Available in PDF, EPUB and Kindle. Book excerpt: A school exclusion is a sanction of last resort that can adversely impact a pupil's life outcomes for many years after the event. The law relating to school exclusions is a complex tangle of public and regulatory law, anti-discrimination and human rights, statutory guidance, and (in relation to independent schools) principles of commercial contract and tort. It can be very difficult to know where to start, whether challenging a decision to exclude or defending one. This book offers a practical guide to the law, and will serve as a useful source of reference for pupils and their parents, head teachers, governing boards of schools, local authorities and practitioners in this surprisingly complex and multidisciplinary area. ABOUT THE AUTHORS Charlotte Hadfield is the head of 3PB Barristers' (3 Paper Buildings) Education Team. She is a specialist in all areas of law related to education, including health, social care and employment law, and has a particular interest in exclusion and discrimination. She is listed in the Legal 500 and Chambers & Partners as a leading junior in education law. Charlotte's first introduction to education law was as a clerk for independent appeal (now review) panels. She represents excluded pupils, their parents, governing boards and local authorities before independent review panels, in the First-tier Tribunal and the County Court in claims for discrimination and breach of contract, and in the Administrative Court in judicial review proceedings. Charlotte has also appeared in education-related appeals before the Upper Tribunal and the Court of Appeal. Her clients appreciate her approachability, pragmatism and user-friendly advice in conference, and her knowledge, experience and attention to detail in hearings. Charlotte has delivered training on all aspects of education law to a variety of audiences, including parents, schools, local authorities, expert witnesses and lawyers. Alice de Coverley is a specialist education, equality, inquiries and public law barrister with 3PB Barristers (3 Paper Buildings). She regularly acts on behalf of children and young people, vulnerable adults, parents and carers, schools, local authorities, charities and NGOs, government departments including Ofsted, students, and universities. Alice has been challenging unlawful exclusion practices since she was at law school, when she was the Chief Director of the award-winning pro bono unit, the "School Exclusion Project". In 2012 the School Exclusion Project won the 'Bar Pro Bono Award'. In 2014 the School Exclusion Project was runner up in the Attorney General LawWorks Pro Bono Awards for 'Best Contribution by a Team of Students'. Alice has also helped to create a number of BBC Radio 4 programmes about school exclusions. She is also newly listed this year in both the Legal 500 and Chambers & Partners.

Available in PDF, EPUB and Kindle. Book excerpt: While the state has extensive powers and duties in relation to state-funded education, independent schools largely sit outside that regime on condition that they meet prescribed standards. 'A Practical Guide to the Independent School Standards' introduces the standards from a rights-based perspective and explains their role in connection with registration and inspection of independent schools. Busy practitioners are signposted to the key guidance and regulations incorporated into the deceptively short standards. The parts of education law which do and do not apply to the independent sector are clearly identified. After outlining the standards and linking to relevant legislation and recent case law which help with interpretation, this book shows how the standards can be applied to common issues affecting pupils such as SEND, mental health, peer-on-peer abuse, admissions and exclusions. The closing chapters consider the role of the standards when things go wrong whether it is a parent wishing to complain about a school, a school questioning the findings of a compliance inspection and/or responding to action by the regulator. Intended primarily for education lawyers, 'A Practical Guide to the Independent School Standards' will also be an invaluable accessible resource for independent schools and parents.

Book excerpt: "A definite must for SENCOS." -- Urmston Junior School "A good insight into process of tribunal and what the Equality Act means." -- Team Leader, St Paul's CE Primary School 'A much needed resource in supporting schools, centres, day nurseries and community childcare provision to understand the complexity of the issues surrounding SEN... A valuable tool.’ -- Gerri Ross – Head of Old Moat Sure Start Children’s Centre, UK "Straightforward and easily accessible...I would recommend this book to undergraduates and professionals alike who have an interest in ensuring that the rights of disabled children are upheld." -- Dr Craig Blyth, School of Education, University of Manchester, UK Under the Equality Act (2010), all schools and service providers have a legal obligation to make provision for disabled pupils, staff and school users. If you’re feeling confused and concerned about the content and implications of the Disability Duty Act (1995) and the more recently released Equality Act (2010), and how it affects your setting, this essential book will help you unpick the issues in a user-friendly and easily accessible way. This highly practical resource: explains the main parts of Equality Act (2010) as it affects disability in a way that will encourage all members of staff within a school to feel confident that they are correctly implementing its requirements; discusses ‘reasonable adjustments’ and ‘less favourable treatment’ which are at the heart of the legislation; shows how ‘less favourable treatment’ and ‘reasonable adjustments’ apply to admissions, exclusions, handling of medicines and during school trips; uses examples and case studies throughout, and highlights the key factors for success in making reasonable adjustments; takes readers through the process of an alleged act of discrimination against the school, and how it may be resolved, up to and including the SEND tribunal process. The author brings a wealth of experience to this topic, both as a parent of a disabled child and as a trainer of professionals. She uses her unique insight to develop skills and awareness in anyone who follows her material, and shows through tried and tested concepts and methods, how schools and settings can avoid costly and stressful tribunals. Headteachers, teachers, SENCos, Sure Start Centre Managers and anyone who works in educational settings will find this book essential to their professional development and a fantastic source of support and help.

Available in PDF, EPUB and Kindle. Book excerpt: The goal of this book is to provide comprehensive and practical knowledge of relevant legal issues that affect the administration of public schools. It will allow educators to effectively perform their duties within the boundaries of constitutional, statutory, and case law. It is also designed to be easy to understand for those with little or no legal background. Selected court cases address issues most relevant to education. It includes recent landmark court decisions in areas such as religion, student rights, student and faculty disabilities, and classroom harassment. School violence is discussed comprehensively. The book begins with an index of major legal issues related to relevant issues, allowing the reader to ascertain the legal sources of authority related to those particular topics. Educational leaders are provided with pertinent information to direct their day-to-day decisions. The primary focus is not on state law since this varies from state to state. Appendices include constitutional provisions, selected and annotated federal statutes, and an abbreviated glossary. It will enable educators to perform their legal duties and to meet the requirements of reasonableness as they move their organizations toward their goals. (Contains 279 references.) (RKJ)

Based on systematic observation of exclusion appeal panel hearings.Challenges to School Exclusion offers a unique insight into the appeal process. It focuses on: *mechanisms by which parents and children can challenge permanent exclusion *the law and current practice *the social context of exclusion *reforms of the appeal system made by the School Standards and Framework Act *the DfEEs latest guidance on pupil inclusion. Challenges to School Exclusion is the first study to examine permanent exclusion. The findings reveal serious deficiencies in the appeal system, including a frequent failure to deal fairly with excluded children. The text will be of particular interest to head teachers, local education authorities, school governors, education lawyers and education charities.
