Book excerpt: This study maps the evolution of institutional change in Canada's public sector from the early 1980s, beginning with the Nielsen Task Force in 1984, through to Public Service 2000 in 1989, the 1994 and 1996 Program Review exercises and the federal government's ongoing renewal initiative. It then examines the transformation and creation of several federal institutions, including the Canadian Tourism Commission and the Canada Business Service Centres, as well as the government's plans for a new parks agency and a revenue and customs agency. It also reviews federal provincial negotiations in social housing, in immigrant settlement services and in regard to the federal Contraventions Act, as well as the transfer of health services to the Yukon government. To complete the picture, the study considers the evolving relationship between central agencies and other federal institutions in the management of the official languages program and the present state of institutional two-language capability in the federal Public Service.

Book excerpt: Now in its 14th year, the NILOS Documentary Yearbook provides the reader with an excellent collection of documents related to ocean affairs and the law of the sea, issued each year by organizations, organs and bodies of the United Nations system. Documents of the UN General Assembly, Meeting of State Parties to the 1982 UN Law of the Sea Convention, CLCS, ISBA, ITLOS, Follow-Up to the UN Straddling Fish Stocks and Small Island States Conferences, Panama Canal, ECOSOC, UNEP and UNCTAD are included first, followed by the documents of FAO, IAEA, IMO, UNESCO/IOC. As in the previous volumes, documents which were issued in the course of 1998 are reproduced, while other relevant documents are listed. The NILOS Documentary Yearbook has proved to be of invaluable assistance in facilitating access by the community of scholars and practitioners in ocean affairs and the law of the sea to essential documentation. The entry of the 1992 UN Law of the Sea Convention into force on 16th November 1994 and of the Part XI Agreement on 28 July, 1996, and progress in the implementation of Chapter 17 of Agenda 21, make continuation of this assistance of particular significance in the years to come. Volume 14 contains Special Report by Editor-in-Chief Barbara Kwiatkowska on The Law-of-the-Sea-Related Cases in the International Court of Justice During the Presidency of Judge Stephen M. Schwebel (1997-2000). It explores the unique role of the ICJ as the principal judicial organ of the United Nations in the development of ocean affairs and the law of the sea, in the context of an ongoing follow-up to the Overall Review and Appraisal of the UNCED Agenda 21. The members of the Yearbook's Advisory Board are: Judges Abdul Koroma and Shigeru Oda of the ICJ, Judges Thomas Mensah, Dolliver Nelson and Tullio Treves of the ITLOS, as well as Rosalie Balkin, Edward Brown, Lee Kimball, Bernard Oxman and Shabtai Rosenne.

Available in PDF, EPUB and Kindle. Book excerpt: Language policies are political. They have political consequences as well as political origins. In State Traditions and Language Regimes, scholars from Asia, Europe, and North America shift focus from the consequences of language policies to how and why states make language policy choices. This shift, theorized through the concept of "language regime," inserts an urgently needed political science perspective into the current dialogue between sociolinguists, who research the societal effects of language policies, and political theorists of language rights, who analyze the normative implications of policies. New analytical tools drawn from comparative politics are showcased to analyze paths taken by different states in establishing language regimes, at times disrupted and redirected at critical junctures. Contributions to the volume include analyses of Canada's increasingly court-driven language policies, the United States’ bifurcated language regime in the aftermath of 9/11, Ireland’s conflicted protection of the Irish language, France's linguistic Jacobin tradition disrupted by Europeanization, the role of political parties and coalitions in language regime stability and change in Taiwan and Southeast Asia, Poland's war-torn history informing policy toward regional languages, and the role of English in international peace-building. While other books look at the political and societal effects of language policy, none seeks to employ a historical institutionalism approach which sets language policy choice in the context of power relations embedded in state traditions. State Traditions and Language Regimes offers a comparative politics perspective, one that enriches interdisciplinary debate on language policy.

Available in PDF, EPUB and Kindle. Book excerpt: Derived from the renowned multi-volume International Encyclopaedia of Laws, this practical analysis of sports law in Slovenia deals with the regulation of sports activity by both public authorities and private sports organizations. The growing internationalization of sports inevitably increases the weight of global regulation, yet each country maintains its own distinct regime of sports law and its own national and local sports organizations. Sports law at a national or organizational level thus gains a growing relevance in comparative law. The book describes and discusses both state-created rules and autonomous self-regulation regarding the variety of economic, social, commercial, cultural, and political aspects of sports activities. Self- regulation manifests itself in the form of by-laws, and encompasses organizational provisions, disciplinary rules, and rules of play. However, the trend towards more professionalism in sports and the growing economic, social and cultural relevance of sports have prompted an increasing reliance on legal rules adopted by public authorities. This form of regulation appears in a variety of legal areas, including criminal law, labour law, commercial law, tax law, competition law, and tort law, and may vary following a particular type or sector of sport. It is in this dual and overlapping context that such much-publicized aspects as doping, sponsoring and media, and responsibility for injuries are legally measured. This monograph fills a gap in the legal literature by giving academics, practitioners, sports organizations, and policy makers access to sports law at this specific level. Lawyers representing parties with interests in Slovenia will welcome this very useful guide, and academics and researchers will appreciate its value in the study of comparative sports law.

It’s about how children’s voices are liberated through the arts, and how children make and communicate meaning through still and moving images, sounds, textures, gestures and the use of many other signs. It is also about how teachers, parents, peers and the community influence children’s early development, and how quality arts education in early childhood is an essential component of lifelong learning. The authors are teachers and researchers who are respected for their contributions to early childhood arts education. All of them have addressed their topics via practical examples, which are embedded in current philosophies and theories, often stemming from original research and firsthand interactions with children.

Available in PDF, EPUB and Kindle. Book excerpt: Legal issues encroach into almost every aspect of modern day education in Ireland. Education and the Law has been completely updated since the last edition published in 2012. It examines in detail recent key legislation including the Education (Admissions to School) Act 2018 and the Data Protection Act 2018. It has also been restructured for ease of use and reference. An essential title, it examines the legal issues surrounding teaching and education, such as the employment of teachers, school discipline, bullying, freedom of information, and the State's responsibility for educating children with special educational needs. Membership of the European Union has also resulted in many changes arising from the principles of free movement, non-discrimination and the common vocational training policy. These developments, as well as the key legislation (including the Education Act 1998, the Education (Welfare) Act 2000, the Education for Persons with Special Educational Needs Act 2004 and the Disability Act 2005) are examined in detail. Education and the Law also takes an historical look at the legal aspects of the education system in Ireland, and it traces the distinctive development of the Irish education system but it also looks at the future direction of education in Ireland and at the likely impact of equality law, human rights law and membership of the enlarged European Community on Ireland's largely denominational education system. Elizabeth-Ann Kirwan contributed to this edition. Elizabeth-Ann is a practising barrister. She is a member of the Bar of Ireland and holds a Barrister-at-Law Degree from the Honorable Society of the King's Inns. She is an experienced educator: a qualified teacher, with a wide teaching experience at school, third level, and continuing professional education. She is also experienced in industrial relations matters, advising and representing employees and employers in employment and professional statutory procedures.
