Available in PDF, EPUB and Kindle. Book excerpt: In this book, author Hayat Alvi’s purpose and focus are to illustrate the legal basis for Islamic nonviolent activism, as Maulana Abul Kalam Azad promoted and exemplified. Maulana Azad’s endorsement of nonviolent civil disobedience as a means to expel British colonial rule from India poses a strong counterargument against Islamist extremism, and a legal precedent for nonviolent activism in Islam. Millions of Indian Muslims participated under Maulana Azad and Mahatma Gandhi’s leadership in nonviolent civil disobedience against the British Raj. These facts indicate that there is such a thing as nonviolent activism in Islam. Abul Kalam Azad introduced “nonviolent Jihad” in the form of civil disobedience. As a legitimate religious authority, trained as an Islamic jurist and scholar, he endorsed Mahatma Gandhi’s nonviolent civil disobedience and activism to free India from British colonial rule. A highly respected Islamic scholar and jurist, Maulana Azad’s endorsement of nonviolent civil disobedience provides the legal precedent for nonviolent activism in Islam. Contemporary Muslim leaders and activists can learn lessons from Maulana Azad’s example, and as Alvi’s thoroughly researched book shows, can be an argument against blind dogma, extremism, and militancy in the modern era.

Available in PDF, EPUB and Kindle. Book excerpt: Maulana Abul Kalam Azad (1888-1958), has largely remained less explored as a political leader in the history of Indias struggle for independence. Two reasons seem quite plausible for this; one, historians have ignored the claims and contributions of those, generally described as nationalist Muslims in view of Indias Partition as they focused more on the politics and claims of the Muslim League; the second would be lack of knowledge of Urdu, in which, Azad has left behind a considerable corpus of evidence. The combination of the two has resulted in near silence of historians on political life of Azad, honourable exceptions notwithstanding. Such neglect and ignorance about the man and his times has left a void in our knowledge not only about Maulana Azad but the entire range of Muslim political opinion aligned with the cause of Indian nationalism and freedom movement. This volume provides a much needed and timely corrective. With the help of extensive but hitherto unexplored primary sources the author has been able to argue that Azads politics was continuously evolving while he remained steadfast towards composite Indian nationalism and resistant to communal politics. This volume is invaluable for scholars of Indian nationalism and Modern Indian History.

Available in PDF, EPUB and Kindle. Book excerpt: This book examines a selection of themes that have become salient in contemporary debates on constitutional democracies. It focuses in particular on the experiences of India and Germany as examples of post-war and post-colonial constitutional democracies whose trajectories illustrate democratic transitions and transformative constitutionalism. While transformative constitutionalism has come to be associated specifically with the post-apartheid experience in South Africa, this book uses the transformative as an analytical framework to transcend the dichotomy of west and east and explore how temporally coincident constitutions have sought to install constitutional democracies by breaking with the past. While the constitution-making processes in the two countries were specific to their political contexts, the constitutional promises and futures converged. In this context, the book explores the themes of Constitutionalism, Nationalism, Secularism, Sovereignty and Rule of Law, Freedoms and Rights, to investigate how the contestations over democratic transitions and democratic futures have unfolded in the two democracies. It offers readers valuable insights into how the normative frameworks of constitutional democracy take concrete form at specific sites of democratic and constitutional imagination in Dalit and Islamic writings, as well as the relationship between state and religion in the writings of public intellectuals, political and legal philosophers. The book also focuses on specific sites of contestation in democracies including the relationship between sovereignty and citizenship in post-colonial India, free speech and sedition in liberal democracies, questions of land rights in connection with economic and political changes in contemporary contexts, and the rights of indigenous communities with regard to international conventions and domestic law. Given its scope, it will be of interest to students and scholars of political theory, political philosophy, comparative constitutionalism, law and human rights.
