The Transboundary Waters Interaction NexuS (TWINS) examines the coexistence of conflict and cooperation in riparian interaction. This framework highlights the importance of power relations between basin states that determine negotiation processes and institutions of water resources management. The analysis illustrates the way river basin management is framed by powerful elite decision-makers, combined with geopolitical factors and geographical imaginations. In addition, the book explains how national development strategies and water resources demands have a significant role in shaping the intensities of conflict and cooperation at the international level. The book draws on detailed case studies from the Ganges River basin in South Asia, the Orange–Senqu River basin in Southern Africa and the Mekong River basin in Southeast Asia, providing key insights on equity and power asymmetry applicable to other basins in the developing world.

Book excerpt: Water - and its governance - is becoming a global concern partly because it is turning into a goods in short supply, with devastating effects on literally billions of people, but also because it is the "carrier" of global warming; whether through irregular weather patterns or through flooding, water is how global warming will be 'felt'. The lion's share of the globally available fresh water resources is to be found in transboundary systems. In spite of its significance, the generated knowledge on how to deal with transboundary waters is weak and leaves policy makers with seemingly unavoidable, trade-off dilemmas and prioritizations, often with detrimental effects. In order to disentangle this predicament this volume works with one case: the Lower Mekong Basin and covers state-of-the-art academic and practitioners' knowledge and hence appeals to a wide audience. The topic this volume addresses is situated in the nexus of an IR- (International Relations) approach focussing on transboundary politics and its inclination to remain within the sphere of state sovereignty and national interest on the one hand, and Development studies, with its imperatives on participation, planning, and intervention, on the other. Asia, with 1.5 billion of its people living in shared river basins, and with very few transboundary rivers governed by treaties, is especially prone to such conflicts. The key to mitigating transboundary water conflicts and advancing cooperation in Asia is largely in the hands of China, the upstream country for most of Asia’s major transboundary rivers. To avert the looming water crisis, apart from spending billions of dollars on domestic water transfer projects such as the South–North Water Diversion Megaproject, as well as on water conservancy and pollution abatement, China has sought to utilize the water resources of the major rivers that run across borders with neighbouring countries. On these transboundary rivers, China has built or plans to build large dams for hydroelectricity and major water diversion facilities, which has triggered anxiety and complaints from downstream countries and criticism from the international society. This book aims to systematically examine the complex reality of water contestations between China and its neighbouring countries. It provides a discussion on transboundary hydropolitics beyond the state-centric geopolitical perspective to dig into various political, institutional, legal, historical, geographical, and demographic factors that affect China’s policies and practices towards transboundary water issues. This book also provides a collection of comparative case studies on China’s water resources management on the Mekong River with other five riparian states in the Lower Mekong region: the Salween River with Myanmar, the Brahmaputra River with India, the Amur River with Russia and Mongolia, the Illy and Irtysh Rivers with Kazakhstann, and the Yalu and Tumen Rivers with North Korea. Freshwater resources are scarce and different nations, actors and users compete for limited resources in transboundary river basins; often conflicting with each other. Water is a resource with no substitute: it cannot be secured in sufficiently large quantities through long-distance trade deals; and, due to the interconnectivity of the hydrological system, the actions of one country in its water management have a direct bearing on the interests of neighbouring countries. For instance, in the Mekong River Basin, current hydropower and navigation developments in certain countries impact on traditional sources of income such as fisheries, and rice production in others. These kinds of changes in water use have given rise to conflict between countries in that region and others, but have also led, in some cases, to greater cooperation. The past few decades have seen a number of new agreements about the sharing of river resources and cooperation between riparian states. Negotiating for Water Resources explores the drivers of conflict and cooperation between states in transnational river basins. Drawing on extensive fieldwork and interviews on the Mekong, Danube and La Plata River Basins, the book provides a three level analysis across three case studies, including the regional framework (EU, ASEAN and Mercosur), the River Basin Organisations (ICPDR, MRC and CIC) and the micro-level. The key question of the book is: To what extent do power asymmetries prevent or inhibit cooperation between riparian states over water resources? This is linked to the question of how institutions contribute to mitigate competition for natural resources and how states interact in a multilateral arena. Overall, the book argues that cooperation in transboundary river basins is possible even where there are asymmetric power relations, challenging realist assumptions about competition and conflict over resources.

A comparative analysis of these two global water conventions and the 1995 Mekong Agreement reveals that all three instruments are generally compatible. Nonetheless, the international legal principles and processes set forth in the two conventions can render the Mekong Agreement more up-to-date, robust and practical. The Governance Regime of the Mekong River Basin: Can the Global Water Conventions Strengthen the 1995 Mekong Agreement? contends that strengthening the Agreement would be timely, given the increasing pressures associated with the rapid hydropower development within the basin and the gradually emerging disputes therein. Due to these fast-moving developments, Kinna and Rieu-Clarke strongly recommend that the Mekong states should seriously consider joining both conventions in order to buttress and clarify key provisions of the 1995 Mekong Agreement.

This book provides an understanding of water security in Asia by investigating how shared water resources affect China’s relationships with neighbouring countries in South, East, Southeast and Central Asia. Since China is an upstream state on most of its shared transboundary rivers, the country’s international water policy is at the core of Asia’s water security.
