Book excerpt: Copyright is meant to do something-several things-to accomplish socially desirable ends. One of those ends is to create a space for a free exchange of ideas that allows us to build upon a universe of expression that came before. How can I tell if something is in the public domain? This is the central question addressed daily by the Copyright Review Management System (CRMS) project. It is a special question and one essential to the social bargain that society has struck with authors and rights holders. It is also a deceptively simple question. There should be a straightforward answer, especially for books. It should be easy to know when something is-or is not-subject to copyright. And yet, in an age of absolute fluidity of media and medium, even plain old books can be highly complex embodiments of copyright. We need to make it easier to ascertain whether a work is in the public domain. If the rights of copyright holders are to be respected and valued as part of the social bargain, the public domain as a matter of copyright law should be ascertainable and enjoyed. Given this complexity, consider the determination of the copyright status of a given creative work as a design problem. How do we move the copyright status of works in the collections of our libraries, museums, and archives from confusion and uncertainty to clarity and opportunity? Working over a span of nearly eight years, the University of Michigan Library received three grants from the Institute of Museum and Library Services (IMLS) to generously fund CRMS, a cooperative effort by partner research libraries to identify books in the public domain in HathiTrust. The Toolkit is a resource that aims to allow others to understand and replicate the work done by CRMS.

Book excerpt: "Every American has a landed inheritance. It is the public domain--land owned and administered by the federal government and held in trust for the people of the United States, all of the people of the United States. Created in the years preceding and following the Revolutionary War and enlarged as America spread west from the Mississippi River to the Pacific Ocean, this national legacy at its greatest included more than two billion acres of land. Today [as of 1975], after two centuries of confusion, mismanagement, corruption, and abuse, 453 million acres still remain--an inheritance rich in wilderness values and natural resources--and still victimized by misunderstanding and neglect. For the first time in a single book, the whole story of the public domain is told in a narrative as timely as it is enlivened by history--from the land speculations of George Washington and his contemporaries to the real-estate boondoggles of today; from the pre-emption movement of the 1830s to the Taylor Grazing Act of 1934, from the 90 million acres given away to railroads in the 1860s and 1870s to the millions of acres now being maimed by dune buggies, trail bikes, and other off-road vehicles; from the cynical distortion of such well-intentioned land laws as the Homestead Act of 1862 to the curious grazing practices of modern stockmen; from nineteenth-century entrepreneurs, who mortgaged the public domain in the name of greed to twentieth-century engineers who would pockmark it with strip mines in the name of energy; from the creation of the national forest system in the 1890s to land-reform legislation under consideration by Congress in the spring of 1975. Written by historian and environmental writer T. H. Watkins, based on more than twenty years of research and investigation by conservationist Charles S. Watson, Jr., and illustrated with more than 70 pages of historical and modern photographs, [this book] places the past at the service of the present, and in the process illuminates a nearly unknown part of the American landscape. Above all, this book makes it clear that if we allow history to repeat itself, if we do not move soon to give the public domain the first intelligent management program it has ever known, we will have squandered the largest part of what we have left to give to those who must follow us."--Dust jacket.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Public Domain and Democracy: A Study of Social, Economic and Political Problems in the United States in Relation to Western Development It is common knowledge that its settlement and development have had tremendous influences in national life. The history of the whole country is bound up in the rapid extension of her borders and the remarkable expansion of her population. But in large movements one may lose sight of others developing at the same time. To reverse a wellknown saying: "We see so much of the forest that we fail to see the trees." Social developments and social movements have been taking place the significance of which, because of other great national affairs more evident and appreciable, is not yet fully perceived. The importance of population movements in the United States and the occupation of the Public Domain rests in the fact that they have created a condition of successive change; of social unstability; of social, economic and political restlessness; and have carried with them peculiarly vital developments in various phases of American life. No population removal of history, perhaps, has been accompanied by any more marked social phenomena than that beginning in America at the close of the Revolutionary War and continuing to the present. No movement within the range of modern times has been fraught with greater import than has this one which transplanted a portion of the roots of a vigorous people on a restricted sea-board to the wilds of a frontier which shortly teemed with life and civilization. Available in PDF, EPUB and Kindle. Book excerpt: Digital technology has made culture more accessible than ever before. Texts, audio, pictures and video can easily be produced, disseminated, used and remixed using devices that are increasingly user-friendly and affordable. However, along with this technological democratization comes a paradoxical flipside: the norms regulating culture's use - copyright and related rights - have become increasingly restrictive. This book brings together essays by academics, librarians, entrepreneurs, activists and policy makers, who were all part of the EU-funded Communia project. Together the authors argue that the Public Domain - that is, the informational works owned by all of us, be that literature, music, the output of scientific research, educational material or public sector information - is fundamental to a healthy society. The essays range from more theoretical papers on the history of copyright and the Public Domain, to practical examples and case studies of recent projects that have engaged with the principles of Open Access and Creative Commons licensing. The book is essential reading for anyone interested in the current debate about copyright and the Internet. It opens up discussion and offers practical solutions to the difficult question of the regulation of culture at the digital age.

Book excerpt: "Cadastral surveys are performed to create, mark, and define, or to retrace the boundaries between abutting land owners, and, more particularly, between land of the Federal Government and private owners or local governments. As referred to here, cadastral surveys were performed only by the General Land Office during its existence and by the Bureau of Land Management. The Bureau of Land Management is the only agency that is currently authorized to determine the boundaries of the public lands of the United States. Proper understanding of the basis for performance of cadastral surveys includes an understanding of the history of the public land surveys. An understanding of that history requires some consideration of the people who performed these surveys and of the people whose land was affected by them. These chapters were written to be used as an aid in training cadastral surveyors in the application of surveying principles. The learner is expected to gain from the factual material on survey laws and their formation, as well as from a study of the people who performed the surveys. Many of the men who had an important role in the history of cadastral surveying are still living, but only those who have retired are included in the present document."--Foreword.
