Book excerpt: Excerpt from A Treatise Law of Patents: For Useful Inventions, as Enacted and Administered in the United States of America The following work, the fruit of careful studies in a department of jurisprudence of great practical importance, is presented to the Profession, not without anxiety as to its reception. This branch of the law is so peculiar, the subjects with which it is concerned are so abstruse, and so much caution is requisite in dealing with its principles and in combining them into a system, that no writer can expect wholly to satisfy the wants of his readers, who does not bring to its treatment a force of intellect and a reputation as a jurist, which entitle him to be regarded in the light of an authority. But it cannot be my hope, as it is not my desire, to escape criticism. Looking upon the law as a science of vast practical consequence to mankind, and desiring to discharge my humble debt to its Profession, I shall gratefully receive, from any competent source, any suggestions of errors or imperfections in a work designed for practical use. Book Synopsis Working Knowledge by : Catherine L. Fisk
Download or read book Working Knowledge written by Catherine L. Fisk and published by Univ of North Carolina Press. This book was released on 2009-11-01 with total page 376 pages. Available in PDF, EPUB and Kindle. Book excerpt: Skilled workers of the early nineteenth century enjoyed a degree of professional independence because workplace knowledge and technical skill were their "property," or at least their attribute. In most sectors of today's economy, however, it is a foundational and widely accepted truth that businesses retain legal ownership of employee-generated intellectual property. In Working Knowledge, Catherine Fisk chronicles the legal and social transformations that led to the transfer of ownership of employee innovation from labor to management. This deeply contested development was won at the expense of workers' entrepreneurial independence and ultimately, Fisk argues, economic democracy. By reviewing judicial decisions and legal scholarship on all aspects of employee-generated intellectual property and combing the archives of major nineteenth-century intellectual property-producing companies--including DuPont, Rand McNally, and the American Tobacco Company--Fisk makes a highly technical area of law accessible to general readers while also addressing scholarly deficiencies in the histories of labor, intellectual property, and the business of technology.
Book Synopsis Intellectual Property and the Common Law by : Shyamkrishna Balganesh
Download or read book Intellectual Property and the Common Law written by Shyamkrishna Balganesh and published by Cambridge University Press. This book was released on 2013-09-02 with total page 577 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this volume, leading scholars of intellectual property and information policy examine what the common law - a method of reasoning, an approach to rule making, and a body of substantive law - can contribute to discussions about the scope, structure and function of intellectual property. The book presents an array of methodologies, substantive areas and normative positions, tying these concepts together by looking to the common law for guidance. Drawing on interdisciplinary ideas and principles that are embedded within the working of common law, it shows that the answers to many of modern intellectual property law's most puzzling questions may be found in the wisdom, versatility and adaptability of the common law. The book argues that despite the degree of interdisciplinary specialization in the field, intellectual property is fundamentally a creation of the law; therefore, the basic building blocks of the law can shed important light on what intellectual property can and should (and was perhaps meant to) be.
