concern in Europe. It is also closely related to the issue of governance, the subject of previous Council of Europe studies. The Enlarged Partial Agreement on Sport (EPAS) decided to explore the concept of autonomy in greater depth by studying the conceptual, political, legal, economic and psycho-sociological aspects of the subject. This study was carried out at the request of the EPAS by the Swiss Graduate School of Public Administration (IDHEAP) on the basis of a questionnaire sent to public authorities in charge of sport and to national and international umbrella sports organisations. In addition to an analysis of the data obtained, documents produced by public authorities and sports organisations on this emerging issue are presented. This study contributes to a better understanding of the concept of autonomy and offers a clear picture of the issues involved.

The first section of the book deals with the "constitutional" law of the Council of Europe, or its internal statutes in the broad sense. The second section concerns the role played by the Council of Europe - which has always been very active in standard-setting - in the harmonisation of European states¿ domestic law. Book excerpt: In Integrating Europe: Informal Politics and Institutional Change the author explains why the European Union (EU) member states actively surrender policy-making power to supranational authorities in unconventional ways. In light of the general antipathy toward giving up national sovereignty in European societies—even where "pro-European" sentiment thrives, why do national governments allow the creation of any new EU laws or policies whose effects they cannot keep under their general control? Why do EU member states allow any sovereignty transfer to occur outside of inter-governmental treaties, which are the only legitimate EU bargains found in the EU's formal sphere? Deploying the tools of rational choice institutionalist theory, the author argues that informal bargains struck between the EU's primary organizational actors - the European Council, European Commission, and European Parliament - have paradoxically resulted in increased integration. As the EU is an ideal laboratory for testing different institutionalist hypotheses for explaining institutional change, the author focuses on the ongoing competition to alter the EU rules that allocate power, and, with an approach that allows for feedback loops among agents and structures, makes an argument that flies in the face of realist and intergovernmentalist theories. While some have shed light on the importance of informal dynamics in the legal sphere of the EU, this book does the same for the policy-making sphere.
