Available in PDF, EPUB and Kindle. Book excerpt: This timely book assesses national and supranational bilateral approaches to dealing with the rising tide of migration into the European Union via the Mediterranean Sea. International law and EU migration law specialists critically assess the legal tools adopted to engage with the ‘refugee crisis’. While the EU works to develop a unified approach to Mediterranean transit and origin countries, the authors argue that a crucial role should be accorded to individual states in finding a solution to this complex and sensitive situation.

Download or read book Bridges and Barriers written by Filippos Pierros and published by Routledge. This book was released on 2019-06-03 with total page 200 pages. Available in PDF, EPUB and Kindle. Book excerpt: Originally published in 1999, Bridges and Barriers is a detailed study of the European Union’s Mediterranean Policy from the initial agreements in the 1960s to the recent Euro-Mediterranean Partnership . The scope of this analysis includes the Maghreb and Mashreq countries in addition to Turkey, Malta, Israel, the Occupied Territories and Cyprus. The authors argue that the limited success of trade and development policy in this region resulted from endogenous and exogenous factors: examples of the former include the lack of the political will necessary to implement trade, aid and reform policies, while the latter include the energy crisis of the 1970s, the Arab-Israeli conflict and the Cold War.

Book Synopsis The External Dimension of the EU’s Migration Policy by : Katharina Eisele
Download or read book The External Dimension of the EU’s Migration Policy written by Katharina Eisele and published by Martinus Nijhoff Publishers. This book was released on 2014-05-08 with total page 556 pages. Available in PDF, EPUB and Kindle. Book excerpt: In recent years the EU has been active in developing a common European immigration policy in cooperation with third countries and in building an “external dimension” of such an EU policy. The linkages between the EU’s external relations and migration policies have influenced the distinct legal positions of third-country nationals (non-EU nationals). This book critically discusses whether the EU’s objective of creating a common EU migration policy can be achieved against the backdrop of a highly fragmented EU framework for migration law and policy, and it argues that it is difficult to speak of one single, unitary group of third-country nationals forming the counterpart to EU citizens.
Book Synopsis The EC Common Fisheries Policy by : Robin Churchill
Download or read book The EC Common Fisheries Policy written by Robin Churchill and published by Oxford University Press. This book was released on 2010-03-04 with total page pages. Available in PDF, EPUB and Kindle. Book excerpt: The Common Fisheries Policy (CFP) is one of the longest established and more controversial of the common policies of the EC. It deals principally with the management of fishery resources, relations between the EC and third States in fisheries matters, the marketing of and trade in fishery products, financial assistance to the fisheries sector, and aquaculture. However, the CFP is not just a matter for those with an economic interest in fisheries. It also raises many issues of more general concern, such as the capacity of the EC and its Member States to manage important natural resources sustainably, the impact of fishing on the wider marine environment, and relations between developed and developing States. This book addresses the CFP from a legal perspective. It provides a detailed account of the very large body of EC law comprising the CFP, and draws on the European Commission's associated documents to aid interpretation and add context. As a result, the book will be of value to anyone wanting knowledge of the law of the CFP. Although not addressing the Commission's 2009 Green Paper on reform of the CFP, the book should provide a useful reference point against which to view the reform of parts of the CFP that is anticipated to take place over the next few years.
Book Synopsis Mixed Agreements as a Technique for Organizing the International Relations of the European Community and its Member States by : Joni Heliskoski
Download or read book Mixed Agreements as a Technique for Organizing the International Relations of the European Community and its Member States written by Joni Heliskoski and published by BRILL. This book was released on 2021-08-30 with total page 345 pages. Available in PDF, EPUB and Kindle. Book excerpt: This volume provides the most comprehensive account to date of the foundations, evolution, and nature of the treaty-making practice, known as the practice of mixed agreements, whereby the European Community and its Member States enter into international agreements with one or more other subjects of international law. Covering policy areas from external economic relations to the environment, from development cooperation to the law of the sea, the practice of mixed agreements occupies a highly prominent position in the external relations of the EU. Rather than focusing upon any particular agreement or subject area, the book seeks to identify, through analysis of the respective interests of the Community, the Member States and other parties, as they are reflected in actual practice, the general parameters for the conclusion and application of mixed agreements. The basic thesis defended is that there are mediating strategies whereby mixed agreements can be turned into an effective technique for manifesting the Community's position in external relations whilst nevertheless safeguarding the vital interests of the Member States and the other, non-EC parties. Rather than a `necessary evil', mixed agreements should be regarded as a natural way of organizing the international relations of the EC and its Member States. Of individual treaties, the most thorough examination is made of the Community and the Member States' participation in the Law of the Sea Convention, the Food and Agriculture Organization of the UN (FAO), as well as the Agreement establishing the World Trade Organization (WTO). As regards the WTO, for instance, the book offers a comprehensive account of the dispute settlement practice under the GATS and TRIPS Agreements.

Book Synopsis Improving International Investment Agreements by : Armand De Mestral
Download or read book Improving International Investment Agreements written by Armand De Mestral and published by Routledge. This book was released on 2013-02-11 with total page 441 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book presents the reflections of a group of researchers interested in assessing whether the law governing the promotion and protection of foreign investment reflects sound public policy. Whether it is the lack of "checks and balances" on investor rights or more broadly the lack of balance between public rights and private interests, the time is ripe for an in-depth discussions of current challenges facing the international investment law regime. Through a survey of the evolution in IIA treaty-making and an evaluation from different perspectives, the authors take stock of developments in international investment law and analyze potential solutions to some of the criticisms that plague IIAs. The book takes a multidisciplinary approach to the subject, with expert analysis from legal, political and economic scholars. The first part of the book traces the evolution of IIA treaty-making whilst the other three parts are organised around the concepts of efficiency, legitimacy and sustainability. Each contributor analyzes one or more issues related to substance, treaty negotiation, or dispute resolution, with the ultimate aim of improving IIA treaty-making in these respects. Improving International Investment Agreements will be of particular interest to students and academics in the fields of International Investment Law, International Trade Law, Business and Economics.

Book Synopsis The Neighbours of the European Union's Neighbours by : Sieglinde Gstöhl
Download or read book The Neighbours of the European Union's Neighbours written by Sieglinde Gstöhl and published by Routledge. This book was released on 2016-02-24 with total page 352 pages. Available in PDF, EPUB and Kindle. Book excerpt: Should the European Neighbourhood Policy stop at the borders of the European Union’s immediate neighbouring countries? This book is the first full length study of the ’neighbours of the EU’s neighbours’, a concept originally introduced by the European Commission with reference to Saharan Africa, the Middle East and Central Asia. These regions in the EU’s broader neighbourhood are often perceived as an ’arc of crisis’ from which manifold challenges emanate for Europe. This timely book takes stock of the state of the EU’s cooperation with the neighbours of its neighbours and explores how the concept might help promote security, stability and prosperity beyond the countries which are formally part of the European Neighbourhood Policy. How can the EU create bridges between these regions? What instruments does the EU have at its disposal and how can it link them in order to respond to the challenges and overcome the current fragmentation? One of the conclusions is the suggestion to consider a pragmatic ’EU Strategy for the Neighbours of its Neighbours’ which addresses the needs of the broader EU neighbourhood in a more systematic and consistent manner and helps transform in the long run the ’arc of crisis’ into another ’ring of friends’.
