O debate acerca da vetusta teoria dos direitos adquiridos é decisiva para uma releitura necessária da importância e da abrangência do instituto no Brasil, sobretudo diante de posicionamento do Supremo Tribunal Federal desde 1900 até os dias atuais, entendendo como axiomático o pensamento que não existe direito adquirido a regime jurídico. A objeção ao modo de pensar arraigado da Suprema Corte brasileira se desenvolve por meio dos conceitos de apoio da força normativa da Constituição, da confiança legítima no Estado e da segurança jurídica, formando uma tríade de garantia dos direitos dos cidadãos em uma democracia como a nacional. De posse destes conceitos, e após evidenciar as premissas teóricas sobre o direito adquirido e sobre o direito adquirido a regime jurídico, buscou-se indicar concretizações da tese em questões relevantes do cotidiano forense, acadêmico e social contemporâneo do Brasil. Ao final, dada a pandemia do COVID-19, encerra-se com uma análise dos direitos adquiridos em tempos de pandemia e como é possível que ambos dialoguem – os interesses personalíssimos e o público difuso.
