Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Negligence, Vol. 1 of 2: Relations Not Resting in Contract; Illustrated by Leading Cases and Notes The preface of a book ought to be a brief advertisement of its con tents and purposes, from the author's point of view. These volumes embody an attempt to classify and present the case-law of England and America on the subject of Negligence, in relations not springing out Of contract, in a form which it was thought would prove most useful and convenient to practising lawyers. Dismissing the definitions of negli gence which are usually given in the law-books, the writer came to the conclusion that its proper legal meaning is a failure of duty, generally unintentional, but sometimes intentional.1 The foundation of every action for negligence is, therefore, a duty on the part of the defendant toward the plaintiff to abstain from doing what he did, or to do what he failed to do. Book excerpt: Excerpt from The Civil Liability: For Personal Injuries Arising Out of Negligence In the preparation of the present edition, the text of the work has been revised, all errors discovered corrected, and obsolete and redundant matter expunged. A great amount of new matter has been added under the respective section heads, and a number of supplementary sections inserted. The cases, reported since the publication of the first edition, have been examined, and about seventeen hundred citations from the decisions of the courts of last resort added to the work. Gratefully acknowledging the favor with which the the first edition of the book has been received, the author believes that its thorough revision, and the additions made to it in the present edition, will be found materially to have increased its value, both to the student and the practising lawyer. Book excerpt: Excerpt from A Treatise on the Law of Contributory Negligence I have made this book upon the Law of Contributory Negligence in the belief that such a work, even if only fairly well done, would be timely, and might possibly be, in some degree, useful to the bench and bar. The libraries have furnished, hitherto, no separate treatise upon this subject; the latest editions of the standard works upon the Law of Negligence, which consider Contributory Negligence only incidentally, were published several years ago, and the subject is one of constant, and constantly increasing interest and importance to the profession. It is by far the most important and material branch of the Law of Negligence, and although we already have at hand, aside from the several English treatises, the three excellent American works of Messrs. Shearman & Redfield, Dr. Wharton, and Judge Thompson respectively - each in its way the best of the three - I have thought, because the subject is an interesting one and impinges so much upon so many other leading titles in the law, that this work of mine might supplement rather than supplant what has already been better done upon the more general subject of Negligence, and that it might, in consequence, turn out not a wholly superfluous undertaking. I have collected and cited more than three thousand cases - not omitting, as I believe, a reference to any valuable adjudication in point, by the State and Federal courts of our own country, and have endeavored to give a due prominence to recent English authorities, and to include, particularly, citations from the latest volumes of the reports and from current periodical legal literature. I may frankly acknowledge that in the progress of my work I have drawn without stint from many sources. I owe much to the three American treatises on Negligence, to divers other works, and to many essayists, pamphleteers, and reporters, as the notes declare. Book excerpt: Excerpt from A Treatise on the Law of Damages The general plan Of this work is as follows: The first chapter contains a general survey Of the subject; the nine chapters following, a statement and illustration Of elements, principles and rules relating to it; the next ten chapters the law Of damages applicable in cases Of breaches of con tracts; the following fourteen chapters the law of damages in all the various classes of torts; the succeeding one relates to damages under various statutes; the next chapter discusses the subject of nominal damages; and the last treats Of the power and discretion of the court to set aside verdicts for excessiveness or inadequacy. It has been my aim to furnish the practitioner with a useful and convenient treatise, embracing the latest statement Of the law and the most recent authorities; and I entertain a hope that its general usefulness may be largely augmented by the system and method I have pursued.
