Book excerpt: Excerpt from Cases on the Law of Personal Property The purpose of this book is to set out and illustrate by concrete cases these fundamental principles. In selecting these cases, the author has kept in mind two things; viz., first, to include no case based on obsolete law; second, to include only so much of the case as is in point. The cases have also been arranged in such a way as to develop, in a logical order, the legal principles under discussion. As a further help to the student, a topical heading has been used for each case or group of cases the purpose being to give the student something definite to look for. The heading, however, in no instance, reveals the holding of the case, for the author has been as careful to pre vent legal conclusions being drawn from the headings as he has been particular in selecting suitable headings. The cases selected are of such a type and variety as to illustrate, in a comprehensive manner, the underlying principles of the law of Personal Property. Available in PDF, EPUB and Kindle. Book excerpt: The Fourth Edition continues the emphasis on real-life problems and transactions that has distinguished these teaching materials for decades. As in previous editions, the Problems are tailored to focus the student's attention on the relevant statutory language and its application to common patterns of secured financing. They emphasize counseling, planning, drafting, and litigation skills. In addition to more traditional Problems, which ask the student to predict the outcome, many of the Problems ask the student to give advice to clients, to structure transactions, and to draft certain provisions of documents. As in the Third Edition, many of the Problems are based upon Prototype transactions that feature actual transaction documents. The first'financing an automobile dealer's inventory and financing a consumer buyer's purchase of an automobile from the dealer'affords the basis for a discussion of basic Article 9 concepts in a concrete setting. The second Prototype features an accounts and inventory ?borrowing-base? secured credit facility and includes a revolving credit agreement and security agreement. This Prototype forms the basis for detailed coverage of various types of financing secured by receivables and other intangible property.

Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Cases on the Law of Personal Property The author has long been of the opinion that the subject of Personal Property was deserving of more attention than is often times given to it in the law schools of this country. This seems particularly so because of the constantly increasing volume of this type of property, and the multiplicity of legal relations arising therefrom; and while many phases of the subject naturally lend themselves to separate treatment, yet there is a certain body of legal principles which underlie and run throughout the subject of Personal Property, a knowledge of which is highly desirable, if not absolutely necessary to a reasonable understanding of the law. The purpose of this book is to set out and illustrate by concrete cases these fundamental principles. In selecting these cases, the author has kept in mind two things; viz., first, to include no case based on obsolete law; second, to include only so much of the case as is in point. The cases have also been arranged in such a way as to develop, in a logical order, the legal principles under discussion. As a further help to the student, a topical heading has been used for each case or group of cases, the purpose being to give the student something definite to look for. The heading, however, in no instance, reveals the holding of the case, for the author has been as careful to prevent legal conclusions being drawn from the headings as he has been particular in selecting suitable headings. The cases selected are of such a type and variety as to illustrate, in a comprehensive manner, the underlying principles of the law of Personal Property. Available in PDF, EPUB and Kindle. Book excerpt: Landmark Cases in Property Law explores the development of basic principles of property law in leading cases. Each chapter considers a case on land, personal property or intangibles, discussing what that case contributes to the dominant themes of property jurisprudence – How are property rights acquired? What is the content of property rights? What are the limits or boundaries of property? How are property rights extinguished? Individually and collectively, the chapters identify a number of important themes for the doctrinal development of property institutions and their broader justification. These themes include: the obscure and incremental development of seemingly foundational principles, the role of instrumentalism in property reasoning, the influence of the law of tort on the scope of property doctrines, and the impact of Roman legal reasoning on the common law of property. One or more of these themes (and others) is revealed through careful case analysis in each chapter, and they are collected and critically explored in the editors' introductions. This makes for a coherent and provocative collection, and ensures that Landmark Cases in Property Law will be lively and essential reading for scholars, practitioners, and all those interested in the development of property principles at law.

Book excerpt: An argument for retaining the notion of personal property in the products we “buy” in the digital marketplace. If you buy a book at the bookstore, you own it. You can take it home, scribble in the margins, put in on the shelf, lend it to a friend, sell it at a garage sale. But is the same thing true for the ebooks or other digital goods you buy? Retailers and copyright holders argue that you don't own those purchases, you merely license them. That means your ebook vendor can delete the book from your device without warning or explanation—as Amazon deleted Orwell's 1984 from the Kindles of surprised readers several years ago. These readers thought they owned their copies of 1984. Until, it turned out, they didn't. In The End of Ownership, Aaron Perzanowski and Jason Schultz explore how notions of ownership have shifted in the digital marketplace, and make an argument for the benefits of personal property. Of course, ebooks, cloud storage, streaming, and other digital goods offer users convenience and flexibility. But, Perzanowski and Schultz warn, consumers should be aware of the tradeoffs involving user constraints, permanence, and privacy. The rights of private property are clear, but few people manage to read their end user agreements. Perzanowski and Schultz argue that introducing aspects of private property and ownership into the digital marketplace would offer both legal and economic benefits. But, most important, it would affirm our sense of self-direction and autonomy. If we own our purchases, we are free to make whatever lawful use of them we please. Technology need not constrain our freedom; it can also empower us.
